It is intimated that earlier the industry was granted consent to operate under the Water Act, 1974 vide no. CTOW/Renewal/BAR/2019/10142582 dated 20/06/2019 valid upto 30/09/2028 and under the Air Act, 1981 vide no. CTOA/Renewal/BAR/2019/10119704 dated 20/06/2019 valid upto 30/09/2028 for manufacturing of raw rice (Without sortex and without dryer) @ 2.0 TPH by processing of paddy @ 3.0 TPH as raw material under the name of Sh. Davinder Kumar, (Proprietor).
The industry has submitted an affidavit by Sh. Davinder Kumar, wherein, it is mentioned that Sh. Davinder Kumar has sold the industry to Smt. Shimpy Rani w/o Sh. Naveen Mittal s/o Sh. Yadwinder Kumar.
The industry has submitted an undertaking wherein, it is mentioned that there is no addition in land, building and plant & machinery. It has only purchased the rice sheller and land. There is no increase in production and pollution load.
Now, the industry has applied for obtaining fresh consent to operate under the Water Act, 1974 and the Air Act, 1981 for manufacturing of same production i.e. raw rice (Without sortex and without dryer) @ 2.0 TPH by processing of paddy @ 3.0 TPH as raw material under the name of Smt. Shimpy Rani, (Proprietor).
Previous consent fee under the Air Act, 1981 is adequate upto 30.09.2028 against the value of fixed assets of Rs. 46.56 lacs. Therefore, Rs. 14,500/- is pending under the Air Act, 1981, which is adequate upto 30.09.2026 against the value of fixed assets of Rs. 56.05 lacs as per latest CA certificate dated 13.06.2024 (after deducting penalty fee and NOC fee).
Now, the industry has deposited Rs. 5600/- (Rs. 5100/- as consent fee including penalty fee + Rs. 500/- as application fee) vide R. No. 444703227 dated 18.06.2024 under the Water Act, 1974 against the total value of fixed assets of Rs. 56.05 lacs as per CA certificate dated 13.06.2024. The fee deposited by the industry is adequate upto 30.09.2025 under the Water Act, 1974.
To verify the facts, the site of the industry has been visited by the undersigned on 19.06.2024 and it was observed as under:-
1. The industry was not in operation during visit, the representative informed that rice sheller is not in operation as its milling process already completed.
2. The industry has covered all the processing sheds.
3. The industry has installed one shelling section, with cyclone as APCD and adequate stack height.
4. The industry has provided brick wall of 10 feet height in front of the discharge point of rice husk area and the length of aforesaid brick wall is 35' on each side of the rice husk discharge point. The industry has provided jali of height 5 ft above this wall.
5. The industry has no source of trade effluent generation.
6. The industry has constructed septic tank for treatment of domestic effluent of the toilet section and disposal onto land for plantation.
7. The industry has planted sapling of trees along the boundary wall.
8. The industry has provided the brick road for the movement of vehicles.
Presently, there is no addition in the machinery or land and present CTO has been applied due to change proprietor only.
In view of above it is recommended that consent to operate under the Water Act, 1974 and the Air Act, 1981 be granted to the industry upto 30.09.2025 (upto adequacy of fee) for manufacturing of raw rice (Without sortex and without dryer) @ 2.0 TPH by processing of paddy @ 3.0 TPH as raw material under the name of Smt. Shimpy Rani, (Proprietor) with suitable conditions and special condition that the industry shall got analyzed its stack emission samples from Board's lab in coming season.
