It is submitted that earlier the industry was granted consents to operate under the Water Act, 1974 & the Air Act, 1981 vide nos. CTOW/Varied/MOG/2022/18201528 & CTOA/Varied/MOG/2022/18201382 dated 04.04.2022 for of its rubber tyre shredding unit to manufacture rubber chips @ 1,12,2000 MT per year from waste tyres with validity upto 31.12.2027, subject to the certain conditions mentioned therein.
The Board vide office memo no. 65 dated 11.03.2022 has carried out classification of left out industrial sectors i.e. rubber chips / crumb and reclaimed rubber manufacturing from waste / used tyres. As per this office memorandum at serial no. 76, the industrial code 3076 with category green has been mentioned as "Rubber chips / crumb manufacturing from waste / used tyres using cutter / shredder with de-beading facility or having effluent discharge from washing of tyres less than 10 KLD or both".
Now, the industry has applied for obtaining consent to operate under the Water Act, 1974 & the Air Act, 1981. Details of the case are as under:-
• The industry has submitted CA certificate regarding its gross fixed assets of Rs 10.02 lakhs. It has already deposited Rs. 11600/- vide UTR / Ref. No. 000286207130 dated 28.09.2020 under the Water Act, 1974 and Rs. 11600/- vide UTR / Ref. No. 000286198603 dated 28.09.2020 under the Water Act, 1974 and the Air Act, 1981, which are adequate upto 31.12.2027 under both the Acts.
• The industry has submitted request letter regarding amendation in product detail from "Rubber Chips" to "Rubber Chips / Crumb Rubber".
To check the compliance, the industry was visited by undersigned on 31.03.2022 and it was observed as under:-
1. The industry was not in operation during visit.
2. The industry has installed 02 no. bead wire machine, 04 no. cutters and 04 no. shredders as machinery in its premises.
3. The process of industry consist of: Tyre scrap (raw material) > tyre de-beading > cutting into pieces > Chips / crumbs cutting using shredders > Product There is no uses of oil, water and chemicals in the process, thus there is no generation of trade effluent and air pollution during this process.
4. No washing of the raw material (tyres) is being done in the premises.
5. The industry has installed a septic tank for treatment of domestic effluent generated from its premises with outlet of same onto land for plantation along the boundary.
It is therefore recommended that consent to operate under the Water Act, 1974 & the Air Act, 1981 may be granted to the industry for a period upto 31.12.2027 for operation of rubber tyre shredding unit to manufacture Rubber Chips / Crumb Rubber @ 1,12,2000 MT per year from waste tyres, subject to conditions and specific as under:-
1) This consent shall supersede the earlier consent granted to it vide no. CTOW/Varied/MOG/2022/18201528 & CTOA/Varied/MOG/2022/18201382 dated 04.04.2022 under the Water Act, 1974 & the Air Act, 1981.
2) The industry shall not import raw material (waste tyres) without obtaining prior permission from the Board as actual user intending to import or transit for transboundary movement of hazardous and other wastes specified in Part A and Part B of Schedule III of the HWM Rules, 2016, if it tends to import its raw material in future.
3) The industry shall not carried out washing of raw material in its premises without prior permission of the Board.
4) The industry has always complying with the Noise Pollution (Regulation & Control) Rules, 2000.
