the directions u/s 33-A of the Water ) Act, 1974 and u/s 31-A of the Air Act, 1981 were issued to PSPCL Authorities for disconnection of the electricity connection and the electric connection of the industry has been disconnected by PSPCL authorities vide TDCO No. 29/274 dated 24.01.2024 in compliance of the directions.
Though the present violations are under Water Act but the consent to operate under Air Act can also not be granted until the directions under Water Act stands. And the industry is still violating the provisions of Water Act so restoration of electric connection can-not be recommended. As such without restoration of electric connection CTO under Air act can also not be granted. the industry has not complied with the decisions of the personal hearing dated 26.04.2024.............
In view of above, As recommended by RO application of the industry for obtaining CTO under the Air act, 1981 may be refused, please. |
