Sir, the industry was issued show cause notice for violation of provisions of the Water Act, 1974 and Air Act, 1981 with an opportunity of personal hearing before Senior Environmental Engineer, Zonal Office-I, Ludhiana on 03.06.2024 in which following decisions were taken:- 1. The industry shall close soakage pit immediately and develop adequate plantation area for discharge of treated domestic effluent. 2. The industry shall submit within 02 days, the Bank Guarantee of Rs. 1.0 lacs, as already imposed during hearing held on 15.05.2024. 3. In case, the industry fails to make the compliance, action u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 shall be recommended to CEE, Ludhiana. 4. The Environmental Engineer, Regional Office shall verify submission made by the industry and submit further recommendations, accordingly.
In the meantime, the industry has applied fresh consent to operate under the Water Act, 1974 and Air Act, 1981.
The site of the industry was visited by RO on 07.05.2024 and 14.05.2024 and it was reported that the industry has not submitted the Bank Guarantee of Rs. 1.0 lacs in compliance to decision of personal hearing and not provided adequate stack height to its thermostat.
The industry has not submitted an analysis report of air emissions and not submitted detailed drawing indicating the plantation area for discharge of treated domestic effluent. Moreover, the industry has been established without NOC of the Board. The industry has not submitted point wise compliance to the NOC conditions which would have been imposed if the industry earlier had obtaining 'Consent to Establish' (NOC).
In view of the above, it is recommended that show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 alongwith notice u/s 33-A of the Water Act, 1974 and u/s 31-A of Air Act, 1981 may be issued to the industry with hearing before CEE Ludhiana, please.
