File Note: Earlier, the project proponent was granted “Consent to Establish” (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. PBIP/PPCB/2017/CTE – 233 dated 26.12.2017 which was valid upto 25.12.2018 through Invest Punjab under orange category for Anchor Shops @ 6 Nos., Offices @ 44 Nos., Rooms @ 44 Nos & Restaurant @ 2 Nos with subject to suitable conditions mentioned therein. Now, the project proponent has applied for obtaining fresh “Consent to Establish” (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for Anchor Shops @ 6 Nos, Offices @ 44 Nos, Rooms @ 44 Nos. & Restaurant @ 2 Nos. under green category, along with requisite documents and fee. NOC Fee The project proponent has submitted brief project report as per which the proposed cost of the project is Rs. 17.57 Crores. The project proponent has deposited Rs. 1,08,000/- vide R. No. BKIDN24149346253 dated 28.05.2024. The NOC fee deposited by the project proponent is adequate for one year. Site Suitability The project proponent has submitted CLU certificate issued by Town Planner/Local Government, Punjab Bureau of Investment Promotion, GoP vide Reference No. PBIP/LORC-1/1612253677 for an area of 0.66 acres for construction of commercial shops. The project proponent has submitted approved site plan from MC Zirakpur vide letter no. 3270 dated 14.12.2018. Water Pollution The project proponent has submitted revised calculation w.r.t waste water generation and as per the project report the total estimated population of the project will be 602 persons. The total water requirement of the project will be 33 KLD and total water generation will be 25 KLD, which will be treated in STP of capacity 50 KLD installed in its premises. The treated water @ 15 KLD will be used for flushing and 8 KLD for cooling and rest 2 KLD for green area within the project @ 300 sqm. The project proponent has proposed to install STP of capacity 50 KLD based on MBBR technology followed by UF Membrane for treatment of wastewater generated from the project. Air Pollution The project proponent has proposed to install 2 nos. D.G sets of capacities500 KVA, which will be equipped with canopy and adequate stack height. There is no other source of air pollution. Applicability of EIA notification dated 14.09.2006 As per the CLU and site plan submitted by the project proponent the project shall be developed as building and construction Project. As the total built-up area will be less than 20,000 sq.mtr. and the total project area is 0.66 acre, it is not covered under category 8-B of the EIA notification dated 14.09.2006 and not required to obtain prior Environmental Clearance. Visit The site of the project was visited by AEE of this office on 21.06.2024 and during visit, it was observed that: 1. The site is located at VIP Road Bishanpura, Zirakpur, Derabassi, SAS Nagar. 2. The project proponent has started excavation work at site. 3. As physically observed, the distance of the proposed site from the various approved existing operational industries / units (for which specific siting guidelines has been issued by the Board for time to time), is more than the required distance as per the siting criteria given as under: Sr. No. Type of Industrial unit Required distance as per siting criteria 1. Jaggery Unit 200 m The site is complying with general siting criteria as per policy dated 30.04.2013 and specific sitting guidelines as per the Department of Science, Technology, Environment, Government of Punjab notification no. 3/6/07/STE(4)/2274 dated 25.07.2008. Recommendations In view of the above, it is recommended that “Consent to Establish” (NOC) from pollution angle under the provisions of the Water (Prevention & control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted for one year with subject to suitable conditions and following additional conditions that: 1. The promoter shall not allow any occupancy in the project till the time adequate arrangements for treatment & disposal of wastewater and solid waste are made as well as 'consents to operate' under the Water Act, 1974 & the Air Act, 1981 are obtained. 2. The project proponent shall develop 300 sqm green area in the open area earmarked in its approved layout plan for disposal of treated wastewater. 3. The project proponent shall provide STP of adequate capacity followed by UF Membrane and shall submit the complete drawing and design of the STP and its component at the time of obtaining consent to operate. 4. The project proponent shall provide separate water meter and energy meter for the STP and maintain record of the same on daily basis. 5. The project proponent shall utilize treated wastewater from nearby STPs for the construction purpose and shall submit an agreement in this regard within one month. 6. The promoter company shall explore the possibility of using treated domestic effluent for useful purpose such as construction work, sprinkling on dusty patches/roads, use in nearby construction activities etc. 7. The project proponent shall place adequate no. of bins outside its premises from where the Municipal Solid Waste shall be got lifted. 8. The project proponent shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016 and ensure that the solid waste is segregated into biodegradable and non-biodegradable components. The biodegradable component shall be treated by providing adequate mechanical composter to produce compost, which will be disposed of/reused in an environmentally sound manner and the non-biodegradable solid waste shall also be disposed of in an environmentally sound manner. 9. The project proponent shall also ensure that the hazardous waste and e-waste components of the solid waste shall also be segregated and the same shall be channelized to the authorized facility for such type of waste. 10. The project proponent shall comply with the provisions of the Construction and Demolition Management Rules, 2016. 11. The project proponent shall take adequate steps to the effect that the construction material of any kind that is stored at site shall be fully covered in all respects so that it does not disperse in the air in any form. 12. The project proponent shall ensure that all the construction material and debris shall be carried out in trucks or other vehicles which are fully covered and protected so as to ensure that the construction debris or the construction material does not get disburse into the air or atmosphere in any form. 13. The project proponent shall take all necessary steps to control the dust emissions to be generated from the construction activities of the project. 14. The project proponent shall ensure that the vehicles carrying construction material and construction debris of any kind shall be cleaned before it is permitted to ply on the road after unloading of such material. 15. The project proponent shall provide mask to every worker working on the construction site and involved in loading/ unloading and carrying of construction material and construction debris. 16. The project proponent shall provide all medical help, investigation and treatment of workers involved in construction of building and carrying out construction material and debris related to dust emissions. 17. The promoter shall develop its commercial plots strictly in accordance with the layout / building plans approved / to be approved by the Competent Authority. 18. The promoter company shall ensure that the total built up area of construction being carried out by it or any different builders may not be greater than 20,000 sqm, otherwise the project as such is covered under category 8(a) of the schedule appended to the EIA notification and project proponent of the building and construction project is required to obtain the environmental clearance, failure which, the promoter company/builder shall be liable for action for the violation of EIA notification dated 14/09/2006. *Competency –Senior Environmental Engineer Medium Scale Green Category Date of Receipt: 14.06.2024 Date of Scrutiny: 21.06.2024 Date of Deemed Approval: 10.07.2024
