File Note: It is submitted that the industry is a small-scale red category unit. Earlier, the industry was granted "Consent to Establish"(NOC) for an industrial unit u/s 25 of Water (Prevention & Control of Pollution) Act, 1974 and u/s 21 of Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/SAS/2024/24623435 dated 30.01.2024, having validity upto 29.01.2025 for manufacturing of Lead @ 3360 MT/Year, Lead Ash Powder @ 660 MT/Year, Plastic Scrap @ 720 MT/Year and Wrought lead @ 180 MT/Year by using Old Batteries @ 6000 MT/Year and Charcoal @ 1200 MT/Year as raw material with subject to suitable conditions mentioned therein. Now, the industry has applied for obtaining consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Lead Ingots @ 2700 MT/Year, Lead Ash Powder @ 480 MT/Year, Plastic Scrap @ 575 MT/Year and Wrought lead @ 145 MT/Year by using Old Batteries @ 4800 MT/Year and Charcoal @ 1000 MT/Year as raw material along with requisite documents and fee. The industry has deposited Rs. 54,000/- vide R. No. 988614054 dated 18.06.2024 under Water Act, 1974 and Rs. 68,900/- vide R. No. 510964447 dated 18.06.2024 (Rs. 54,000/- under Air Act, 1981, Rs. 14,400/- as NOC fee & Rs. 500/- application form fee, as per gross value of fixed assets is Rs. 108.68 lacs as on 15.06.2024. The consent fee deposited by the industry is adequate upto 31.03.2029 under both acts. The industry has submitted a copy sale deed executed on 21.03.2022 between Sh. Ramesh Kumar S/o Late Sh. Maheshwar Singh and Sh. Sanjay Jain S/o Sh. Prem Chand. The industry has submitted the electricity bill as proof of commissioning and as per which the date of connection of the electricity is 19.01.2024. The industry has submitted the partnership deed executed on 21.03.2022 between Sh. Sanjay Jain S/o Late Sh. Prem Chand Jain and Sh. Rajesh Kumar S/o Sh. Sat Parkash. The industry has submitted the copy of letter issued by office of Director of Factories, Punjab vide letter no. DOFPB00037138 dated 26.03.2024 regarding approval of proposed building plans under The Factories Act, 1948 and The Punjab Regional and Town Planning and Development Act, 1995 for an area of measuring 01 Bigha 14 Biswa 10 Biswasi (Approx. 0.36 Acre). The industry was visited by AEE of this office on 19.06.2024 and it was observed as under: 1) The industry was not in operation during the visit. 2) The manufacturing process of the industry is as under: - The old batteries will be purchased from open markets. After that plastic box and lead plates will be separated by cutting the batteries. The said lead plates are fixed with plastic material to separate the lead from the plastic. The lead plates will be put into the furnace fired with charcoal. Blowers blows air from the back side of the furnace. With the elapse of the time the plates start to melt resulting in molten lead which is further collected in the pot fixed outside for its collection. Afterwards, the said liquid lead will be put into moulds for getting its desired shape. After some time, the lead moulds looses its temperature or in other words when it is cooled then the moulds are removed and ingot shaped lead will be ready for sales and dispatch. 3) The industry has installed 2 nos. Temple type Blast furnace in which charcoal is being used as fuel. Both the furnaces are equipped with separate air pollution control devices for control of dust from the flue gas emissions from the Lead smelting furnace consisting of Gravity Chamber, Involute Cyclone, Bag House, Scrubber, I.D. Fan, Stack. The industry has installed proper sampling platforms and porthole with the chimney. 4) The industry has provided separate storage room for the product. The industry has provided space in the shed for the storage of raw material. 5) The industry has provided separate space for the breaking / dismantling of used batteries. 6) The industry has installed ETP for the treatment of any kind of effluent generated during the dismantling process of batteries and the purge wastewater of scrubbing tank and the same is treated through the ETP and is reutilized for scrubbing and partially utilized onto land for plantation purpose. 7) The domestic effluent is being discharged onto land for plantation after passing through septic tank. 8) The industry has installed 1 no. D.G set of capacity 63 KVA which is equipped with canopy and stack of adequate height. The industry has also submitted compliance report of conditions of "Consent to Establish"(NOC) for an industrial unit u/s 25 of Water (Prevention & Control of Pollution) Act, 1974 and u/s 21 of Air (Prevention & Control of Pollution) Act, 1981 earlier granted to it. The industry is complying with the SOP framed by CPCB for units engaged in Recycling of Lead Scrap/Used Lead Acid Batteries. In view of above, it is recommended that the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 31.03.2029 with subject to suitable conditions and special conditions that: 1. The industry shall maintain the record of receiving of used battery from the different states and quantity of product (i.e. lead recovery) and submit the same in the Regional Office on monthly basis. 2. The industry shall comply with the Standard Operating Procedure (SOP) for recycling of Lead Scrap/Used Lead Acid Batteries as circulated by CPCB on 04.01.2024. 3. The industry shall not procure raw material without obtaining Authorisation and Passbook as required under Rule 9 of the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016. 4. The industry shall break/ dismantle used batteries in scientific ways. 5. The industry shall obtain permission from CGWA for abstraction of groundwater. 6. The industry shall obtain authorization and actual user certificate from the Board under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 within one month. 7. The industry shall get itself registered with MoEF under Batteries (Management and Handling) Rules, 2001. 8. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation at any time, under any circumstances. 9. The industry shall ensure that due to operation of the project at the site, no nuisance for general public is created at any time and no public complaints are received. 10. The Consent is being granted to the industry based upon the undertaking/ documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time. 11. In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.
