File Note: Kindly peruse the note of AEE. On perusal of the note of AEE, it is intimated that the industry i.e. M/s Mittal Ceramics was issued directions u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 for the disconnection of electric supply available to the unit due to non-submission of adequacy cum completion certificate from PSCST, Chandigarh and has failed to comply with the conditions of the consent granted to it under the Air (Prevention & Control of Pollution) Act, 1981. Thereafter, the industry was granted consents to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, which were valid upto 31/12/2022 in the name & style of M/s Evit Steels Private Limited L/o M/s Mittal Ceramics. The industry was allowed to operate its unit subject to the condition that the industry shall submit bank guarantee amounting to Rs. 2.0 lacs within 07 days, as an assurance to complete the modification of APCD as per the feasibility report of PSCST, Chandigarh by 30/09/2022 and to comply with the provisions of the pollution control laws. Also, the PSPCL Authorities were also directed to restore the electric connection of the industry upto 31/12/20222. As per the record file, the industry was issued notice for imposition of Environmental Compensation for violations of the provisions of the Hazardous and Other Waste (Management and Trans-boundary) Rules, 2016 alongwith an opportunity of personal hearing before the Chairman of the Board on 17/08/2022, wherein, it was decided as under: 1. Environmental Compensation amounting to Rs. 4 lakhs shall be deposited by the industry within 15 days. 2. The industry shall maintain the record of the hazardous waste category 35.1 in a proper manner and shall submit the same at RO, FGS on regular basis. 3. The industry shall dispose of its hazardous waste category 35.1 to an authorized re-cycler and will not dispose of the same in an illegal manner under any circumstances. 4. The Regional Office shall process the authorization application of the industry after depositing the Environmental Compensation. Further, the industry was issued notice to issue directions u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 alongwith an opportunity of personal hearing before the CEE (B) on 04/05/2023, wherein, it was decided as under: 1. The industry shall provide staircase and sample collection facility with the stack within 7 days. 2. The Industry shall install an online continuous emission monitoring system with its stack within 15 days. 3. The Industry shall submit proof of the Induction furnace capacity, immediately at Regional Office, Fatehgarh Sahib. 4. Environmental Engineer, Regional Office, Fatehgarh Sahib shall visit the industry after 15 days to verify the compliance of the hearing decisions and process the consent cases on merits. In compliance to the decision of personal hearing, the industry was visited by the AEE on 03/11/2023 and during visit, the industry was found not in operation. Sh. Sukhvir Singh, Manager of the industry informed that the industry does not operated on regular basis and has been operated only 3-4 days in week on demand. Now, the industry has applied for obtaining renewal of consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 and request to restore the electric supply of the industry. To verify the contents of the application, the industry was visited by AEE on 14/06/2024 and observed as under: 1. The industry was not in operation. The electric supply of the industry has been disconnected by the PSPCL Authority vide order no. 100025606127 dated 11/06/2024. 2. The industry has installed an induction furnace of capacity 6 TPH. The industry has installed side hood suction system followed by the bag filter house as APCD to contain the concentration of particulate matter within the prescribed standards. 3. The industry has submitted the completion certificate from PSCST, Chandigarh vide no. PSCST/TFD/27 dated 25/04/2023 regarding proof of Induction Furnace capacity. 4. In compliance to the hearing decisions, the industry has provided staircase and sample collection facility. 5. Further, the industry has not installed online continuous emission monitoring system with its stack. However, the industry has attached the Invoice for installation of the OCEMS, which will be installed shortly. It is further intimated that the industry has deposited a bank guarantee of Rs. 2.0 Lacs vide no. IN-PB25536473439254W dated 14/06/2024 and Environmental Compensation amounting to Rs. 4.0 Lacs vide R. No. 49/5532 dated 19/06/2024. The industry has applied for obtaining authorization under the Hazardous and Other Waste (Management and Trans-boundary) Rules, 2016, which is under process. From the facts mentioned above, the industry is complying with the decisions of the personal hearings given before the Competent Authority of the Board.
