File Note: Sub:- Application for consent to operate under Air (Prevention & Control of Pollution) Act, 1981 of M/s Ganesh Brick Supply Co., Village-Jhangi Saroop Dass, Gharota Road, District-Gurdaspur. Earlier, the subject cited Brick Kiln was granted Consent to Operate under Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974 vide online reference no. CTOW/Fresh/GRP/2021/14533918 & CTOA/Fresh/GRP/2021/14533900 dated 29/01/2021, which are valid upto 30/09/2025 for the operation of Brick Kiln as per zig-zag technology. Further, it is intimated that the Brick Kiln was visited by the officers of this office on 15/09/2023 and observed as under:- 1. The Brick Kiln was in operation during visit. 2. The BKO has converted to induce draft technology, as the setting of the Bricks was in zig-zag manner and the ID fan was also operational. 3. The Brick Kiln was emitting intense black smoke from the chimney for significant time period resulting into the degradation of the Environment. 4. The Brick Kiln was found using coal as fuel in the Brick Kiln. However, the Brick Kiln has not use atleast 20% Paddy Straw Pellets as fuel with coal as per Board’s notifications no. 10/574/2022-STE1/443 dated 04/11/2022. Taking into consideration the above said violation, the consent to operate under Air (Prevention & Control of Pollution) Act, 1981 of the Brick Kiln was revoked vide letter no. 2483 dated 22/11/2023 and the report was sent to higher authority of the Board for taking further necessary action in this regard and same is under consideration. It is pertinent to mention here that personal hearing before the Senior Environmental Engineer at Amritsar on 20.02.2024, in reference to Show cause notice for violations of the provisions of the Air (Prevention & Control of Pollution) Act, 1981, whereas it was decided as under:- 1. The Regional Office shall check the contentions made by the brick kiln and submit its report along with recommendations within 10-days. In the meantime, the subject cited Brick Kiln has applied for obtaining fresh consent to operate under Air (Prevention & Control of Pollution) Act, 1981 through OCMMS mode. The industry has already deposited Rs. 23700/- vide R/No. 60/5395 dated 19/01/2021, Rs. 21750/- vide R/No. 61/5395 dated 19/01/2021, Rs. 2900/- vide R/No. 62/5395 dated 19/01/2021 and now, deposited Rs. 9200/- vide online UTR No. 230674775 dated 17/06/2024 as consent to operate fee under Air (Prevention & Control of Pollution) Act, 1981, which is adequate upto 30/09/2029 including Rs. 500/- as Form downloading fee. The industry has already submitted completion certificate issued by Central Building Research Institute, Roorkee intimating that the industry has constructed High Draft Brick Kiln with zig-zag technology, rectangular in shape as per CSIR CBRI design via drawing no. 19/1113. The industry was visited by officer of the Board on 18/06/2024 and observed as under:- 1. The industry was in operation during the visit. 2. The industry has stabilized the peripheral road around the kiln trench with brick bats/keri. 3. The industry has planted new saplings along the boundary of Brick Kiln. 4. During visit, it was found that the brick kiln has store pellets in its premises along with coal. 5. The industry has installed platform and ladder with stack for sample collection purpose. Sampling facility installed by the industry is adequate. 6. The industry complied with the code of practice prescribed by the Board for brick kilns. From the above mentioned facts it is evident that the brick kiln is now complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. In view of the above, it is recommended that Consent to operate under Air (Prevention & Control of Pollution) Act, 1981 may be granted to the Brick Kiln for a period upto 30/09/2029 subject to the suitable conditions along with the special conditions as under:- 1. The project proponent shall comply with code of practice/directions issued by PSCST, Chandigarh. 2. The brick kiln will obtain Environmental Clearance under EIA notification for mining of brick clay to be used as a raw material for the manufacturing of bricks as per Head Office order no. 346 dated 1/8/2016. 3. The brick kiln shall get its stack emission analyzed as per policy of the Board. 4. The consent is subject to the orders passed by the Hon’ble High Court for the state of Punjab & Haryana/Hon’ble National Green Tribunal or other judiciary authority in the cases pending or being filed with regard to the subject matter of the office order. 5. The consent is subject to the performance evaluation of new technology adopted by the brick kiln. 6. The brick kiln will plant adequate trees around the boundary of the Brick Kiln. 7. The Brick Kiln shall use atleast 20% Paddy Straw Pellets as fuel with coal as per Board’s notifications no. 10/574/2022-STE1/443 dated 04/11/2022. Note:- It is also recommended that the above note may also be sent to Zonal Office, Amritsar for information please.
