It is intimated that the industry is a small-scale green category unit. The industry has applied for obtaining "Consent to Establish" (NOC) for an industrial unit u/s 25 of Water (Prevention & Control of Pollution) Act, 1974 and u/s 21 of Air (Prevention & Control of Pollution) Act, 1981 for Cold storage of Fruits & Vegetables @ 2000 MTD alongwith requisite documents and fee.
NOC Fee
The industry has deposited Rs. 18,500/- vide Receipt No. 36632953791DC dated 14.06.2024 as NOC fee including application form fee against the total project cost is Rs. 9.35 crores. The NOC fee deposited by the industry is adequate for one year.
Manufacturing Process
Finished Goods—Store as per batch & date in control Temp.(15 degree to 25 degree)—Sorting and Re-Packing as per requirement—Dispatch to the Market.
Site suitability
The industry has submitted copy of letter issued by Tehsildar Derabassi vide no. 44 dated 11.03.2024 and as per which site is suitable for establishment of cold storage at Village Behra, Tehsil Derabassi at Khasra no. 44//2/2 (0-14), 3 (3-14), 8/1 (0-6), 8/2 (2-12), 4/1/2 (1-4), 7/2/1 (0-2), 7/3 (1-6), 4/2 (2-0), 7/1/1 (1-9), 9/1/2 (0-14-10), 4/1/1 (0-2), 4/2 (0-8), 7/2/2 (0-1), Kite 13, Rakba 14 Bigha - 12 Biswa- 10 Biswasi, Hadbast No. 198.
The industry has submitted certificate of In Principal Approval vide Memo No. 1997 dated 16.05.2024 having validity upto 15.11.2027 for cold storage/warehouse.
Further, there is no residential area/lal lakir/phirni within the 100 mtr boundary of the project and as such the site is suitable for establishment of such units.
Water Pollution:
As per project report and application submitted by the industry, there is no generation of trade effluent and the entire cooling water will be re-circulated. The domestic effluent @ 0.5 KLD will be generated, which will be discharged onto land for plantation after passing through septic tank.
Air Pollution:
The industry will not involve any air polluting process. However, it has proposed to install one no. D.G set of capacity 125 KVA, which will be equipped with canopy and adequate stack height.
Applicability of EIA notification dated 14.09.2006:
The manufacturing of the industry is not covered under the ambit of EIA notification dated 14.09.2006.
Visit
The site of the industry was visited by the officer of the Board on 22.06.2024 and it was observed as under:
1. The proposed site of the unit is located in Village Behra, Tehsil Derabassi, SAS Nagar.
2. The industry has provided boundary wall along its plot and civil construction work has been started at site.
3. The project proponent has not installed any machinery at the project site.
4. The site is complying all the general sitting guidelines framed by the Board for Green Category Unit.
5. The industry is covered under Green Category i.e. 3013- Chilling plant, cold storage and ice making.
Recommendations
In view of above, it is recommended that ‘Consent to Establish’ (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted to for one year with subject to suitable conditions and additional condition that: -
1. The industry shall apply for obtaining consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 before commissioning of its unit.
2. The industry shall not start any new process within its unit which may change its category from Green to Orange/ Red, without the prior written permission of the Board.
3. The industry shall not discharge the effluent into any drain/choe/nallah, in any case.
4. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances.
5. The industry shall recycle the entire quantity of cooling water (if any).
6. The industry shall develop its project strictly in accordance with the layout / building plans approved / to be approved by the Competent Authority.
7. The industry shall ensure that due to operation of the project at the site, no nuisance for general public is created at any time and no public complaints are received.
8. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.
9. The establishment shall obtain all the statuary approvals/clearances from the concerned departments.
10. The NOC is being issued to the project proponent based upon the documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing.
11. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent.
