It is submitted that the industry was newly identified by Sh. Rishi Sikka, JEE of this office on 15.05.2024. The industry was operating its process without obtaining consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. Hence, the industry was issued notice for violation of the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide this office letter No. 1168 dated 20.05.2024. The industry had submitted its reply on 03.06.2024 and observed that earlier, the industry had obtained consent to Establish (NOC) of the Board vide no. CTE/Fresh/LDH1/2021/15683725 dated 04.062021 which was valid upto 04.06.2022.
Now, the industry has applied fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for alongwith requisite document and fee.
The site of the industry was visited by the AEE of this office on 21.06.2024 and it was observed as under:-
1. The industry is a Small Scale, green Category unit and was in operation during visit.
2. It has installed 5 LPG fired Rotary furnaces.
3. The manufacturing process of the industry is Raw Material (Forgings/Castings/Bar Cutting) Heating in Furnace Quenching in Water Tempering Hardness Checking Ready for delivery.
4. The industry has no DG set/boiler in its premises.
5. It has provided septic tank to treat the domestic effluent.
6. The treated domestic effluent is discharged onto land for plantation.
7. The industry has submitted the letter issued by DTP, Ludhiana vide no. 888 DTP(L) dated 18.03.2021 vide which the site of the industry falls in Industrial Zone as per Master Plan, Ludhiana (2007-31).
8. As per 1st Bill issued by the industry on 13.08.22 and electricity Bill data the production started in the month of August/2022.
9. As per CA certificate submitted by the industry the value of total fixed assets is Rs. 87.33 Lacs as on 21.05.2024.
10. The industry has deposited consent fee as under:-

11. The consent fee deposited by the industry is adequate upto 15.02.2032 as under:-
13.08.2022 to 12.08.2031 = 9 Year + 2 Year Penalty period (1-2 years @ 200% of one year fee)= 11 years * 4200/- = 46,200/- + 2100/- (13.08.2031 to 12.02.2032)= 48,300/- each.
Keeping in view of the above, it is recommended that consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 31.12.2031. to the industry.
