The Regional Office has submitted report in lieu to the application filed by the industry.
Upon perusal of the report sent by RO, the following points have been observed:
• The project proponent was earlier granted consent to establish (NOC) under the Water Act, 1974 and under the Air Act, 1981 vide no. CTE/Fresh/PTA/2024/25054258 dated 21/03/2024, valid upto 20/03/2025 for manufacturing of Pelletts @ 300 MT/Day by using Paddy Straw @ 369.30 MT/Day, Sugar Cane Molasis @ 35.40 MT/Day, Mustard Waste @ 16.80 MT/Day, Cotton Waste @ 15.90 MT/Day with suitable condition mentioned therein.
• Now, the industry has applied revised/ fresh consent to establish (NOC) of the Board under the Water Act, 1974 and the Air Act, 1981 for manufacturing of Pellets (NonTorrified) @ 150 MT/Day and Pellets (Torrified) @ 100 MT/day by using Paddy Straw (For Non –Torrified) @ 184.65 MT/Day, Sugar Cane Molasis (For Non-Torrified) @ 17.70 MT/Day, Mustard Waste (For Non-Torrified) @ 8.40 MT/Day, Cotton Waste (For Non-Torrified) @ 7.95 MT/Day and Paddy Straw (For Torrified) @ 370.40 MT/day with requisite documents.
• The industry has submitted Partnership deed, location plan, brief project report, Land use pattern from DTP, Revenue Report from Tehsildar etc. along with the application form.
• The industry has deposited Rs. 36000.0/- vide Receipt no. 323725188 dated 17.05.2024 as NOC fee against the project cost of Rs. 2900.00 Lakhs, which is adequate for one year.
• The industry has submitted brief project report in which it was mentioned that SSS Green Energy is install New Manufacturing Plant for Manufacturing of Pellets from Paddy Straw with Installed Capacity of 250 Tons per Day in Two Phases (150 Tons per Day in Phase 1 (Non-Torrified) & 100 Tons per Day in Phase 2 (Torrified)) at Location of Village Kamaspur, Cheeka Road, Samana, Distt. Patiala.
• The industry has submitted certificate issued by DTP Patiala vide no. 461-DTP(P)/RTB-1 dated 29.02.2024 as under:
“ਹਵਾਲੇ ਤਹਿਤ ਪ੍ਰਤੀ ਬੇਨਤੀ ਨਾਲ ਨੱਥੀ ਕੀਤੇ ਗਏ ਦਸਤਾਵੇਜਾਂ ਦੇ ਸਨਮੁੱਖ ਇਸ ਦਫਤਰ ਵੱਲੋਂ ਕਰਵਾਈ ਗਈ ਫੀਲਡ ਰਿਪੋਰਟ ਅਨੁਸਾਰ ਸਾਈਟ ਸਮਾਣਾ ਤੋਂ ਪਿੰਡ ਬੀਬੀਪੁਰ ਵੱਲ ਜਾਂਦੇ ਹੋਏ ਪਿੰਡ ਲਗਭਗ 810 ਮੀਟਰ ਦੀ ਦੂਰੀ ਤੇ SPS Eco Friendly fuels ਦੀ ਸਾਈਟ ਦੇ ਨਾਲ ਇੱਟਾਂ ਵਾਲੇ ਭੱਠੇ ਦੇ ਸਾਹਮਣੇ ਸੜਕ ਦੇ ਖੱਬੇ ਹੱਥ ਪਿੰਡ ਕਮਾਸਪੁਰ ਦੀ ਰੈਵੀਨਿਊ ਹਦੂਦ ਅੰਦਰ ਖਸਰਾ ਨੰ.: 28//7(5-0), 13(8-1), 14(4-5-1/2), 17(4-4), 18(2-13), 24/1 (0-3-1/2) ਕੁੱਲ ਰਕਬਾ 24 ਕਨਾਲ 7 ਮਰਲੇ (3.04 ਏਕੜ) ਵਿੱਚ ਪੈਂਦੀ ਹੈ। ਸਾਈਟ ਮੌਕੇ ਤੇ ਖਾਲੀ ਹੈ। ਸਾਈਟ ਨੋਟੀਫਾਈਡ ਲੋਕਲ ਪਲੈਨਿੰਗ ਏਰੀਆ ਸਮਾਣਾ ਦੇ ਵਿੱਚ ਪੈਂਦੀ ਹੈ ਜਿਸ ਦਾ ਮਾਸਟਰ ਪਲੈਨ ਅਜੇ ਤਿਆਰ ਕੀਤਾ ਜਾਣਾ ਹੈ। ਜਿਸ ਵਿੱਚ ਪ੍ਰਾਰਥੀ ਵੱਲੋਂ PELLETS FROM PADDY STRAW ਲਗਾਇਆ ਜਾਣਾ ਹੈ। ਸਾਈਟ ਉਕਤ ਯੂਨਿਟ ਸਥਾਪਿਤ ਕਰਨ ਲਈ sitting guidelines ਦੀ ਪ੍ਰਤੀ ਪੂਰਤੀ ਕਰਦੀ ਹੈ। ਡਾਇਰੈਕਟਰ ਟਾਊਨ ਐਂਡ ਕੰਟਰੀ ਪੰਜਾਬ ਜੀ ਦੇ ਪੱਤਰ ਨੰ: 2180-2283 ਸੀਟੀਪੀ (ਪਬ)/ਐਸਪੀ-432(Gen) ਮਿਤੀ 14.06.2023 ਅਨੁਸਾਰ ਜ਼ੋ ਸਾਇਟਾਂ ਕਿਸੇ ਨੋਟੀਫਾਈਡ ਮਾਸਟਰ ਪਲੈਨ ਵਿੱਚ ਨਹੀਂ ਪੈਂਦੀਆਂ, ਜੇਕਰ ਉਹ ਵਿਭਾਗ ਦੀਆਂ sitting guidelines ਦੀ ਪ੍ਰਤੀ ਪੂਰਤੀ ਕਰਦੀ ਹੈ ਤਾਂ ਹੇਠ ਲਿਖੇ ਅਨੁਸਾਰ ਸ਼ਰਤ ਲਗਾਉਂਦੇ ਹੋਏ ਐਕਟੀਵਿਟੀ ਨੂੰ ਪ੍ਰਵਾਨਗੀ ਦਿੱਤੀ ਜਾਣੀ ਬਣਦੀ ਹੈ।
"The applicant shall be liable to abide by the provisions of Master Plan and shall also be bound to follow the provisions of section 79 along with other provisions of PRTPD Act, 1995, in case the site falls in non-conforming land use zone after the notification of Master Plan and no claim shall be demanded by the applicant from the Department".
ਰੈਵੀਨਿਊ ਰਿਕਾਰਡ ਅਨੁਸਾਰ ਸਾਈਟ ਨੂੰ 16 ਕਰਮ (88’-0’’) ਚੌੜੀ ਸੜਕ ਲੱਗਦੀ ਹੈ। ਜਿਸ ਨੂੰ ਭਵਿੱਖ ਵਿੱਚ ਬਣਨ ਵਾਲੇ ਮਾਸਟਰ ਪਲੈਨ ਵਿੱਚ 100’-0’’ ਚੌੜਾ ਕੀਤੇ ਜਾਣ ਦੀ ਸੰਭਾਵਨਾ ਹੈ। ਇਸ ਲਈ ਪ੍ਰਾਰਥੀ ਸਾਈਟ ਵਿੱਚੋਂ ਇਸ ਰਸਤੇ ਨੂੰ ਚੌੜਾ ਕਰਨ ਹਿੱਤ 6’-0’’ ਚੌੜੀ ਰੋਡਵਾਈਡਨਿੰਗ ਸਟਰਿੱਪ ਅਤੇ 5 ਮੀਟਰ ਦਾ ਨੋ-ਕੰਨਸਟਰੱਕਸ਼ਨ ਜ਼ੋਨ ਛੱਡਣ ਦਾ ਪਾਬੰਦ ਹੋਵੇਗਾ। ਪ੍ਰਾਰਥੀ ਇਸ ਰਸਤੇ ਸਬੰਧੀ ਸਬੰਧਤ ਰੋਡ ਅਥਾਰਟੀ ਤੋਂ ਪ੍ਰਵਾਨਗੀ ਲੈਣ ਦਾ ਵੀ ਪਾਬੰਦ ਹੋਵੇਗਾ। ਪ੍ਰਾਰਥੀ ਵੱਲੋਂ ਆਨਲਾਈਨ ਪੋਰਟਲ ਉਪਰ ਜੋ ਫੀਸਾਂ ਭਰੀਆਂ ਗਈਆਂ ਹਨ, ਉਹ FORM - 2 Declaration Of intent ਵਿੱਚ ਦਿੱਤੇ ਗਏ ਵੇਰਵੇ ਅਨੁਸਾਰ ਸਹੀ ਹਨ। ਪਰੰਤੂ ਜੇਕਰ ਪ੍ਰਾਰਥੀ ਸਾਈਟ ਦੇ ਰਕਬੇ ਜਾਂ ਕਵਰਡ ਏਰੀਆ ਵਿੱਚ ਕੋਈ ਤਬਦੀਲੀ ਕਰਦਾ ਹੈ ਤਾਂ ਉਸ ਅਨੁਸਾਰ ਬਣਦੀਆਂ ਫੀਸਾਂ ਦੇਣ ਦਾ ਪਾਬੰਦ ਹੋਵੇਗਾ। ਪ੍ਰਾਰਥੀ ਉਸਾਰੀ PUPD ਬਿਲਡਿੰਗ ਰੂਲਜ਼ 2021 ਅਤੇ ਹੋਰ ਵਿਭਾਗੀ ਰੂਲਾਂ ਅਨੁਸਾਰ ਉਸਾਰੀ ਕਰਨ ਅਤੇ ਬਿਲਡਿੰਗ ਪਲੈਨ ਅਪੂਰਵ ਕਰਵਾਉਣ ਦਾ ਪਾਬੰਦ ਹੋਵੇਗਾ।“
• The industry has submitted certificate from Tehsildar, Samana issued vide dated nil stating that the proposed site in khasra no. 28//7(5-0), 13(8-1), 14(4-5-1/2), 17(4-4), 18(2-13), 24/1 (0-3-1/2) as under:
1. ਜਮੀਨ ਦੀ ਮਾਲਕੀ ਐਸ ਐਸ ਐਸ ਗਰੀਨ ਐਨਰਜੀ ਦੇ ਨਾਮ ਤੇ ਹੈ।
2. ਮਾਲਕੀ ਅਨੁਸਾਰ ਜਮੀਨ ਦੀ ਰਕਬਾ 24 ਕਨਾਲ 7 ਮਰਲੇ ਹੈ।
3. ਇਹ ਜ਼ਮੀਨ ਭਾਰ ਮੁਕਤ ਹੈ।
4. ਰੈਵੀਨਿਓ ਰਸਤਾ (ਸਮਾਣਾ ਤੋ ਚੀਕਾ) ਦੀ ਚੌੜਾਈ ਲਗਭਗ 16 ਕਰਮ ਦੀ ਹੈ।
5. ਇਸ ਨੁਕਤੇ ਸਬੰਧੀ ਮਾਲ ਰਿਕਾਰਡ ਹਾਲੀਆ ਜਮਾਬੰਦੀ ਵਿੱਚ ਕੋਈ ਇਦਰਾਜ ਨਹੀਂ ਹੈ।
6. ਇਸ ਨੁਕਤੇ ਸਬੰਧੀ ਉਪਰੋਕਤ ਨੰਬਰਾਨ ਖਸਰਾ ਲਈ ਅਕਸ ਸਜਰਾ ਲੱਗ ਵਿੱਚ ਕੋਈ ਇਦਰਾਜ ਨਹੀਂ ਹੈ। 7. ਸਾਝਾ ਖਾਤਾ ਹੈ। ਮੁਤਾਬਿਕ ਰਜਿਸਟਰਡ ਵਸੀਕਾ ਨੰ. 2208 ਮਿਤੀ 21.11.2023 ਵਾ ਦਰਖਾਸਤ, ਪ੍ਰਾਰਥੀ ਦਾ ਕਬਜਾ ਨੰ. ਖਸਰਾ 28//7 (5-0) 13 (8-1) 14 (4-5 ½) 17 (4-4) 18 (2-13) 24/1 (0-3 ½) ਤੈਦਾਦੀ 24 ਕਨਾਲ 7 ਮਰਲੇ ਦਾ ਰਕਬਾ ਹੈ।
8. ਇਸ ਨੁਕਤੇ ਸਬੰਧੀ ਅਕਸ ਸਜਰਾ ਲੱਗ ਵਿੱਚ ਕੋਈ ਇੰਦਰਾਜ ਨਹੀਂ ਹੈ।
9. ਇਹ ਸਾਈਟ ਮਿਉਸਪਲ ਕਮੇਟੀ ਸਮਾਣਾ ਦੀ ਹੱਦ ਤੋਂ ਬਾਹਰ ਹੈ।
10. ਇਸ ਸਬੰਧੀ ਮਾਲ ਰਿਕਾਰਡ ਵਿੱਚ ਕੋਈ ਇੰਦਰਾਜ ਨਹੀਂ ਹੈ।
11. ਇਸ ਸਬੰਧੀ ਮਲੀਆ ਮਾਲ ਰਿਕਾਰਡ ਵਿੱਚ ਕੋਈ ਇੰਦਰਾਜ ਨਹੀਂ ਹੈ।
12. ਇਹ ਸਾਈਟ ਸਬੰਧੀ ਹਾਲੀਆ ਮਾਲ ਰਿਕਾਰਡ ਵਿੱਚ ਕੋਈ ਇੰਦਰਾਜ ਨਹੀਂ ਹੈ ਇਹ ਸਾਈਟ ਪਿੰਡ ਤੋਂ ਲਗਭਗ 500 ਮੀ. ਦੀ ਵੱਧ ਦੂਰੀ ਤੇ ਹੈ।
• The site was visited by the officer of Regional Office on 22.05.2024 and observed as under:
1. The site of the industry falls Village Kamaspur, Cheeka Road, Samana, Distt. Patiala.
2. The industry has started the foundation work.
3. No Village Phirni/ MC limit / 15 pucca residential houses was found within the 100 m from the proposed site. As per report of DTP, Patiala, Tehsildar, Samana and visit of the AEE RO, the project site is suitable as per general siting criteria prescribed by the Board for such type of unit.
• The RO has recommended that the industry may be granted Consent to Establish (NOC) under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981 for manufacturing of Pellets (NonTorrified) @ 150 MT/Day and Pellets (Torrified) @ 100 MT/day by using Paddy Straw (For Non –Torrified) @ 184.65 MT/Day, Sugar Cane Molasis (For Non-Torrified) @ 17.70 MT/Day, Mustard Waste (For Non-Torrified) @ 8.40 MT/Day, Cotton Waste (For Non-Torrified) @ 7.95 MT/Day and Paddy Straw (For Torrified) @ 370.40 MT/day as raw material under orange category subject to the suitable conditions and following additional conditions:
1. The industry will submit building plan prepared and duly authenticated by the Director of Factories/ Chartered Architect/ Chartered Engineer under the provisions of section 3-A of Punjab Factory Rules, 1952.
2. The industry will comply with all the conditions mentioned in the DTP letter no. 461-DTP(P)/RTB-1 dated 29.02.2024 issued to this office.
3. The industry is advised to obtain necessary clearance for abstraction of ground water from Punjab Water Regulation and Development Authority (PWRDA).
4. The industry shall comply with the stack emissions standards as laid down by the Board and as amended from time to time by the Board/MoEF.
5. The industry shall bound to comply with the laws & bye-laws of the Master Plan to be prepared by the Department of Town and Country Planning, Punjab.
6. The industry shall dispose off the ash in an environmentally sound manner.
7. This Consent to establish (NOC) is issued with the supersession of previous Consent to establish (NOC) issued vide no. CTE/Fresh/PTA/2024/25054258 dated 21/03/2024, valid upto 20/03/2025.
In consideration of the report/ recommendations sent by RO; if approved, the revised/fresh Consent to Establish under the Water Act, 1974 and the Air Act, 1981 for establishment of unit for manufacturing of Pellets (NonTorrified) @ 150 MT/Day and Pellets (Torrified) @ 100 MT/day by using Paddy Straw (For Non –Torrified) @ 184.65 MT/Day, Sugar Cane Molasis (For Non-Torrified) @ 17.70 MT/Day, Mustard Waste (For Non-Torrified) @ 8.40 MT/Day, Cotton Waste (For Non-Torrified) @ 7.95 MT/Day and Paddy Straw (For Torrified) @ 370.40 MT/day as raw material, be granted to the unit upto 20.05.2024 (i.e. one year from date of application filing), subject to suitable general & additional conditions and additional conditions as proposed by RO.
