The industry was earlier issued show cause notice for violating the provisions of Water Act, 1974 and Air Act, 1981 with an opportunity of personal hearing before the Chief Environmental Engineer, Ludhiana on 29.05.2023 as the industry was not achieving the effluent standards. After hearing, it was decided as under:
1. The project proponent shall submit records of water extraction and usage for at least three months along with other records to the Regional Office-3, Ludhiana for its consideration and audit, within 10 days.
2. The project proponent shall submit the complete details of individual eateries, their waste generation at peak loads, total staff of the mall and the employees / workers of showroom / shops / eateries with expected solid waste generation and capacity of composter / compactor, if any provided, within 10 days.
3. The Bank Guarantees, if any expired shall be got extended, within 15 days.
4. Environmental Engineer, Regional Office-3, Ludhiana shall audit the water balance / generation of the effluent and as well as solid waste generation / disposal viz-a-viz composter installed and give further recommendations accordingly within 20 days.
In compliance to the decisions of the personal hearing given to it before Chief Environmental Engineer, Ludhiana, the project proponent has submitted all documents online and offline. The project proponent was complying with all the decisions of the hearing held on 29.05.2023 except for condition no. 1, the Project Proponent submitted ground water extraction record and STP water meter record, in which there were number of contradictions in the readings as compared to the actual reading…………………..
The project proponent has also submitted Bank Guarantee amounting Rs. 3.0 Lac and Rs. 1.5 Lac in this office. Thereafter, the report was sent to the Competent Authority………………………..
The Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 was refused on 16.08.2023 and Consent to Operate under Air (Prevention & Control of Pollution) Act, 1981 was renewed for a period for six months i.e. upto 02.02.2024…………………………….
The mall was visited by AEE of RO on 21.02.2024 and it was observed that:
1. The shopping mall has a separate food court and it has not adopted systematic record of daily food quantities served, and food converted to organic manure.
2. The shopping mall has not implemented a complete ban on single-use plastic items in its food court.
3. The effluent sample of STP was also collected from and as per the analysis report, all the parameters are within the permissible limits as prescribe by the Board (i.e. pH-7.6, TSS-19mg/l, COD-44mg/l, BOD-9mg/l and O&G-BDL).
Thereafter, the matter was considered by the Competent Authority and notice u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 was issued to the Project Proponent with an opportunity of personal hearing before Chairman of the Board on 14.03.2024 at Head Office, Patiala. After hearing, it was decided as under:
1. The industry shall submit the Bank Guarantee amounting Rs. 10.00 Lac as an assurance to comply with the Environmental Laws, within 07 days.
2. The Project Proponent shall apply for Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 within 15 days.
3. It was made clear to the Project Proponent that in case it is again found violating the provisions of the Environmental laws, strict action may be taken which may include closure without any further notice/opportunity of personal hearing.
In compliance to the above decisions, the Project Proponent has now again applied for renewal of the Consent to Operate under both acts…………………………
The Project Proponent has submitted all the required documents alongwith the application. The Project Proponent has also submitted Bank Guarantee amounting Rs. 10.00 Lac vide bearing no. 034GT02241100018, which is valid upto 18.04.2025……………………..
The Project Proponent has also submitted renewed Bank Guaranties amounting Rs. 3.00 lacs, bearing no. 034GT02152720008 and Rs. 1.5 lacs, bearing no. 034GT02211240001 both are valid upto 09.02.2025…………………..
The project proponent has deposited consent fee, which is adequate upto 30.03.2028 under Water Act, 1974 and upto 30.06.2028 under Air (Prevention & Control of Pollution) Act, 1981………………..
The site of the mall was visited by AEE of RO on 14.06.2024 and it was observed as under:
1. The entity has provided a STP for treatment of domestic effluent and same was in operation.
2. The Project Proponent has provided water meter at the source of fresh water and EMF at the outlet of the STP. The Project Proponent has also maintained the proper record of the water meter and energy meter.
3. The unit has provided 03 D.G sets of capacities 1010 KVA, 1010 KVA and 500 KVA. All were equipped with canopies and having adequate stack heights.
4. The project proponent has installed bio composter of capacity 200 KG/ batch for treatment / processing of food waste. The manure is being used for gardening.
5. The project proponent has made agreement with all the eateries regarding the Solid Waste Management as decided during hearing dated 19.04.2021.
6. The PP has made MOU with M/s A2V Infra Services for collecting solid waste.
7. The mall has also implemented a complete ban on single-use plastic items in its food court with instructions to all the mall shops. No SUP was observed in the mall.
Regional Office reported that the project proponent has complied with the decisions of the personal hearing held on 14.03.2024. The Project Proponent is also complying with the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 as well as with Guidelines/Mechanism for Hotels/Motels/Restaurants/etc. notification 2021 issued by the Board................................................
As proposed by Regional Office, may if approved that:
The renewal of the Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 be renewed to the Project Proponent for period upto 30.06.2027 with suitable conditions and with special condition that...............................................:
1) The project proponent shall not use and allow any banned single use plastic items by the caterers and shall not prior inform the organizer of the marriage parties/functions to not purchase, stock, use and distribute any banned single use plastic items such as plastic or Styrofoam plates, cups, glasses, cutlery items etc.
2) If any later stage the project proponent is found using any banned items then Board shall be at liberty to take action against project proponent as per Law.
3) The establishment shall obtain necessary permissions from Punjab Water Regulation and Development Authority (PWRDA)/ Central Groundwater (CGWA) for extraction of groundwater as and when required.
4) The PPCB shall be at liberty to take action against the establishment for failure to obtain the necessary permission for extraction of groundwater as and when required from the concerned Department.
5) The establishment shall maximize the reuse of treated water for non-potable purpose/gardening, etc.
6) The establishment shall furnish quarterly reports to the PPCB showing quantity of water consumption (month-wise) and quantity of treated water.
7) Rain water harvesting system shall be installed by all establishments in consultation with the PWRDA/CGWA. Bigger hotels/halls need to make arrangements for both roof-top and ground-based harvesting of rain water. In case roof-top harvesting is not possible/ viable, the smaller halls/venues having hosting capacity of less than 500 persons/guests shall then go for ground-based/artificial storage systems, storage tanks and other similar arrangements.
8) The establishment shall need to use efficient fixtures such as low flow shower heads, bath, sink faucet aerators, low flow toilets.
9) The establishments shall use approved fuel such as LPG, PNG, Charcoal for tandoor, boiler, etc. with preference to cleaner fuels.
10) The establishment shall properly channelize the fugitive emissions including emissions from cooking & kitchen operations by providing proper ducting/hood arrangement and proper exhaust system and emissions.
11) The establishment shall not install the any gensets on temporary as well as permanent basis without the acoustic enclosure for as per the specific norms.
12) The establishment shall explore the application of solar energy in various area such as illumination, water heating.
13) The establishment shall explore the use of inverters of Diesel Generator sets.
14) The establishment shall explore the use of LED bulbs.
15) The establishments shall properly handle, manage and dispose the solid waste generated and comply with the provisions of the Solid Waste Management Rules, 2016.
16) The project proponent shall comply with the clause 3 (8) of the Solid Waste Management Rules, 2016, marriage halls generating waste of more than 100 kg/day fall under the category of ‘Bulk Waste Generator’ and should ensure compliance with the provisions of the Rules.
17) The project proponent shall not throw, burn or burry the solid waste generated by him, on streets, open public spaces outsides his premises or in the drain or water bodies.
18) The establishments shall ensure that food waste shall kept in segregated from at source and shall be treated/ processed in organic waste convertor to through any other scientific way allowed under the Solid Waste Management Rules, 2016 and treated compost/ by product shall be used as manure or for other useful purposes.
19) The establishments shall ensure that the hazardous waste (used oil, used batteries) generated in the premises are collected property and disposed only to authorizes recyclers registered with MoEF&CC/CPCB and valid operating license of PPCB.
20) The establishment shall obtain permission from designated as per provisions of Noise Pollution (regulation & Control) Rules, 2000.
21) The establishment shall comply with provision of Noise Rules Specifically Rules 5 and Rules 6 of the Noise Rules.
22) The DG sets shall comply with the provisions of Noise Pollution Control limits.
23) The establishment shall obtain necessary permissions from the concerned departments under the above said guidelines for Traffic movement, Fire safety, Building plan and for development of green belt.................................................
