• The industry is a small scale orange category unit.
• A complaint was received in this office through e-mail dated 16.02.2024 from EPA cell Head office Patiala. In this complaint, the complainant has mentioned that as per notification no person shall manufacture carry bags below 50 microns industrial packaging material in the state of Punjab and has given some name of the manufacturer who are engaged in the process of single use plastic activity in the city.
• To check the contentions of the complainant as given in the complaint, the industry was visited by Er. Akash Deep singh JEE (OS) on 13.03.2024 and it was observed as under:-
1. The industry was in operation during the time of visit.
2. The industry is engaged in the manufacturing of Plastic granules (Dana) by recycling the plastic industrial bags.
3. The manufacturing process of industry involves in grinding of waste plastic and then heating the material after that the heated material is poured into the extruder to make plastic wire and the cutting of same is done to make plastic granules.
4. The industry is having 01 no. of Extruders machines, 01 nos. of Aglo machines.
5. The industry is not engaged in manufacturing of banned plastic carry bags and single use plastic items. As such the contention of the complainant is not genuine.
6. The industry was granted CTOs under Water (Prevention & Control of Pollution) Act, 1974 under green category. Now as per new categorization of CPCB the industry falls under orange category.
• Thereafter, the industry was issued notice u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 and 31-A of Air (Prevention and Control of Pollution) Act, 1981 alongwith show cause notice for violation of Plastic Waste Management Rules 2016 with an opportunity of personal hearing before Chief Environmental Engineer, Jalandhar on 02.05.2024, wherein it was decided as under:- .
1. The industry shall apply for consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 within 15-days.
2. The industry shall apply for registration on the centralized portal developed by Central Pollution Control Board, immediately when the portal is operational, not later then 01-month, failing which Board will initiate action against the industry as per Environmental laws, without giving any further notice.
3. The Environmental Engineer, Regional Office-1, Jalandhar shall send the report regarding consent to operate and registration of the industry on the centralized portal developed by Central Pollution Control Board, after 01-month.
• Now, the industry has applied for fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and under Air (Prevention and Control of Pollution) Act, 1981 through OCMMS of the Board under orange category for manufacturing of Plastic Dana @ 600 kg/day by using L.D @ 600 kg/day as raw material under orange category and detail of the same as under:-
1. The industry has deposited Rs. 27000/- vide UTR No. SBIN424123946707 dated 02.05.2024 under Water Act, 1974 and Rs. 29300/- (Rs. 27000/- under Air Act, 1981, Rs. 1800/- NOC fee, Rs. 500/- form fee) vide UTR No. SBIN424123946668 dated 02.05.2024 against the fixed assets of Rs. 20.95 Lacs, which are adequate upto 30.09.2029.
2. The industry has submitted approved building plan from Competent person under Director of Factories Act, 1948, Punjab.
3. The industry has submitted manufacturing process, proprietorship certificate, registry of the land with the application.
4. The industry has submitted a letter issued by M.C Jalandhar addressed to Federation of Jalandhar Industrial & Traders association, vide no 348 dated 03.03.2014 mentioning that the area of Saini Colony, Dada Colony & Globe Colony falls in general industrial zone as per Master Plan 2009-2031.
• The industry was visited by Er. Manvinder Singh Hundal AEE(OS) of this office on 20.06.2024 and it was observed that:-
1. The industry was in operation during visit and is engaged in the manufacturing of plastic dana.
2. The industry has installed one extruder machine, one aglo machine at site.
3. There is no source of generation of trade effluent, only domestic effluent is discharged into sewer. The industry has made arrangement for re-circulation of cooling water with the extruder machine.
4. The industry is using fresh waste plastic as raw material only which is made from virgin plastic. As such, there is no possibility of odour emissions generation from extruding process.
5. The industry has not applied for registration under EPR portal on the centralized portal developed by Central Pollution Control Board till date.
6. The industry is complying with the provisions of Water (Prevention & Control of Pollution) Act, 1974 and under Air (Prevention and Control of Pollution) Act, 1981.
The industry is a small scale orange category unit and the Competency to decide such type of case lies with Senior Environmental Engineer, ZO, Jalandhar.
In view of above, it is recommended that the consent to operate Water (Prevention & Control of Pollution) Act, 1974 and under Air (Prevention and Control of Pollution) Act, 1981 may be granted for short period with suitable conditions as per policy of the Board with special condition that :-
1. The industry shall apply/obtain registration under EPR Portal immediately.
2. The industry will not manufacture any activity related to plastic carry bags/ Single use plastic items.
