Subject: Application for obtaining Consent to Establish (NOC) under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 – M/s Art Rolls Pvt. Ltd., H.B No. 213, Bhadla Nicha, Khanna, District Ludhiana.
It is submitted that the unit has proposed to establish a large-scale Induction Furnace under Orange category. Accordingly, the industry has applied for obtaining Consent to Establish (NOC) under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Steel Ingots/ Metal Rolls @ 78 MTD by using Heavy Melting Scrap/ Special Alloys/ Scrap @ 82 MTD as raw material with requisite documents and NOC fee.
The industry has submitted the Memorandum of Association (copy attached), according to which Sh. Anayat Goyal and Smt. Sugandha Goyal are the directors of the company. The industry has also submitted the copy of resolution passed at the meeting of the Board of Directors of the company, wherein, it has mentioned that Sh. Anayat Goyal is the authorized signatory of the firm.
The industry has submitted the sale & lease deeds of the land and the detail of the same are given as under:
• Lease deed dated 21/07/2022 executed between Sh. Anayat Goyal and M/s Art Rolls Pvt. Ltd., H.B No. 213, Bhadla Nicha, Khanna of Hadbast No. 213, total land area 13 Kanal 18 Marle (1.73 acres), which is valid upto 20/01/2028.
• Sale deed dated 30/06/2023 executed between Sh. Jagdeep Singh, Sh. Harpreet Singh and M/s Art Rolls Pvt. Ltd., H.B No. 213, Bhadla Nicha, Khanna of Hadbast No. 213, total land area 20 Kanal 18 Marle (2.61 acres).
Further, the industry has submitted the In-Principal Approval (Attached herewith) of the said land vide memo no. 2591/DTP(L)/M-2C dated 20/10/2023 issued by District Town Planner, Ludhiana, according to which the total land area 4.35 acres falls in the Industrial Zone as per notified Master Plan of Khanna (2010-31).
The industry has not submitted building plan approved from the Competent Authority. However, the industry has submitted the Certificate of In Principal Approval issued by DC Ludhiana vide memo no. 836 dated 23/02/2024 under Punjab Right to Business Act, 2020 and sanction building plan and as per condition no (vi) of certificate, it has been stated that during the course of validity of certificate of in principle approval, the enterprise shall at any time but no later than three years and six months from the date of issue of the certificate, apply and obtain all application regular approval from the concerned department through the single window system of Punjab Bureau of Investment Promotions (PBIP).
The industry has submitted the brief project report (Attached herewith), wherein, it has mentioned that the total cost of the project is Rs. 1898.27 lacss with value of plant & machinery is Rs. 1350.00 lakhs. Accordingly, the industry has deposited NOC fee amounting to Rs. 24,000/- vide online R. no. 972032685 dated 07/05/2024, which is adequate for 01 year as per Board's Office Order dated 29/10/2018.
The industry has also submitted the feasibility report from PSCST, Chandigarh vide no. 23 dated 19/04/2024 for the proposed APCD i.e. Pulse Jet Bag Filter to be installed over induction furnace of capacity 6 TPH.
To verify the contents of the application, the site was visited by the AEE (OS) on 21/06/2024 and during visit, it was observed as under:
1. The proposed site falls in the revenue estate of Bhadla Nicha, Khanna, District Ludhiana.
2. The industry has proposed to install induction furnace of capacity 6 TPH with Pulse Jet Bag Filter as APCD as per the design of PSCST, Chandigarh.
3. The industry has proposed to install a D.G. set of capacity 125 KVA, which will be equipped with canopy and stack of adequate height.
4. The industry has completed the construction work of boundary wall and building shed.
5. No Trade effluent will be generated from the industrial process and only cooling water will be recirculated.
6. The domestic effluent will be generated, which will be discharged onto land for plantation after passing through septic tank.
7. The industry is located in the Industrial Zone as per notified Master Plan of Khanna.
It is submitted that the Govt. of India, Ministry of Jal Shakti, Deptt. of Water Resources RD&GR Central Ground Water Authority, New Delhi has issued directions u/s 5 of Environment (Protection) Act, 1986 vide letter no. CGWA- 21/6/2020-CGWA-101 dated 06/04/2022 “that it shall be mandatory for the Project Proponent abstracting ground water to obtain NOC from CGWA or the concerned State/ UT Ground Water Authority as the case made be in the compliance condition in consent to operate and consent to establish issued by the State Pollution Control Board.” Accordingly, the Board vide letter no. 1955-57 dated 18/01/2023 has informed all the officers of the Board in continuation to earlier circular no. CEE(HQ)/2018/7956-84 dated 03/03/2018 and 768-97 dated 13/01/2021 to ensure the compliance of the said directions.
PWRDA vide notification dated 27.01.2023 has exempted units from obtaining any permission of the authority, which are extracting not more than 300 cubic meters of ground water per month.
In the subject cited case, the industry has mentioned ground water extraction @ 9.0 KLD. Considering 30 working days per month, ground water extraction will be 270 KL/month, which is less than 300 KL/month. As such, the industry does not require permission from PWRDA.
Site Suitablitiy:
The industry has submitted the In-Principal Approval of the said land vide memo no. 2591/DTP(L)/M-2C dated 20/10/2023 issued by District Town Planner, Ludhiana, according to which the total land area 4.35 acres falls in the Industrial Zone as per notified Master Plan of Khanna (2010-31). As such, the site is suitable for the establishment of new unit.
Applicability of EIA notification dated 14/9/2006:
As per the Ministry of Environment, Forest and Climate Change (MoEF&CC) notification dated 07/06/2024, the industries involving in melting of non-toxic metals having production capacity less than 60,000 TPA are exempt from obtaining clearance under EIA notification dated 14/9/2006. In this case, the annual production of the industry is less than 60,000 TPA. As such, the industry does not falls in the ambient of EIA notification dated 14/09/2006.
Applicability of first schedule of Factories Act, 1948:
Yes, the industry is covered under the First Schedule of Factories Act, 1948, as such, the industry is required to obtain clearance of site from SAC. However, as per the Govt. letter no. 7319-45 dated 27/8/2015 has exempted the industries from obtaining clearance under Factories Act, 1948, which are being established in industrial zones. Accordingly, as per the In-Principal Approval of the industry, the site falls under industrial zone as per the master plan of Khanna. Hence, the industry has not required to obtain clearances under SAC.
Applicability of Press Note-17 (1984 series):
No, Govt. of Punjab vide its notification no. 10/134/2019-STE(5)/689 dated 14/7/2020 has withdrawn notification constituting SCA-cum-SAC.
In view of the facts mentioned above, if approved, the Consent to Establish (NOC) under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Steel Ingots/ Metal Rolls @ 78 MTD by using Heavy Melting Scrap/ Special Alloys/ Scrap @ 82 MTD as raw material may be granted for one year with suitable conditions and following special conditions:
1. The project proponent shall establish its unit in the land details mentioned in the sale & lease deed and In-Principal Approval issued by the DTP.
2. The industry shall submit the completion certificate of APCD to be installed with Induction Furnace from PSCST, Chandigarh at the time of obtaining consent to operate.
3. The industry shall comply with the guidelines/SOPs provided by PSCST, Chandigarh in the effective operation of APCD.
4. The industry shall apply for consent to operate under the provisions of the Water Act, 1974 and the Air Act, 1981 before commissioning of the unit.
5. The industry shall provide stack monitoring arrangements as per emissions regulations part 3 (1985 series) as per CPCB manual.
6. The industry shall install rotary valve along-with conveyor system below bag filters to avoid manual handling of APCD dust.
7. The industry will get its building plans approved from competent authorities before commissioning of the unit.
8. The industry shall not carry out any activity covered under the ambit of EIA Notification dated 14/09/2006.
9. The industry shall comply with PWRDA Guidelines issued from time to time.
10. The industry shall provide thick plantation of spreading crown varieties of evergreen trees all along the boundary wall.
