It is submitted that the industry was given personal hearing before worthy SEE(ZO) on 03.06.2024 in which following decisions were taken:-
(A) DECISIONS OF PESONAL HEARING
1. The industry shall close soakage pit immediately and develop adequate plantation area for discharge of treated domestic effluent.
2. The industry shall submit within 02 days, the Bank Guarantee of Rs. 1.0 lacs, as already imposed during hearing held on 15.05.2024.
3. In case, the industry fails to make the compliance, action u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 shall be recommended to CEE, Ludhiana.
4. The Environmental Engineer, Regional Office shall verify submission made by the industry and submit further recommendations, accordingly.
In the meantime, the industry has applied fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 alongwith requisite document and fee. The site of the industry was visited by the AEE and JEE of this office on 07.05.2024 and 14.05.2024 the details of visit are as under: -
(B)COMPLIANCE OF THE DECISIONS OF PESONAL HEARING :-
1. The industry has closed soakage pit and plantation area has been developed to discharge the domestic effluent through septic tank.
2. The industry has not submitted the Bank Guarantee of Rs. 1.0 lacs. Sh. Sharanjeet Singh Sabharwal, Prop. Of the industry informed during visit dated 07.05.2024 that he is already in touch with the bank for preparing Bank Guarantee.
In light of above, the case was accepted and processed. If, such cases the consent applications are not processed and return to the industry, following facts have been observed during my service in the Board: -
• Industry continue operate its process without obtaining consents of the Board.
• No. of non-applying industry increases day by day in RO inventory.
• No. of pending e-noting/e-office files/Return cases in OCMMS/compliance of decisions of personal hearing increases in RO portal which reflects the bad image of RO at Board/Govt. Level.
• If such cases are processed, no doubt industry may take some more time, but it will left no option to comply with the decisions of personal hearing as well as comply with the Pollution Control Laws.
As per photograph sent through whatsapp, now, the industry has provided adequate stack height to its thermostat. However, I again made a call to the prop. of the industry on 21.06.2024 to submit the Bank Guarantee and back message received of the prop. that his mother is hospitalized.
