It is submitted that earlier the industry was visited by the officer of the Board on 13.05.2023 and the industry was in operation and engaged in pickling process. The industry has not made an agreement with CETP operator/Re-processor for lifted of trade effluent. The industry representative informed that they are disposing off pickling effluent into sewer.
Thereafter, directions u/s 33-A of the Water Act, 1974 has been issued to the PSPCL authorities to disconnect the electric supply of the industry vide Board’s letter no. 4319-4321 dated 07.08.2023. The PSPCL Authorities have disconnected the electric supply of the industry vide TDCO no. 162/298 dated 01.09.2023. Thereafter, the industry was granted consent to operate under the Water Act, 1974 vide no. CTOW/Fresh/LDH4/2023/23535031 dated 26.09.2023 and Air Act, 1981 vide no. CTOA/Fresh/LDH4/2023/23527951 dated 21.09.2023, which were valid upto 20.03.2024 with temporary restoration of electric connection upto 20.03.2024.
Thereafter, the industry has obtained auto renewal consent to operate under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTO/Renewal/LDH4/2024/25024077 dated 28.02.2024 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTO/Renewal/LDH4/2024/25025272 dated 28.02.2024, which are valid upto 28.02.2029.
The industry was visited by the officer of this office on 21.03.2024 and it was observed as under:-
1. The industry was in operation during visit.
2. The industry has installed powder coating booths with inbuilt cyclone as APCD including phosphating section.
3. The industry has also provided 01 oven with adequate stack height.
4. The industry has submitted an agreement made with CETP operator i.e. with M/s JBR unit-1 for lifting of trade effluent @ 2000 Ltr/month.
5. The industry has installed water meter on the source of supply in phosphating process and reading was to be noted 11.521 KL.
6. The industry has maintained the record of water consumed in process and effluent lifted to the CETP Operator. As per record maintained by the industry the reading on 01.10.2023 was 0.57 KL and the industry was consumed fresh water 10.95 KL during period 01.10.2023 to 21.03.2024. The industry was lifted out trade effluent @ 9.2 KL during this period and the industry has stored approx. 700 Ltr.
7. The industry has also provided storage tank of capacity 2000 ltrs for storage of effluent generated from phosphating section.
From above, the industry is complying with the provisions of the Water Act, 1974 and Air Act, 1981. However, the industry had obtained long-term auto renewal consent to operate under the Water (Prevention & Control of Pollution) Act, 1974.
Therefore, the industry was given personal hearing before Senior Environmental Engineer, Zonal Office-2, Ludhiana on 26.04.2024 for revocation of auto renewed consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide Board letter no. 2846 dated 06.05.2024 and wherein it was decided that:-
1. Auto renewed consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 be revoked.
2. Environmental Engineer, Regional Office-4, Ludhiana shall get the compliance of directions issued to the industry earlier, as till date no further extension in the electric connection restorations is allowed by the Board. He shall submit the report alongwith recommendations, within 07 days.
Further, the auto renewed consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 was revoked vide letter no. 3265-66 dated 09.05.2024.
Now, the industry has applied for fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 through OCMMS along with request letter that electric connection may not be disconnected as the industry is not violating provisions of the Water (Prevention & Control of Pollution) Act, 1974.
The industry has already deposited consent fee Water Act, 1974 Rs. 21,000/- vide R.No. IBKL230725928641 dated 25.07.2024, Rs. 1,400/- vide R.No. IBKL230725929037 dated 25.07.2024 and Rs. 700/- vide R.No. IBKL230725929170 dated 25.07.2024, which adequate upto 30.06.2028.
Accordingly, the site of the industry was visited by the officer of this office on 24.06.2024 and it was observed as under:-
1. The industry was in operation during visit.
2. The industry has installed powder coating booths with inbuilt cyclone as APCD including phosphating section.
3. The industry has also provided 01 oven with adequate stack height.
4. The industry has submitted an agreement made with CETP operator i.e. with M/s JBR unit-1 for lifting of trade effluent @ 2000 Ltr/month.
5. The industry has installed water meter on the source of supply in phosphating process and reading was to be noted 17.34 KL.
6. The industry has maintained the record of water consumed in process and effluent lifted to the CETP Operator. As per record maintained by the industry the reading on 01.10.2023 was 0.57 KL and the industry was consumed fresh water 16.77 KL during period 01.10.2023 to 24.06.2024. The industry was lifted out trade effluent @ 16.2 KL during this period and the industry has stored approx. 400-500 Ltrs. in the storage tank.
7. The industry has also provided storage tank of capacity 2000 ltrs for storage of effluent generated from phosphating section.
It is pertinent to mention here that the industry is maintaining the record of water consumption/ storage/ generation/ lifting to CETP operator and the industry has submitted request letter that electric connection may not be disconnected as the industry is not violating provisions of the Water (Prevention & Control of Pollution) Act, 1974 and consent to operate may be granted for further period (Copy of the request letter attached in note history-Clarification).
In view of above, if approved, it is recommended that the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 may be considered for grant for six months alongwith extension in restoration of electric connection for further extended for six months with suitable conditions as per policy of the Board.
