File Note: It is submitted that the construction project is covered under medium scale orange category i.e. 2099: Building and construction projects <= 20,000 sq. m built up area. It is a proposed commercial retail building only and the project as per proposal is not covered under the EIA notification 2006. Now, the project proponent has applied for 'Consent to establish' (NOC) under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 through OCMMS on 04.06.2023. The project proponent has not submitted layout plan approved by CTP/STP, Punjab. However, the layout plan submitted by the project proponent, total covered area mentioned is 4052.948 sq meter and total area 03 acres (12140.468 Sq meters). As such, it is not covered under EIA notification 2006. As per the project report, the total investment on the project shall be Rs. 1085.00 Lacs. The industry has deposited Rs. 21,600/- vide R.No. N151243062407769 dated 30.05.2024 as NOC fee, which is adequate for one year. As per the application from submitted by the project proponent, the proposed project is a supermarket retail outlet offering household products. There is no manufacturing activity proposed at the project site. There will be no trade effluent generation and no boiler/furnace has been proposed. As per the application form, the fresh water requirement of the project shall be met through submersible, the total fresh water requirement of the project as 10 KLD. The total sewage generation from the project shall be 08 KLD. As per the feasibility report/reply of clarification submitted by the project proponent, the project proponent has proposed to install STP of capacity 10 KLD based on physic-chemical treatment followed by bioreactor (MBBR) for treatment of domestic effluent to be generated from the project. The components of the proposed STP shall be bar screen, collection cum equalization tank, bio reactor, secondary tube settler, pre-filtration tank, pressure filters, sludge handling system. The treated effluent will be used for floor washing/toilets and gardening. The project proponent has proposed to earmark area of around 1398.298 sq. mt. as green area. The STP and proposed plantation area is principally adequate. Accordingly, the site of the proposed project was visited by the AEE of this office on 18.06.2024 and it was observed as under:- 1. The project proponent has proposed to establish commercial retail building namely D-Mart. It is located at Village Lalton-1 and 2, Hadbast No. 291, Tehsil and District Ludhiana. 2. The project proponent has yet to start construction activity at the site. 3. There is no Maximum Hazard (MAH) industry at radial distance of 250 meters from the site of the boundary of the project. 4. There is no air polluting industries, rice shellers, brick kiln and stone crushers at distance of 100 meters from the boundary of the project. 5. The project proponent has installed one DG set of capacity 400 KVA will be provided with canopy and adequate stack height. In view of the above, it is recommended that Consent to Establish (NOC) under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted for one year to the project proponent with suitable conditions and special conditions that:- 1. The project proponent shall submit approved layout plan from the concerned authority of GLADA/PUDA. 2. The project proponent shall comply with all the conditions stipulated in the Ludhiana Master Plan. 3. The Consent to Establish (NOC) is granted to the project proponent only for commercial retail building on 03 acres. 4. The project proponent shall not increase the built up area of the project beyond 20,000 square meters, in any case, without obtaining revised Consent to Establish of the Board. 5. The project proponent shall obtain permission from CGWA for abstraction of ground water (if required) and shall comply with the guidelines issued by it from time to time. 6. The project proponent shall provide adequate capacity of bio composter for management of its wet waste and shall provide adequate arrangement such as waste segregation, compost pits, MRF shed etc for management of municipal solid waste as per Solid waste management Rules, 2016. 7. The project proponent shall fulfill its responsibility as a bulk waste generator and shall comply with the provisions of Solid waste management Rules, 2016. 8. The project proponent shall develop adequate green area and shall make arrangements for utilization of its entire treated wastewater for plantation, flushing within its premises. The project proponent shall provide dual plumbing system for back flushing. 9. The project proponent shall comply with the provisions of the Noise Pollution (Regulation & Control) Rules 2000. 10. The project proponent shall ensure compliance to the comprehensive guidelines for the regulation of noise/ sound pollution caused by use of loud speakers, public address system etc. issued by Punjab Government, Deptt. of Science, Technology & Environment vide notification no. 3/100/2013-STP(4)/145 dated 26.02.2014. 11. The industry shall obtain permission from the concerned Department(s) and shall comply with the conditions of relevant permissions obtained by it from other related Departments (if any). 12. The Consent is being issued to the project proponent based upon the undertakings/documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time. 13. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the promoter. The competency to decide the application lies with Senior Environmental Engineer, Ludhiana.
