It is submitted that Sh. Tushen Nayar, G.M. Admin and Sh. Rohit Kapur, CEO of the industry attended the hearing and submitted a written reply which was taken on record. He submitted that the black smoke was emitted only for one (01) minute due to the boiler restarting. To overcome the raised issue, we have already ordered spare parts for up-gradation on 30t January 2024 from Cheema Boilers amounting to Rs. 25-30 lacs and should be receiving the same in the next few days (the purchase orders are attached) and boiler performance shall improve upon up-gradation. With regards to the bank guarantee of Rs. 5 lacs not being deposited, they did not receive any official letter in regards to this matter. Additionally, they already have a Bank Guarantee of Rs. 20 lacs deposited with PPCB since November 2022 against ZLD commitment. On self-request, air sample was tested by PBTI on 06/02/2024 for the renewal of consent. PPCB visited and conducted their own testing on 27/02/2024. The results are way below the required norms in both PBTI & PPCB test results.......
In compliance to the observations raised it is submitted that this office has verified the purchase order for upgradation of APCD made by the industry and the statement made by the representative during the hearing in this regard is correct. Further, the industry has already submitted bank guarantee of Rs. 5.0 Lacs valid upto 31.03.2025 as imposed during hearing held on 20.12.2023, as an assurance to comply with provisions of the Air (Prevention & Control of Pollution) Act, 1981. Further, the industry has already achieved ZLD system and has got it ratified from Institute of repute and has also been verified by Board officers during the last 2 visits it is also submitted hereby that air emission sample were got analyzed by PBTI on 06/02/2024 and PPCB on 27.02.2024 and the sample qualified with the prescribed limits.
