File Note: As discussed.............After perusal of record file of the industry………………. Earlier, the industry was afforded an opportunity of personal hearing before the CEE(L) on 05-04-2018 in which the representative of the industry informed that due to off season, they are not operating the winch machines and voluntarily offered to get their winch machines sealed to reduce its water consumption/effluent discharge. Meanwhile, he assured to explore the possibility for replacement these machines with low liquor ratio machines…………………………….. Accordingly, the extension of consent under Water Act, 1974 and Air Act, 1981 were granted to the industry (valid upto 02-11-2018) with following special conditions that: 1) The Industry shall implement a complete waste water minimization mechanism that includes the re-circulation of cooling water, recovery and re-use of steam condensate, non-installation of winch dyeing/drum dyeing machines, adoption of minimum baths for dyeing, re-use of treated trade effluent wherever possible and any other measure which may result in the water conservation and waste water minimization, within a period of 2 months. 2) The industry will explore the possibility for replacement of high liquor ratio and water/energy intensive machines including the winch dyeing machines and submit a road map within 2 months. Meanwhile, as voluntarily agreed by the representative of the industry, winch machines shall be sealed. 3) After 2 months, a team will be constituted by the Senior Environmental Engineer, Zonal Office-2, Ludhiana to visit the industry to check the compliance of waste water minimization program………………………………. In compliance of the condition no. 2 of the consent granted, the site of the industry was visited by the officers of the Board on 14-05-2018 and it was observed as under: 1) The industry was in operation during the visit. 2) The industry did not allowed to seal the winch dyeing machines as earlier voluntarily obted and accordingly decided by the Competent Authority of the Board during hearing. 3) The industry has installed 7 winch dyeing machines, out of which 3 winch machines were in operation during the visit and washing of fabric was carried out in these machines. Apart from it, the fabric was lying loaded in 3 other winch machines for further washing. The remaining one winch machine was not in operation, during the visit…………………….. As detailed above, during last hearing held before the Chief Environmental Engineer, Ludhiana on 05-04-2018, the industry despite voluntarily offered to get their winch machines sealed to reduce its water consumption/effluent discharge has not allowed the officers of the Board to seal the machines…………………….. Thereafter, the industry was again afforded an opportunity of personal hearing before CEE, Ludhiana on 24.09.2018 and following decisions were taken: 1. Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 shall be confirmed for the closure of the unit and affecting the closure orders by disconnection of electric supply through PSPCL authorities. 2. Consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 earlier granted to the industry shall be revoked. 3. Environmental Engineer, Regional Office-3, Ludhiana shall take immediate action for the compliance of the above orders…………………... Accordingly, consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 has been revoked vide Zonal Office-2, Ludhiana letter no. 5582-83 dated 11-10-2018.………………….. Thereafter, the industry applied for consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and same was granted and directions u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 were issued to the PSPCL Authorities to re-store the electric supply temporarily for three months i.e upto 17.01.2019 vide Zonal Office letter no. 5679 dated 18.10.2018 along with following directions to this office: 1. Seal the polluting/ dyeing machinery proportionately (50%) to check the hydraulic and treatment capacity of the ETP and ensure the compliance of the same. 2. Carry out a complete study of the water usages, effluent generation and adequacy of the effluent treatment plant viz-a-viz the dyeing capacity of the industry within one month in the comprehensive manner alongwith achievement of the effluent standards for such discharges……………………... For the compliance of above said directions the industry was visited by the officer of the Board on 26.10.2018 and observed that the industry was in operation. During the visit, industry was operating its 07 nos. soft flow dyeing machines having capacity @ 1900 KG out of 10 nos. soft flow dyeing machine having total capacity @ 2400 Kg which is more than the 50% of its dyeing machinery/capacity. Also, representative of the industry did not co-operate to seal the machinery……………………... The industry was again visited by officer of the Board on dated 20.11.2018 in reference to the request submitted by the industry for sealing of the machines. During visit, 3 winch machines of capacity @200 kgs each were sealed out of 7 winch dyeing machines. 2 soft flow machines of capacity @300 Kgs each, 3 soft flow machines of capacity @200 Kgs each, 1 soft flow of 50 Kgs capacity were sealed in the presence of Sh. Raman, Accountant of the industry……………………... Thereafter, the electric connection of the industry was again restored upto 14.04.2019……………………... Thereafter, the industry applied for consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the same was granted vide no. CTOW/Renewal/LDH3/2022/20267234 dated 13.12.2022 for Trade effluent @ 741.4 KLD and domestic effluent @ 9.0 KLD into the dedicated conveyance system leading to CETP of capacity 50 MLD located at Tajpur Road, Ludhiana and directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 were issued to the PSPCL authorities for temporary restoration of the electric connection of the industry upto 12.06.2023……………………... Thereafter, the industry was afforded an opportunity of personal hearing before Chairman of the Board on 30.10.2023 due to violations observed during the visited dated 15.04.2023, wherein it was decided as under:……………………... 1. The Environmental Compensation be imposed on the industry upto 30.10.2023 for continued violations. 2. The Environmental Engineer, Regional Office-3, Ludhiana shall visit the industry to verify the contentions of the industry and process the application of the industry for obtaining consent to operate on merits…………………….... Accordingly, the amount calculations of Rs. 19,90,000/- were sent to EC committee through E-office no. 223519 and same has been approved……………………..... Now, the industry has again applied for renewal of consent to operate under Water Act, 1974 and Air Act, 1981 for dyeing of cloth @ 5200 Kgs/day, printing of cloth @ 1500 Kgs/day and finishing of cloth @ 14400 Kgs/day with trade effluent @ 720.0 KLD and domestic effluent @ 9.0 KLD into CETP 50 MLD……………………...... The industry has deposited consent fee, which are adequate upto 31.05.2027 under the Water (Prevention & Control of Pollution) Act, 1974 and 30.11.2026 under the Air (Prevention & Control of Pollution) Act, 1981, respectively……………………...... The case was examined and it was observed that the industry has not submitted area classification certificate after the date of notification of Master Plan, Ludhiana……………………...... Accordingly, show cause notice for refusal of consent to operate under Water Act, 1974 was issued to the industry with an opportunity of personal hearing before Chief Environmental Engineer 30.04.2024, wherein it was decided that: ……………………..... i. The industry shall submit the desired certificate from the District Town Planner (DTP), Ludhiana regarding land use pattern of the area as per Master Plan of the Ludhiana. ii. Environmental Engineer, Regional Office, Ludhiana-3 shall comment on machinery details viz-a viz share DEMAT certificate submitted by the industry. iii. Environmental Engineer, Regional Office – 3 shall accordingly process the consent application on merit. Regional Office reported that in compliance of personal hearing industry has now submitted area classification certificate vide no. 1202/DTP(L)/-M2A dated 20.05.2024 Ludhiana (2007-2031) mentioning that the site of the industry falls in Industrial Land Use Zone as per Master Plan Ludhiana and dyeing is allowed in this zone. The industry has also obtained adequate shares i.e. 1554 KLD to manage the quantum of discharge i.e. 900 KLD as per the audit carried out by GNE but the industry has applied for the discharge of 741 KLD only, so the CTO can be granted to the industry after restricting the operation of its printing process/ printing machinery and winch machines……………………...... The industry was visited by the AEE of RO on 02.04.2024 and it was observed that: 1. The industry was in operation and engaged in the process of dyeing & washing of fabric, dyeing / washing of garments……………………...... 2. The industry has installed 13 soft flow machines (2 of 600 Kg each, 4 of 450 Kg, 7 of 300 kg) having 34 chambers and one sample machine. The industry has also installed 03 winch machines (in dismantled condition) & 02 printing section (one flat bed printing machine and one rotary printing machine) but both printing machines are not operational and the physical conditions of the printing machines is showing that the same has not been operated since long. But the industry has applied for printing of fabric too. 3. The study on effluent generation has been done by the Guru Nanak Dev Engineering College (GNE) and as per report it has total effluent generation as 750.4 KLD from its total 26 chamber of soft flow, 03winch machine of capacity 200 Kg and 02 printing section. During last visit dated 3.11.2022, the industry owner Sh. Bobby Jindal had informed that the industry has dismantled its 02 winch machine and01 printing section and in place of it, it has installed 8 chambers of soft flow machines. However in the present list of machinery given by it, it has mentioned 02 printing machine and 100 KLD effluent in total quantity of effluent generation. 4. As per audit carried out by Guru Nanak Dev Engineering College (GNE) generation of effluent from 34 chambers is 680 KLD considering generation of 20 KLD per chamber and generation of effluent from 03 winch machines is 120 KLD and from 02 printing machines is 100 KLD. Hence the total generation of effluent is 680 + 120 + 100 = 900 KLD, which is beyond than the discharge applied by the industry i.e. 741.4 KLD, however the printing machines and winch machines are not in operation but the industry has not got lifted the additional machinery from the premises and has applied for CTO for printing of fabric too. 5. The industry is connected with the conveyance system of CETP 50 MLD, Tajpur Road, Ludhiana for discharge its trade & domestic effluent through single outlet. The industry has provided the flow meter at its final outlet leading to CETP, which is connected with the SCADA system……………………...... Further, Regional Office was requested to submit comments on mandatory documentary required for members unit of CETP 50 MLD. Now, Regional Office has submitted documents in the annotated form. The industry has submitted DEMAT certificate of 1579 KLD shares, the contens of the same are as under: ……………………..... 1. Shares held in DEMAT (A/c No. IN304295-51076289)- 24,522 2. As per the list of allotees in E-Form PAS-3 filed with ROC by the Company for the allotment made on 22nd May 2023 and shares under the process of demat- 15,54,478……………………..... As proposed by the Regional Office, may if approved: 1. Consent to operate under Water Act, 1974 for dyeing of cloth @ 5200 Kgs/day, finishing of cloth @ 14400 Kgs/day with trade effluent @ 720.0 KLD and domestic effluent @ 9.0 KLD into CETP 50 MLD may be granted to the industry for the period of one year with usual conditions. 2. Industry may be directed to not to operate its printing machinery as well as winch machines. 3. Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 be issued to the PSPCL authority to restore electricity connection of the industry permanently as the industry is now connected with CETP.
