File Note: Recommendations: It is intimated that the industry is small scale orange category unit was granted consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOW/Renewal/FGS/2020/13594485 dated 14/09/2020 and CTOA/Renewal/FGS/2020/13594473 dated 14/09/2020 both are valid upto 30/09/2024 for the manufacturing of Castings @ 12.600 MTD and Runner Riser @ 1.890 MTD in the name of M/s Ocean Pumps Pvt. Ltd. The applicant has submitted his report in the Hon'ble NGT alongwith pictures of the industries causing air pollution in the area of Mandi Gobindgarh. To verify the contents of the report alongwith pictures submitted by the applicant, the industry was visited by the AEE on 16/03/2024. During visit, it was observed that as per stack of industries from which the black smoke emitted was reported not from the premises of the industry, it originated from M/s Chehal Udyog. After that the industry was issued Show Cause Notice before the Chairman of the Board on 12/04/2024 at 11:00 AM at Vatavaran Bhawan, Nabha Road, Patiala as the industry is being operated in the name of M/s Fern techno cast Pvt. Ltd but the industry has obtained consent to operate in the name of Ocean Pumps Pvt. Ltd. After hearing of the officers of the Board and representative of the industry, the Chairman of the Board decided as under: 1. The consents to operate granted to M/s Ocean pumps Pvt. Ltd. under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 be revoked/Cancelled. 2. The industry shall apply for consents to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 with new name alongwith requisite documents/fee within 7 days. 3. The industry shall comply with the SOPs framed by the PSCSST, Chandigarh to operate APCD at all the time. 4. The industry shall use good quality scrap with proper size, as raw material at all time. 5. The Environmental Engineer, Regional Office, Fatehgarh Sahib shall visit the industry to verify the concentration of the representative of the industry within 10 days. He shall submit the report/ recommendations along with comments, as the whether the industry needs APCD for secondary emissions. Now, the industry has applied for varied consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 with requisite documents through OCMMS. The industry has changed the industry name to M/s Fern Techno cast Private Limited. The industry has also submitted the documents regarding change the name of industry. The industry has already deposited consent fee of Rs. 42000/- vide Common R. No. 57/5235 dated 14/06/2019 & Rs. 44100/- each vide UTR No. N238201223587461 dated 25/09/2020 as water consent fee & Rs. 42000/- vide Common R. No. 57/5235 dated 14/06/2019 & Rs. 44100/- N238201223588330 dated 25/09/2020 as air consent fee which is adequate upto 30/09/2025. Now, the industry has deposited of Rs. 33600/- vide no. 663659523 dated 23/04/2024, Rs. 8400/- vide no. 275420139 dated as water consent fee and Rs. 33600/- vide no. 838254792 dated 23/04/2024 as air consent fee against the fixed assets of Rs. 154.64 lakhs as on 20/03/2024 CA certificate dated 16/04/2024 which is adequate upto 30/09/2029 as per office order dated 29/10/2018.The industry has deposited NOC Regularization fee of Rs. 2900/- vide no. 99550186 dated 18/04/2024. To verify the contents, the industry was visited by the AEE of this office on 24/06/2024 During the visit, it was observed as under: 1. The industry was in operation during the visit. 2. The industry has installed induction furnace of capacity 0.5 TPH and using bag filter as APCD. 3. The industry has installed energy meter on its APCD and its reading was 48524. 4. The industry has engaging in the manufacturing of casting @ 12.6 MTD by using iron and steel @ 15.700 MTD. 5. The industry has discharged its domestic effluent onto land for plantation after treatment in a septic tank, and the cooling water is recirculated. 6. The industry has install 01 no. DG set of capacities 62.2 KVA with canopies/acoustic rooms and adequate stack heights. 7. The industry has installed water meter on its submersible pump and its reading was 139.87 KL. 8. The industry has submitted air analysis report from M/s SIMA LABS (NABL Approved) dated 16/04/2024 as per result the parameters i.e. particulate Matter is 78.3 mg/Nm3 which is within the prescribed limits of the Board. 9. The industry has complied with the SOPs framed by the PSCST, Chandigarh to operate APCD and also maintained the record. 10. The industry was used good quality scrap with proper size, as raw material during the visit. Moreover, the Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under: "The Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries." PWRDA vide notification dated 27.01.2023 has exempted units from obtaining any permission of the authority, which are extracting not more than 300 cubic meters of ground water per month. In the subject cited case, the industry has mentioned ground water extraction @ 3.5 KLD. Considering 25 working days per month, ground water extraction will be 87.5 KL/month, which is less than 300 KL/month. The industry does not need to obtain permission for the abstraction of groundwater from PWRDA. In view of above, if approved it is recommended that the varied consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of casting @ 12.6 MTD upto 30/09/2029 with suitable conditions and special conditions as under: 1. The industry will recycle its entire cooling water and will not discharge the same under any circumstances. 2. The industry will not add any water polluting process without obtaining prior written permission of the Board. 3. The industry shall operate the APCD regularly and efficiently so as to achieve the prescribed emission standards on regular basis. 4. The industry shall comply with the SOPs prescribed by the Board for induction furnaces. 5. The industry shall appoint dedicated staff for operation/ maintenance of APCD.
