It is submitted that the project proponent has been granted ‘Consent to Establish’ NOC under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/SAS/2023/24477159 dated 19-01-2024, having validity upto 30-11-2024 for establishment of new Warehouse/Cold Store subject to certain conditions mentioned therein.
Now, the project proponent has applied for obtaining ‘consent to operate’ under the Green Category for Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, for establishment of a new Warehouse, alongwith requisite documents and fees.
The project proponent has deposited Rs. 72500/- vide R. no. 295076265 dated 11.06.2024 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 72500/- vide R. no. 54869656 dated 11.06.2024 under the Air (Prevention & Control of Pollution) Act, 1981, which is adequate upto 30.06.2029, against the cost of the project of Rs. 12.99 cr. on 31.05.2024.
The industry has submitted a copy of letter no. DOFPB00038817 dated 20.03.2024 issued by office of Director of Factories, Punjab, vide which the building plans of the project proponent M/s Spacex Supply Chain Solutions Llp Village - Basma, Sub Tehsil - Banur, Distt. SAS Nagar, has been approved by the said authority.
Visit:.
Accordingly, the industry was visited by AEE of this office on 20.06.2024 and during visit, it was observed as under:
1. The project is a warehouse only and was not in operation during the visit. The representative informed that they shall start the operations at the warehouse after obtaining ‘consent to operate’ from the Punjab Pollution Control Board.
2. The project proponent has installed one no. of tubewell in its premises and flowmeter is yet to be installed with the same.
3. The project proponent has constructed septic tank in its premises, after which domestic effluent shall be used onto land for plantation within premises.
4. The project proponent has installed any boiler, furnace, paint booth, powder coating etc., or any source of air pollution in its premises.
5. The project proponent has not installed any plan and machinery or any trade effluent generating process in its premises.
6. The industry has installed 02 no. DG sets of capacity 50 KVA and 500 KVA, which are provided with canopies and stack of adequate height.
From above, it is clear that the project proponent is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
Recommendations:
In view of above, if may approved, the project proponent may be granted ‘consent to operate’ granted to the industry under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, upto 31.12.2028 with usual conditions & with following special conditions:
1. The project proponent shall not carry out any manufacturing activity in its premises, without prior permission from Punjab Pollution Control Board.
2. The project proponent shall not generate and discharge any kind of trade effluent from its premises and shall discharge only domestic effluent onto land for plantation within its premises after passing through septic tank.
3. The project proponent shall not use any fuel in its premises except HSD for operations of DG sets.
4. The project proponent shall not install any boiler/furnace in its premises, without prior permission from PPCB.
5. The project proponent shall comply with the by-laws of the Department of Town & Country Planning, at all times.
6. The project proponent shall comply with the guidelines issued by PWRDA and shall obtain permission from PWRDA for abstraction of ground water (if required).
7. The project proponent shall not discharge the effluent into any drain/choe/nallah, in any case.
8. The project proponent shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances.
9. The project proponent has been approved by the Board from pollution angle and the industry shall obtain the statutory clearances / permissions from all other concerned departments.
10. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the project proponent and the project proponent shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.
11. The project proponent shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time.
12. The Consent is being issued to the project proponent based upon the documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing.
13. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent.
