File Note: Subject: Proceedings of the personal hearing given to M/s Sukhbir Agro Energy Limited, Village Sedha Singh Wala, Tehsil Jaito, Faridkot before refusal of 'consents to operate' under the provisions of Water Act, 1974 & Air Act, 1981by the Chairman of the Board on 07.06.2024............. The following were present: From Board's side: Er. Sandeep Bahl, CEE, Bathinda Er. Rakesh Kumar, SEE, ZO, Bathinda Er. Ruby Sidhu, EE, ZO, Bathinda From industry side: Sh. Karamjit Singh, Unit Head............... It was brought out that the industry is a bio-mass power plant of capacity 18 MW and was granted consents to operate under the Water Act, 1974 & Air Act, 1981 on 24.01.2020 (valid upto 31.03.2024)............. The industry was visited on 06.04.2022 and emissions samples were collected from the boiler of capacity 80 TPH and as per the analysis report, the conc. of particulate matter was found to be 56 mg/Nm3 i.e. beyond the permissible limits.Also a complaint was received regarding the indiscriminate the disposal of fuel ash and the nuisance being caused by the industry............ The industry was visited by officer of the Board on 11.05.2023 and it was observed that:-.............. 1. The industry has begun the work regarding installation of ESP as APCD with the boiler and has only erected steel girders for the same. The industry has not submitted any technical report w.r.t. installation of ESP nor has submitted any PERT chart in the matter.............. 2. During visit, the stack of the industry was found emitting black smoke intermittently at continuous intervals................... 3. The industry has installed one Online Continuous Ambient Air Quality Monitoring Station; however the same is yet not connected with server of PPCB/CPCB.................. 4. The foundation work regarding construction of STP is almost complete; however neither the industry has submitted any technical report w.r.t. installation of STP nor submitted any PERT chart in the matter............. 5. The green belt provided by the industry is not adequate as it has failed to develop 33% of the area under green belt in compliance to the condition imposed in the Environmental Clearance granted to it......... 6. No in-house management of solid waste provided in compliance to the Solid Waste Management Rules, 2016................ 7. The industry failed to submit any compliance w.r.t. the conditions imposed in the environmental clearance regarding ash content, specific water consumption, ground water quality, CER activities, Energy and water audit, In-situ/ex-situ conservation Plan implementation & health etc.............. The industry was issued show cause notice before revocation of CTOs under the Water Act, 1974 & Air Act alongwith an opportunity of personal hearing before the Chairman of the Board on 26.07.2023, wherein it was decided that:-............... 1. The industry shall ensure the installation & commissioning of ESP with boiler to control boiler emissions by 25/09/2023 and shall submit monthly progress report to the Board in this regard............... 2. The industry shall ensure that no black smoke is emitted from the boiler stack at any time and shall achieve the prescribed emission standards at all times.................. 3. The industry shall ensure the compliance of conditions of environmental clearance obtained under the EIA Notification dated 14.9.2006 as well as ‘consents to operate’ under the Water Act, 1974 and the Air Act, 1981 at all times.................. 4. The industry shall ensure that STP will be installed and commissioned well before the occupancy in the labour colony.............. The industry was visited by the officer of the Board on 15.12.2023 and it was found that ESP has been installed as APCD with the boiler of capacity 80 TPH, emission sample was collected from the stack of the boiler and as per the analysis report, the conc. of particulate matter was found to be 45 mg/Nm3, which is beyond the permissible limits........................ The industry has applied for obtaining extension in the validity of CTOs under the Water Act, 1974 & Air Act, 1981............. The industry was visited by the officers of the Board on 28.02.2024 & 25.04.2024 and it was found that:-........... 1. ESP has been installed as APCD with the boiler of capacity 80 TPH and the stack condition was observed to be almost clear to light grey............. 2. The fuel ash is being dumped through truck/tippers in low lying areas; however fuel ash disposal action plan with mechanism to track the outgoing truck on real-time basis is not submitted by the industry............ 3. STP installed but not in operation and the effluent was found being collected in the collection tank of the STP................ 4. As per the condition of the environmental clearance granted to the project, the green belt is required to be developed in 33% of the total area i.e. 8 acres, however pockets of green belt developed in only 6 acres of land area having only 01 big patch of matured trees and other patches with very small trees............. In view of above, show cause notice before refusal of 'consents to operate' under the provisions of Water Act, 1974 & Air Act, 1981 has been issued to the industry alongwith an opportunity of personal hearing before the Chairman of the Board on 07.06.2024............. During hearing, the representative of the industry submitted written reply to the notice issued, which has been taken on record, wherein it was stated that:-:-............... 1. The Industry has installed ESP as a APCD with Boiler and has been operational from Sep. 2023. We have monitored the stack emission from PBTI and the parameter of Stack is under the limit................ 2. The fuel ash of the industry dumped through cover tipper in low lying area as requested by nearby public. copy of request letter is enclosed. The company has made agreements dumping of ash, which is sufficient for the next 6 months. The land is being filled with ash after mixing it with soil as per PPCB norms............... 3. The residential colony of the industry is under construction and there is no occupancy in the colony of industry. Only domestic effluent is being generated from the office section and Pantry section, STP was not in operation during the visit of PPCB officer as the quantity of waste water generation was not sufficient to run the STP.............. 4. The industry had developed plantation area in 8-acre land. But about 2-acre land of industry periphery had been destroying by the surrounding farmers Now we have managed the land of 2-acre land with in factory premises Land), which is under developing for plantation.................. During hearing, the matter regarding non-compliance of the conditions of the environmental clearance granted to the industry, especially w.r.t. providing green belt was deliberated and the Chairman of the Board shows his displeasure for non-complying the EC. The industry also requested to grant consents so that they can manage the acquired paddy as fuel................. After hearing the representative of the industry as well as Officers of the Board, the Chairman of the Board has decided that:-................ 1. The industry shall submit a comprehensive bank guarantee of Rs. 10.0 lac as an assurance to comply with the environmental laws, within 07 days to the Regional Office, Faridkot of the Board................ 2. The industry shall provide adequate plantation i.e. 33% of the total area of the unit to comply with the EC condition, within 02 months................. 3. The 'consent to operate' applied by the industry under the Water Act, 1974 & Air Act, 1981 be granted to the industry for one year.............. 4. The industry shall ensure to achieve the prescribed emission standards at all times. 5. The industry shall submit a comprehensive action plan for the disposal of its fuel ash with GPS enabled vehicles so as to trace the fuel ash disposal vehicles at any times................. 6. The industry shall submit details regarding total land available (within the premises as well as outside the premises) for the disposal of its fuel ash along-with the carrying capacity of the said land area.............. 7. The industry shall engage an environmental expert to carry out its day to day activities related to the environment and shall submit the details of the same to the Regional Office, Faridkot of the Board................. 8. Environmental Engineer, Regional Office, Faridkot shall visit the industry to verify the submissions / compliance(s) made by the industry after 02 months and thereafter, submit afresh report along-with recommendations...............
