It is intimated that the project is a small-scale green category residential plotted project. The project proponent has applied for obtaining “Consent to Establish” (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for development of Affordable Residential Plotted Colony @ 71 Nos. and EWS Plots @ 10 Nos. alongwith requisite documents and fee.
NOC Fee
The project proponent has submitted brief project report as per which the proposed cost of the project is Rs. 6.16 Crores. The project proponent has deposited Rs. 18,500/- vide UTR. No. KARBN24170303496 dated 18.06.2024 including form fee. The NOC fee deposited by the project proponent is adequate for two years.
Land Documents
The project proponent has submitted copy of sale deed issued on dated 15.03.2024 between Sh. Gurpreet Singh & others (First Party) and SS Infra (Second Party) for area of land 4.0 Bigha 10.0 Biswa.
The project proponent has submitted the partnership deed executed on dated 02.02.2024 between Sh. Taranjeet Singh, Sh. Gurpreet Singh, Smt. Kulwant Kaur and Sh. Kuldeep Singh.
Site Suitability
The project proponent has submitted copy of approved site plan, approved by Sh. Damanjit Singh Mann, ADC (UD), SAS Nagar dated 14.06.2024.
Water Pollution
The project proponent has submitted the feasibility report and as per which the total estimated population of the project will be 405 persons. The total water requirement of the project will be 54.7 KLD. The project will generate 43.7 KLD of wastewater which will be treated in STP of capacity 60 KLD. The treated wastewater will be discharged onto land for plantation within premises and excess will be discharged onto land for plantation area developed as per Karnal Technology in an area of 0.5 acre.
Solid waste will be generated from the residential complex about 150 kg/day, which will be segregate into biodegradable & non-biodegradable waste. Biodegradable waste will be used as composter by vermi-composting pits or mechanical composter & non-recyclable waste will be dumped to authorized MC dumping site or it will handover to Waste management facility.
The project proponent has submitted an affidavit disposal of treated effluent issued on dated 20.06.2024 between SS Infra (Party 1) and Smt. Paramjit Kaur (Party 2) and as per which:-
1. Party 2 will provide its own share of land to party 1 nearby project “PUNJAB ENCLAVE” that is being developed by party 1 having khasra no. 718(4-0), 719(4-0), 720(4-2), 721(2-4), 722(2-2) kite 5 total land 16 bigha 8 biswasi share 800 Hissa measuring around half acre land, for discharge of only treated water for plantation purpose as per karnal technology.
2. Party 1 will not charge any money from party 2 on the pretext. No untreated water from the project PUNJAB ENCLAVE being developed by party 1 will be discharge into the land developing to party 2.
3. This agreement will remain valid for 10 years up to 21 June 2034 and party 1 will comply with all the rules, regulations and norms of PPCB, as issued from time to time.
Air Pollution
The project proponent has proposed to install one D.G set of capacity 250 KVA, which will be equipped with canopy and adequate stack height. There is no other source of air pollution.
Applicability of EIA notification dated 14.09.2006
As per the application form and site plan submitted by the project proponent the project shall be developed as Affordable Residential Plotted Colony Project. As the total project area is 3.223 acres, it is not covered under category 8-B of the EIA notification dated 14.09.2006 and not required to obtain prior Environmental Clearance.
Visit
The site of the project was visited by AEE of this office on 22.06.2024 and during visit, it was observed that:
1. The site is located at Village Baltana, Sub-Tehsil Zirakpur, Tehsil Derabassi, District SAS Nagar.
2. The site is empty plot and no development work has been started.
3. As physically observed, the distance of the proposed site from the various approved existing operational industries / units (for which specific siting guidelines has been issued by the Board for time to time), is more than the required distance as per the siting criteria given as under:

The site is complying with general siting criteria as per policy dated 30.04.2013 and specific sitting guidelines as per the Department of Science, Technology, Environment, Government of Punjab notification no. 3/6/07/STE (4)/2274 dated 25.07.2008.
4. However, there is Sukhna Choe within the 100 mtr boundary of the project and as per the approved site plan the STP has been proposed at the farthest end of the Sukhna Choe.
5. The Plantation are has been proposed adjoining to the Sukhna Choe and the project proponent has been advised to provide bund wall towards the Sukhna Choe.
Recommendations
In view of the above, it is recommended that “Consent to Establish” (NOC) from pollution angle under the provisions of the Water (Prevention & control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted for two years with subject to suitable conditions and following additional conditions that:
1. The promoter shall not allow any occupancy in the project till the time adequate arrangements for treatment & disposal of wastewater and solid waste are made as well as 'Consents to Operate' under the Water Act, 1974 & the Air Act, 1981 are obtained.
2. The project proponent shall install STP of capacity 60 KLD followed by UF Membrane and submit the complete drawing and design of the STP and its component at the time of obtaining consent to operate.
3. The project proponent shall develop land bearing khasra no. 718(4-0), 719(4-0), 720(4-2), 721(2-4), 722(2-2) kite 5 total land 16 bigha 8 biswasi measuring around half acre land in Village Baltana as per Karnal Technology for disposal of treated domestic effluent as per the affidavit submitted by it. The project proponent shall provide bund wall towards the Sukhna Choe in the plantation area.
4. The project proponent shall provide separate water meter and energy meter for the STP.
5. The promoter company shall ensure that the total built up area of construction being carried out by it orany different builders may not be greater than 20,000 sqm, otherwise the project as such is covered under category 8(a) of the schedule appended to the EIA notification and project proponent of the building and construction project is required to obtain the environmental clearance, failure which, the promoter company/builder shall be liable for action for the violation of EIA notification dated14/09/2006.
6. The project proponent shall utilize treated wastewater from nearby STPs for the construction purpose and shall submit an agreement in this regard within one month.
7. The project proponent shall place adequate no. of bins outside its premises from where the Municipal Solid Waste shall be got lifted.
8. The project proponent shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016 and ensure that the solid waste is segregated into biodegradable and non-biodegradable components. The biodegradable component shall be treated by providing mechanical composter of adequate capacity to produce compost, which will be disposed of/reused in an environmentally sound manner and the non-biodegradable solid waste shall also be disposed of in an environmentally sound manner.
9. The project proponent shall also ensure that the hazardous waste and e-waste components of the solid waste shall also be segregated and the same shall be channelized to the authorized facility for such type of waste.
10. The project proponent shall comply with the provisions of the Construction and Demolition Management Rules, 2016.
11. The project proponent shall take adequate steps to the effect that the construction material of any kind that is stored at site shall be fully covered in all respects so that it does not disperse in the air in any form.
12. The project proponent shall ensure that all the construction material and debris shall be carried out in trucks or other vehicles which are fully covered and protected so as to ensure that the construction debris or the construction material does not get disburse into the air or atmosphere in any form.
13. The project proponent shall take all necessary steps to control the dust emissions to be generated from the construction activities of the project.
14. The project proponent shall ensure that the vehicles carrying construction material and construction debris of any kind shall be cleaned before it is permitted to ply on the road after unloading of such material.
15. The project proponent shall provide mask to every worker working on the construction site and involved in loading/ unloading and carrying of construction material and construction debris.
16. The project proponent shall provide all medical help, investigation and treatment of workers involved in construction of building and carrying out construction material and debris related to dust emissions.
17. The promoter shall develop its residential complex strictly in accordance with the layout / building plans approved / to be approved by the Competent Authority.
18. The NOC is being issued to the project proponent based upon the documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing.
19. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent.
