Subject: Proceedings of the personal hearing given to the Superintendent Engineer (SE), Municipal Corporation, Abohar, District Fazilka before refusal of 'Consent to Establish' (NOC) under the provisions of the Water Act, 1974 &Air Act, 1981 - project: Abha City Square developed by MC, Abohar, Distt. Fazilka by the Member Secretary of the Board on 20.06.2024.............

It was brought out that the project is a commercial establishment to be developed by the MC, Abohar for developing 58 no. SCOs, 98 no. booths, one SDAC/Administrative Complex, one public library, one no. stadium and 13 no. public toilets in an area of 22.36 acres under the name & style of M/s Abha City Square at Abohar, District Fazilka.............
Application applied for obtaining 'Consent to Establish' (NOC) under the Water Act, 1974 & Air Act, 1981...............
As per the EIA notification dated 14.09.2006, the building & construction projects having built up area more than 20,000 sq. meter are covered under the purview of EIA notification dated 14.09.2006.............
From the perusal of the documents submitted by the MC, it has been observed that the MC, Abohar has submitted copy of layout plan approved by the Commissioner, MC, Abohar vide drawing no. AS/01/2023 dated 30.10.2023 for an area of 22.36 acres (to be read with letter no. CTP(LG)-24/569 dated 16.02.2024). In the said layout plan, commercial saleable area is 9.4% of the total area, consisting of 58 SCOs& 98 booths having built up area as 21,313 sq. meter. Further, the non-saleable area under Stadium & District Administration Complex is 15.86% & 10.20%, respectively of the total area, however the built up area of the non-saleable area is not mentioned in the layout plan...............
The proposed site of the project was visited by the officer of the Board on 09.04.2024 and found that the construction of the Administration Complex was in process and the Library section has been commissioned. Also, the MC has proposed that the domestic effluent @ 28 KLD will be generated from the total project, which will be discharged into MC sewer without any treatment and no STP has been proposed.............
From the proposal submitted by the MC, the project seems to be covered under the purview of the EIA notification dated 14.09.2006, and is thus require to obtain prior Environment Clearance in the matter................
In view of above, show cause notice before refusal of 'Consent to Establish' (NOC) under the provisions of the Water Act, 1974 & Air Act, 1981 has been issued to the authorities concerned alongwith an opportunity of personal hearing before the Member Secretary of the Board on 20.06.2024...............
During hearing, the officers of the MC, Abohar submitted written reply w.r.t.the notice issued to it, which has been taken on record, wherein they submitted as under:-..............
"ਨਗਰ ਨਿਗਮ, ਅਬੋਹਰ ਦਾ ਆਭਾ ਸਿਟੀ ਸਕੇਅਰ ਪ੍ਰੋਜੈਕਟ ਕਿਸੇ ਵੀ ਤਰ੍ਹਾਂ ਦੇ Industries ਮੰਤਵ ਲਈ ਡਿਵੈਲਪ ਨਹੀਂ ਕੀਤਾ ਗਿਆ ਹੈ। ਆਭਾ ਸਿਟੀ ਸਕੇਅਰ ਵਿੱਚ ਕੱਟੇ ਗਏ ਜੋ ਐਸ.ਸੀ.ਓ./ਬੂਥ ਵੇਚੇ ਜਾਣਗੇ। ਉਹਨਾਂ ਤੋਂ ਪ੍ਰਾਪਤ ਹੋਣ ਵਾਲੀ ਰਕਮ ਨੂੰ ਨਗਰ ਨਿਗਮ, ਅਬੋਹਰ ਦੀਆਂ ਬਕਾਇਆ ਪਈਆਂ ਅਦਾਇਗੀਆਂ ਲਈ ਹੀ ਵਰਤਿਆ ਜਾਵੇਗਾ। ਇਸ ਲਈ ਇੱਥੇ Water Act, 1974 & Air Act, 1981 ਲਾਗੂ ਨਾ ਹੁੰਦਾ ਹੈ। ਇਸ ਲਈ ਆਭਾ ਸਿਟੀ ਸਕੇਅਰ ਪ੍ਰੋਜੈਕਟ ਨੂੰ 'Consent to Establish' (NOC) ਤੋਂ Exemption ਦਿੱਤੀ ਜਾਵੇ। ਜੇਕਰ ਆਪ ਵੱਲੋਂ ਆਭਾ ਸਿਟੀ ਸਕੇਅਰ ਪ੍ਰੋਜੈਕਟ ਨੂੰ 'Consent to Establish' (NOC) ਤੋਂ Exemption ਨਹੀਂ ਦਿੱਤੀ ਜਾਂਦੀ ਤਾਂ 'Consent to Establish' (NOC) Apply ਕਰਨ ਲਈ ਨਗਰ ਨਿਗਮ, ਅਬੋਹਰ ਨੂੰ ਘੱਟੋ-ਘੱਟ 30 ਦਿਨ ਦਾ ਸਮਾਂ ਦੇਣ ਦੀ ਕ੍ਰਿਪਾਲਤਾ ਕੀਤੀ ਜਾਵੇ।.............
ਨਗਰ ਨਿਗਮ, ਅਬੋਹਰ ਕਿਸੇ ਵੀ ਕਾਲੋਨਾਈਜਰ/ਡਿਵੈਲਪਰ ਨੂੰ ਲਾਇਸੰਸ ਜਾਰੀ ਕਰਨ ਲਈ ਸਮੱਰਥ ਅਥਾਰਿਟੀ ਹੈ ਅਤੇ ਨਗਰ ਨਿਗਮ, ਵੱਲੋਂ ਹੀ ਅਬੋਹਰ ਸ਼ਹਿਰ ਵਿੱਚWater Supply ਅਤੇ Sewer System ਪਾਇਆ ਗਿਆ ਹੈ ਅਤੇ Sewerage System ਲਈ ਨਗਰ ਨਿਗਮ ਵੱਲੋਂ ਇੱਕ 25.0 MLD Capacity ਦਾ S.T.P. ਪਲਾਂਟ ਵੀ ਲਗਾਇਆ ਗਿਆ ਹੈ ਅਤੇ ਕਿਉਂਜੋ ਆਭਾ ਸਿਟੀ ਸਕੇਅਰ ਪ੍ਰੋਜੈਕਟ ਸ਼ਹਿਰ ਦੇ ਵਿਚਕਾਰ ਸਥਿਤ ਹੈ, ਜਿਸ ਦੇ ਚਾਰੇ-ਪਾਸੇ Sewer ਦੀ Connectivity ਹੈ, ਜੋ ਕਿ ਅੱਗੇ ਜਾਕੇS.T.P. ਪਲਾਂਟ ਨਾਲ ਵੀ Connected ਹੈ। ਸੋ, ਇਸ ਪ੍ਰੋਜੈਕਟ ਅਧੀਨ ਪੈਂਦੀ ਜਗ੍ਹਾਂ ਵਿੱਚ ਵੱਖਰੇ ਤੌਰ ਤੇS.T.P. ਪਲਾਂਟ ਲਗਾਉਣਾ ਨਹੀਂ ਬਣਦਾ ਹੈ।"............
The matter regarding applicability of environmental clearance was deliberated with the MC officials who informed that the MC is not constructing this whole project at its own as they are developing it as an infrastructure development project. The SCOs and booths are not to be constructed by the MC and only plots for the same will be sold to the individuals who will construct the same at their own. The other parts i.e. Administrative Block, Stadium;Library &Public Toilets etc. will be constructed by the MC. However, the built up area of these blocks have not been mentioned in the approved layout plan presented by the MC during hearing..................
After hearing the officers of the MC, Abohar as well as Officers of the Board, the Member Secretary of the Board has decided that: -..............
1. The Municipal Corporation shall be re-heard on 27.06.2024 at 11:00 a.m. in the O/o the Member Secretary, Punjab Pollution Control Board, Head Office, Patiala.............
2. The Municipal Corporation shall bring the detailed project report of this project alongwith total built-up area of the blocks being constructed by MC, the details of saleable area alongwith built-up area of the same and the details submitted with Real Estate Regulatory Authority (RERA)..............
3. The Municipal Corporation shall assess the total water consumption, wastewater generation & disposal for this entire project with blockwise details..............
4. The Municipal Corporation shall submit the total capacity of the terminal STP of Abohar and the balance capacity of the STP, if any for the treatment of the effluent to be generated from the said project...............
5. Senior Environmental Engineer (HQ-2), PPCB shall also be invited to remain present during the re-hearing on 27.06.2024..............
