File Note: Sir, it is intimated that the legal opinion was sought from the Senior Law Officer of the Board through hard file. (Copy of Noting is attached herewith). The SLO has given the legal opinion that Consent to Operate under the provisions of the Water Act, 1974 may be granted to MC Khanna in respect of 29 MLD STP with suitable conditions that the MC, Khanna will comply with the directions of the PPCB issued from time to time and will also co-ordinate with other concerned departments to make compliance so as to settle the core issue. A short-term consent to operate in the first instance may be granted to MC, Khanna in respect of 29 MLD STP subject to the decision of the Hon’ble NGT in O.A. No. 414 of 2023. As such, if approved, MC, Khanna may be granted fresh consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 for operation of STP for the short period of 06 months subject to the suitable conditions and additional conditions as under: 1. This consent is granted subject to the decision of the Hon’ble NGT in O.A. No. 414 of 2023 titled as Avtar Singh & Ors. Vs. State of Punjab & Ors. 2. The MC, Khanna will comply with the directions of the PPCB issued from time to time and will also co-ordinate with other concerned departments to make compliance so as to settle the core issue. 3. The MC, Khanna will operate the STP effectively and will maintain the record of the same. 4. The MC, Khanna will connect the OCEMS installed at the outlet of STP with the server of the PPCB/CPCB within 15 days 5. The MC, Khanna shall ensure that no stagnation will cause in the future due to treated wastewater of STP. 6. The MC, Khanna shall ensure that maximum treated wastewater will be utilized for irrigation purpose.
