It is submitted that the industry is a small scale orange category rice sheller and was granted consent to establish/NOC from the Board under the Water Act, 1974 and the Air Act, 1981 vide no. CTE/Fresh/SGR/2023/22617628 dated 04/08/2023 valid upto 03/08/2024 for manufacturing of Sorted Raw Rice with Dryer/Steamed Rice @ 2.0 TPH by processing of Paddy @ 3.0 TPH, as raw material under orange category with certain conditions mentioned therein.
Now, the industry has applied for obtaining fresh NOC under the Water Act, 1974 and under the Air Act, 1981 for manufacturing of Sorted Raw Rice with Dryer/Steamed Rice @ 4.0 TPH / Saila Rice @ 2.0 TPH @ 4.0 TPH by processing of Paddy @ 6.0 TPH, as raw material. The rice sheller has already deposited Rs. 18,500/- (Rs. 18,000/- as NOC fee + Rs. 500/- as application fee) vide no. 539940121 dated 25.02.2024 under the Water Act, 1974 and the Air Act, 1981. The industry has submitted the CA certificated for the value of fixed assets Rs. 792.64 Lacs as per project report which is adequate for one years. The industry had already obtained DTP certificate vide letter no. 660 DTP (S) RS-I dated 12/05/2023 for land measuring 23 kanal 2.5 marla land in Lehra Road, Village Nihalgarh, Tehsil Dirba, District Sangrur, having Khasra No. 17//19 Min (5-11.5), 23(8-0), 19/2(1-11), 22(8-0). Now, the industry has submitted CLU report for newly added land issued by DTP, Sangrur vide memo no. 45 DTP (S) RS-I dated 04.01.2024 as per which, the industry is adding 6 kanal 14 marle land from khasra no. 17//18 (6-18). After expansion, total measuring land is 29 kanal 6.5 marle. As per DTP certificate condition no. 10, there is a 11 KVA high tension wire passes over the site.
The industry has submitted Tehsildar report which is stated as under:-
1. The proposed site falls at a distance of more than 500 mtr from lal lakir / phirni of any Village.
2. There is no wild life sanctuary / Zoo within 500 mtr from the proposed site.
3. There is no approved residential area / colony within a radius of 500 meter from the proposed site.
4. There is no Educational Institute, Historical/religious places & Protected Monuments within a radius of 500 Meters from the proposed site.
5. The site does not falls under Punjab Planning Development, PUDA, MC, and Improvement Trust.
To verify facts, the site was visited by undersigned on 15/04/2024 and it was observed as under : -
1. The site is located in the revenue estate of Lehra Road, Village Nihalgarh, Tehsil Dirba, District Sangrur.
2. An electric line of 11 KVA is passing over the site of the industry.
3. The industry has proposed to install separate cyclone separator as APCDs for shelling section and paddy cleaner of dryer section. The industry has also proposed to install separate cyclone with saila plant and boiler section.
4. The industry has propose to produce saila rice, thus will generate trade effluent to the tune of 72 KLD per day. The industry has proposed to install ETP of 80 KLD capacity which is based on the biological treatment system. The industry has proposed to dispose treated trade effluent onto land for plantation in an area of separate land 10 kanal 12 marle. The industry has submitted land registry of land measuring 10 kanal 12 marle for disposal of treated waste water.
5. The industry has proposed to use 3.0 KLD of water for domestic use, thus only domestic effluent @ 2.4 KLD will be discharged onto land for plantation after passing through septic tank.
6. The industry has submitted copy of project report, proposed layout plan, Partnership Deed, CLU certificate (copy enclosed), Tehsildar report, Jamabandi and Copy of registry.
7. The proposed site of the industry meets with the siting guidelines framed by the Board for the establishment of rice shelling units.
From the above, it is clear that the industry is meeting with the specific siting guidelines prescribed by the Board for the establishment of a rice sheller unit, as per Deptt of Science Technology & Environment Govt. of Punjab Order No. 10/48/2004/STE(4)/932 dated 15.10.2013. The competency for grant of NOC to Rice sheller with or without dryer and saila plants lies with the Environmental Engineer of Regional office, as per Board circular no. 23539-76 dated 03.06.2013. Keeping in view of above, if approved, the consent to establish (NOC) for setting up of rice sheller unit at proposed site located at Village Gujjran, Tehsil Dirba, District Sangrur to manufacture Sorted Raw Rice with Dryer/Steamed Rice @ 4.0 TPH / Sella Rice @ 2.0 TPH @ 4.0 TPH by processing of Paddy @ 6.0 TPH, as raw material may be granted to the industry with suitable conditions as per policy of the Board and special condition that:-
1. The industry shall comply with the terms and conditions mentioned in the DTP certificate vide letter no. 45 DTP (S) RS-I dated 04.01.2024 by the Competent Authority.
2. The industry shall shift the electric line of 11 KVA from the proposed site before the start of construction work below this electric line.
