The project proponent has proposed to established a colony namely M/s M R Valley in an area of 36.2979 Acres, located at Salem Shah Road, Near M R Enclave Village Sultanpura, Tehsil & District Fazilka for development of residential plots @ 672 numbers, commercial plot @ 11 numbers and EWS @ 68 numbers. ...............
The project proponent has applied for obtaining consent to establish (NOC) under the Water Act, 1974 and the Air Act, 1981. Details of the case are as under:-
1) The project proponent has submitted project report showing the value of proposed project including land of Rs. 970 Lakhs. Accordingly, it has deposited Rs. 18000/- vide UTR/ Ref No. 270662026 dated 22.05.2024 as NOC-fee, which is adequate for a period of one year.
2) The project proponent has submitted partnership deed dated 10.08.2023, as per which, Sh. Sandeep Gilhotra S/o Sh. Munshi Ram Gilhotra, Sh. Sahil Nagpal S/o Sh. Ravi Nagpal, Smt. Muskaan Nagpal w/o Sh. Kapil Nagpal, Sh. Sanchit Gumber s/o Sh. Amrit Lal and Sh. Manish Kumar s/o Sh. Subhash Chander Kataria are the partners of the firm. ............
3) The project proponent has submitted copy of layout plan approved by the Competent Authority vide drawing no. MRV/LP/02 dated 22.04.2024 with letter no. CTP(LG)-24/1248 dated 02.05.2024, incorporating total saleable area is 60.19 % of 36.2979 acres i.e. 88416 Sq. meters, Also as per layout plan, the area under 10 no. parks of the project will be 8843.34 sq. yards. ................
4) The project proponent has submitted copy of registration of promoter for setting up of a residential colony issued by the Competent Authority under Punjab Apartment and Property Regulating (PAPRA) Act, 1995-cum-Add. Chief Administrator, BDA Bathinda vide no. 110/2022 dated 29.08.2022 to Sh. Sandeep Gilhotra S/o Sh. Mushi Ram Gilhotra................
5) The project proponent has submitted feasibility report regarding installation of STP of capacity 450 KLD for treatment of domestic effluent generated from the colony, wherein the project proponent has calculated the wastewater generation from residential plot with 05 person / plot, EWS plot with 05 person / plot and commercial plot with 4 person / plot. As per feasibility report, total 400 KLD will be generated. The project proponent has proposed to discharge 175-200 KLD onto land for plantation in an area of 4.31 acres inside the colony and 200-225 KLD for flushing purposes. Further, it has proposed to provide septic tank in phase-I and to install STP in phase-II as per occupancy...........................
6) The project proponent has submitted an undertaking which is reproduced as under:-
“We would like to inform you that we have applied for the Consent to Establishment for the residential colony, in the name of M/s M R Valley on Salem Shah Road, Village Sultan Pura, Fazilka. We are planning to develop a residential plotted colony under the Affordable Scheme. We have received a clarification for reply regarding the plotted development calculation of the people per plot. We have mentioned our reply below:
As mentioned previously, we have counted 5 people per plot instead of 15 persons per plot for the plotted development calculation for our colony. Due to demographic factors and market situation of our region, all the colonies are being developed with the calculation of 5 people per plot. Further, our colony develop (all plots size less then 125.50 Sq/Mt plot) under the Affordable Scheme. we would like to inform you that the notification of Department of Housing and urban development is not applicable on us as our colony comes does not fall under PUDA guidelines, rather it falls under Department of Local Government (Town planning Wing). we are assuring you that in our colony, on an average there will not be more than 5 people per plot.
As mentioned in the feasibility report, Total domestic effluent of our colony is 400 kl/d. out of which we have provided the dual plumbing arrangement for the re-use of the treated effluent of approximately 200-225 kl/d that will be recirculated to the houses for the flushing, gardening purposes etc. Rest of 175 -200 kl/d of treated effluent will be used for the gardening purposes of 4.31 acres of plantation area.
The plantation area available in the colony that is proposed to utilize treated water is for Parks & Green Area (8843.34 sq yard / 1.83 acres), open community center plot (5278.20 sq yard / 1.09 acres), area around the Road site, Pathways & Buffer Site etc.(54069.34 Sq yard / 11.17 acres) & Parking site (736.96 Sq yard / 0.15 acres) that will be developed as plantation area of around 2.48 acres making a total plantation area of (2.48 + 1.83) 4.31 acres inside the colony.
Furthermore, in case of excess effluent, we have a sewer connection and NOC from Municipal council Fazilka via letter no. 843 dated 14.05.2024 for disposed our colony's treated effluent into the MC Sewer.
Accordingly, we have planned to manage the domestic effluent and have taken sufficient measures and proposed the installation of STP. Furthermore, it will take at least 8-9 years to develop the colony at its full capacity. In future, if there will be increase in the domestic effluent than the proposed domestic effluent under any circumstances, we will be liable to take the further steps to manage the domestic effluent and install the higher capacity STP to treat the domestic effluent.”..................................
7) The project proponent has submitted copy of letter issued by MC Fazilka vide no. 843 dated 15.05.2024 regarding no objection certificate for water supply & sewerage connection, which is reproduced as under:-
“M/s M.R. Velly ਸਲੇਮਸ਼ਾਹ ਰੋਡ, ਫਾਜਿਲਕਾ ਜੋ ਕਿ ਅਫੋਰਡਏਬਲ ਸਕੀਮ ਅਧੀਨ ਪਾਸ ਕੀਤੀ ਗਈ ਹੈ, ਨੂੰ ਨਗਰ ਕੌਂਸਲ ਫਾਜਿਲਕਾ ਦੇ ਸੋਲਿਡ ਵੇਸਟ ਮੈਨੇਜਮੈਂਟ ਅਤੇ ਕਲੋਨੀ ਦੇ ਪਾਣੀ ਦੇ ਡਿਸਚਾਰਜ ਨੂੰ ਭਵਿੱਖ ਵਿੱਚ ਨਗਰ ਕੌਂਸਲ ਦੇ ਐਸ.ਟੀ.ਪੀ. ਵਿਚ ਜਾਣ ਬਾਰੇ ਕੋਈ ਇਤਰਾਜ ਨਾ ਹੈ ਕਿਉਜੋ ਨਗਰ ਕੋਂਸਲ ਦਾ ਨਵਾਂ ਐਸ.ਟੀ.ਪੀ.13 ਐਮ.ਐਲ.ਡੀ. ਕਪੈਸਟੀ ਦਾ ਹੈ, ਸੀਵਰੇਜ ਟਰੀਟਮੈਂਟ ਪਲਾਂਟ ਕਲੋਨੀ ਦਾ ਵੇਸਟ ਪਾਣੀ ਲੈਣ ਵਿਚ ਸਮਰਥ ਹੈ ।“..............
8) The project proponent has proposed to install compost pit for treatment of bio-degradable waste. The project proponent has also submitted letter from the MC authorities regarding lifting of its solid waste.
The proposed site of project was visited by undersigned (AEE) on 20.06.2024 and it was observed as under:-
a. The site of the project falls at Salem Shah Road, Fazilka and it has carried out construction of boundary wall at site. Construction of office premises was under process....
b. The representative of the project proponent has informed that the colony has total saleable area is 60.19 % of its total land area i.e. 88416 Sq. meters and further informed that considering FAR ratio of 1.47 to the residential plots and EWS plot and FAR ratio for commercial area as 2.1, the total built up area of the project will become as 130339 sq. meters, which is less than 1,50,000 sq. meters. As such, there project is not covered under EIA notification, 2006. ...
c. There is no MAH unit within the 250 mtrs from the boundary of the project. There is no air polluting unit within 100 mtrs of the site. ...........................
Keeping in view of above, it is recommended that the consent to establish (NOC) may be granted to the project proponent under the provisions of the Water Act, 1974 and the Air Act, 1981 for establishment of colony in an area of 36.2979 Acres, located at Salem Shah Road, Near M R Enclave Village Sultanpura, Tehsil & District Fazilka for development of residential plots @ 672 numbers, commercial plot @ 11 numbers and EWS @ 68 numbers, subject to the suitable conditions and specific as under:-
1) The project proponent shall comply with the conditions of CLU granted by the Dept. of Town & Country Planning / BDA.
2) The project proponent shall install STP as per proposal before the commissioning of project.
3) The project proponent shall be liable to provide alternate arrangements (additional plantation area) for disposal of domestic effluent, as per actual quantum of effluent discharged from its premises.
