It is submitted that earlier the industry was granted Consent to Establish (NOC) of the Board under the Water Act, 1974 & the Air Act, 1981 vide no. 5514 on 24.08.2007 for formulation of Insecticide / Herbicide & Pesticide @ 5 TPD by using Solvent, Emulsifier, Technical @ 5 TPD as raw material alongwith conditions mentioned therein. However, the industry has failed to apply for obtaining Consent to operate under the Water Act, 1974 & the Air Act, 1981.
Now, the industry has applied fresh consent to operate under the Water Act, 1974 & the Air Act, 1981 for formulation of Insecticide / Herbicide & Pesticide @ 5 TPD by using Solvent, Emulsifier, Technical @ 5 TPD as raw material, details of the case is as under:
• The industry has submitted year wise CA certificate, showing value of gross fixed assets of Rs. 42.74 lacs (including value of plant & machinery of Rs. 26.18 lacs) as on 31.03.2024.
• The industry has deposited consent fee of Rs. 69400/- vide UTR / Ref. no. 271789541 dated 07.06.2024 under the Water Act, 1974 & Rs. 69400/- vide UTR / Ref. no. 819008635 dated 07.06.2024 under the Air Act, 1981, which is adequate upto 30.06.2029 under both the Acts after adjusting the penalty and balance fee.
• The industry has submitted copy of GST, showing Sh. Sohan Singh Gill as proprietor of the firm.
• The industry has submitted undertaking, which states as under:
"ਮੇਰੇ ਵੱਲੋਂ ਇਕਾਈ 2007 ਵਿੱਚ ਬੋਰਡ ਤੋਂ ਐਨ ੳ ਸੀ ਲੈ ਕੇ ਲਗਾਈ ਗਈ ਸੀ ਅਤੇ ਮੈਂ 2007—08 ਤੋਂ ਇਹ ਇਕਾਈ ਚਲਾ ਰਹ ਹੈ। ਮੇਰੇ ਵੱਲੋਂ ਇੰਡਸਟਰੀ ਦੀ ਪ੍ਰੋਡਕਸਨ ਕਪੈਸਟੀ ਵਿੱਚ ਕੋਈ ਵੀ ਵਾਧਾ ਨਹੀ ਕੀਤਾ ਗਿਆ। ਸਮੇਂ—ਸਮੇਂ ਅਨੁਸਾਰ ਹੋਇਆ ਵਾਧਾ, ਬਿਲਡਿੰਗ ਦੀ ਮੁੱਰਮਤ ਅਤੇ ਪਲਾਂਟ ਅਤੇ ਮਸ਼ੀਨਰੀ ਵਿੱਚ ਵਾਧਾ ਪ੍ਰੋਡਕਟ ਦੀ ਕੁਆਲਿਟੀ ਲਈ ਕੀਤਾ ਗਿਆ। "
The site of the industry was visited by undersigned (AEE) on 20.06.2024 and it was observed that:
1. The industry was in operation with main liquid formulation.
2. The industry has installed 04 no. reaction vessels (1000 L each) for formulation purpose. The industry has provided wet scrubber as APCD to control the emissions / fumes from these vessels, which was in operation during visit and adequate stack height has been provided with the APCD.
3. The industry has installed 02 no. evaporation pans in its premises of size 1.5 m x 1 m x 0.3 m each, for the evaporation of the effluent arising from lab section.
4. The industry has provided separate room for storage of hazardous waste i.e. empty containers with lock & key arrangement. As informed by representative, these empty containers have been returned / lifted to supplier of raw material.
5. No trade effluent is being generated from the manufacturing process.
6. The industry has provided septic tank for treatment of domestic effluent generated from the premises with provision to discharge onto land for irrigation in adjoining their own fields.
As above, the industry is complying with the provisions of the Water Act, 1974 & the Air Act, 1981 as well as conditions of Consent to Establish (NOC) granted to it.
Keeping in view of the above, it is recommended that Consent to operate under the Water Act, 1974 & the Air Act, 1981 may be granted to the industry for formulation of Insecticide / Herbicide & Pesticide @ 5 TPD by using Solvent, Emulsifier, Technical @ 5 TPD as raw material for a period upto 30.06.2029, subject to the suitable conditions along with suitable conditions as under:
1. The industry shall not enhance its production capacity without prior permission of the Board.
2. The industry shall not increase its existing land area without prior permission of the Board.
3. The industry will not generate any hazardous waste from the manufacturing process.
