File Note: It is submitted that the subject cited rice sheller was granted 'Consent to Establish' (NOC) under the Water Act, 1974 and the Air Act, 1981 vide no. CTE/Fresh/FGS/2023/22037919 dated 05/06/2023, which is valid upto 04/06/2024 for establishment of rice sheller unit for manufacturing of Raw Rice @ 2 T/Hour by processing of Paddy (With Drier) @ 3 T/Hour in the name of Sh. Rythem Jindal, (Partner), subject to the suitable terms & conditions mentioned therein. Now, the rice sheller has applied for obtaining fresh consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Raw Rice @ 2 T/Hour by processing of Paddy (With Drier) @ 3 T/Hour with requisite documents and consent fee. The rice sheller has submitted the CA certificate dated 08/03/2024, wherein, it has mentioned that the total value of fixed assets of the unit as on 28/02/2024 is Rs. 129.04 lacs with value of plant & machinery is Rs. 83.04 lacs. Accordingly, the unit has deposited consent fee amounting to Rs. 25,200/- vide UTR No. 716613906 dated 18/05/2024 under the Water Act, 1974 and Rs. 25,200/- vide UTR No. 857286686 dated 18/05/2024 under the Air Act, 1981. As such, the fee deposited by the unit under the both Acts is adequate upto 31/12/2026 as per office order dated 29/10/2018. The date of commissioning is being considered as December 2023. The rice sheller has not submitted building plan under the provisions of 3-A of Punjab Factory Rules, 1952 from the Competent Authority. However, the industry has submitted the Certificate of In Principal Approval issued by DC Fatehgarh Sahib vide no. SPL-2 dated 09/06/2023 under Punjab Right to Business Act, 2020 and sanction building plan and as per condition no (vi) of certificate, it has been stated that during the course of validity of certificate of in principle approval, the enterprise shall at any time but no later than three years and six months from the date of issue of the certificate, apply and obtain all application regular approval from the concerned department through the single window system of Punjab Bureau of Investment Promotions (PBIP). The industry has submitted an undertaking regarding installation of the cyclone separator as APCD with paddy cleaner of dryer section, separately along with adequate stack height and sample collection facilities. To verify the contents of the application, the rice sheller was visited by AEE (OS) of this office on 13/04/2024 and during visit, it was observed as under: 1. The Rice sheller was not in operation. 2. The rice sheller has installed separate cyclone separator as APCD with shelling section and paddy cleaning section of the drier, which is adequate. The industry has submitted the stack emission sampling report carried out by the Board on 18/04/2024 and as per the analysis report, the concentration of SPM was 278 mg/Nm3, which is within the permissible limit as prescribed by the Board. 3. The rice sheller hasprovided brick wall of 10' height with adequate length and further wind screen of 5' height has also provided on the said wall. 4. The rice sheller has provided submersible pump for ground water abstraction and it has installed water meter on it. 5. The rice sheller has provided septic tank for treatment of domestic effluent. 6. The industry hasprovided adequate plantation along the boundary wall. 7. The rice sheller has provided brick paved on movement area of the vehicles. From above, it is clear that the rice sheller is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 as well as code of practice prescribed for such kind of units, deliberating and intentionally. It is submitted that the Govt. of India, Ministry of Jal Shakti, Deptt. of Water Resources RD & GR Central Ground Water Authority, New Delhi has issued directions u/s 5 of Environment (Protection) Act, 1986 vide letter no. CGWA-21/6/2020-CGWA-101 dated 06/04/2022 “that it shall be mandatory for the Project Proponent abstracting ground water to obtain NOC from CGWA or the concerned State/ UT Ground Water Authority as the case made be in the compliance condition in consent to operate and consent to establish issued by the State Pollution Control Board.” Accordingly, the Board vide letter no. 1955-57 dated 18/01/2023 has informed all the officers of the Board in continuation to earlier circular no. CEE(HQ)/2018/7956-84 dated 03/03/2018 and 768-97 dated 13/01/2021 to ensure the compliance of the said directions. PWRDA vide notification dated 27.01.2023 has exempted units from obtaining any permission of the authority, which are extracting not more than 300 cubic meters of ground water per month. In the subject cited case, the rice sheller has mentioned ground water extraction @ 1 KLD. The unit has submitted 180 working days in a year, considering 30 working days in a month during season, so ground water extraction will be 30 KL/month, which is less than 300 KL/month. Therefore, the unit does not require to obtain permission from the PWRDA. In view of the facts mentioned above, if approved, it is recommended that the fresh consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Raw Rice @ 2 T/Hour by processing of Paddy (With Drier) @ 3 T/Hour may be granted upto 30/09/2026 with suitable conditions and following special conditions: 1. The industry shall submit the building plan approved from the Competent Authority within 01 month. 2. The industry shall be bound to comply with the provisions of Master Plan of Fatehgarh Sahib, prepared by the Department of Town and Country Planning, Punjab. 3. The industry shall comply with the guidelines for Abstraction of Ground Water from the Punjab Water Regulation and Development Authority (PWRDA). 4. The industry shall discharge its domestic effluent onto land for plantation after treatment in septic tank. 5. The industry shall ensure that at any time the emissions do not exceed the emission standards laid down by the Board from time to time. 6. The adequacy and efficiency of the air pollution control device will be the entire responsibility of the industry. 7. The industry shall not discharge any fugitive emissions. All gases shall be emitted through a stack of suitable height, as per the norms fixed by the Board from time to time. 8. The industry will comply with the following code of practice notified by the Govt. i. All the processing sheds be covered and have minimum ventilation as per the recommendations of Director of Factories. ii. The industry should plant thick plantation of spreading crown varieties of evergreen trees all along the boundary wall of the rice sheller. iii. All dust emitting points should be properly hooded and dust extracted to a common point. At this exhaust point, dust coming here will be passed through a dust control system and air will be emitted through astackofheight3metres above the roof of the building. iv. The management and handling of rice husk in the rice shelling units should be done as under:- a) All the rice shelling units shall provide paved / brick roads /cement concrete roads/ metal led roads inside their premises for movement of vehicles, so as to prevent the generation of dust. b) The industry shall provide proper rice husk storage facilities inside the factory premises and the height of brick wall in front of the discharge point of rice husk area should be at least 10’ high or 3.5’higher than the discharge point of the rice husk pipe(whichever is more) and the length of aforesaid brick wall should be at least 35’oneachsideofthe rice husk discharge pipe. c) The industry shall provide a layer of wind screen of mild steel or some other similar material of at least 5’ height above the brick wall. The wind screen system should have a porosity of ~30% to lower the wind velocities, thus reducing the amount of air borne particulate from storage, handling and loading/unloading areas of rice husk. d) The minimum diameter at the outlet of discharge pipe of rice husk be kept as 15’’ which can be maintained by extending the existing discharge pipe with the help of a conical shaped pipe of at least 3’length. e) Wherever the height of rice husk is 3’ or more, the industry shall cover the heap of husk with HDPE warp knitted fabric completely, except the area near the discharge pipe. The HDPE warp knitted fabric be made of 100% virgin high density polymer of at least 70gm/m2 weight having 40-45 hole/inch 2 to prevent wind blowing of stored husk. f) During transportation of rice husk through vehicles, it shall be covered from all sides with tar Pauline prevent blowing of husk by winds. 9. The emission standards given in the order dated 13/9/2006 will remain operative for Rice Shellers and Saila Plants. These emission standards are reproduced as under:- Emission Standards for Rice Shellers &Saila Plants in the State of Punjab will be applicable as under: - i. Emissionstandards750SPM(mg/Nm3) ii. Inside the building TLV of air SPM (mg/Nm3) NOTE: The existing units not meeting with the prescribed sitting guidelines will meet with stack emission standards of SPM 500mg/Nm3. 10. The industry shall continue to comply with the new code of practice notified by Govt. Notification no.10/48/2004-STE(4)/932 dated 15/10/2013 at all the times. 11. The industry shall abide by the fresh directions (if any) issued by the Hon'ble Punjab & Haryana High Court/ Govt./ Board for compliance of code of practice of rice sheller. 12. The industry shall not cause any nuisance/traffic hazard in vicinity of the area. 13. The industry shall shift its location to designated area as per directions issued by the State Govt. / Board from time to time and time frame stipulated in Master Plan for industry located in MC limits. 14. The industry shall upgrade/ replace the APCD as per latest notification issued by the Ministry of Environment & Climate Change, New Delhi to achieve the revised emissions stands as amended time to time. 15. The project proponent shall not throw, burn or burry any solid wastes in open, outside premises or in drain/water bodies. 16. The project proponent shall promote use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic, through their Corporate Environment Responsibility (CER) activities. 17. The project proponent shall properly handle and manage the solid wastages as per the provisions of the Municipal Solid Waste Rules 2016 and ensure that the solid waste is segregated & disposed of in an environmentally sound manner. 18. The industry shall provide thick plantation of spreading crown varieties of evergreen trees all along the boundary wall.
