File Note: It is intimated that earlier the industry had applied for fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 through OCMMS of the Board. The industry was found violating the provisions of Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. The case was processed with the recommendations to refuse the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Accordingly, the industry was issued show cause notice for refusal of consent to operate applied under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 with an opportunity of personal hearing before Senior Environmental Engineer, Zonal Office-1, Patiala vide Board’s letter no. 544 dated 26.04.2024. The project proponent was given personal hearing before the Senior Environmental Engineer of the Board on 06.05.2024 and during hearing it was decided as under: 1) The consent to operate applied by the industry under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 be refused. 2) Environmental Engineer, Punjab Pollution Control Board, Regional Office, SAS Nagar may be asked to initiate the action against the industry u/s 33-A of the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 for its closure. The copy of the proceeding was conveyed to the project proponent vide Board’s letter no. 769 dated 08.05.2024. In compliance of the decision no. 1 of the proceeding the application applied by the project proponent was refused vide refusal no. CTOW/Fresh/SAS/2024/25329591 dated 09.05.2024 under Water (Prevention & Control of Pollution) Act, 1974 and vide refusal no. CTOA/Fresh/SAS/2024/25329539 dated 09.05.2024. Now, the project proponent has applied fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Automobile Parts @ 2000 No./day along with requisite documents. The project proponent has submitted CA certificate with the value of fixed assets of Rs. 2.67 crore as on 31.03.2024. The project proponent has already deposited Rs. 86,400/- vide R no. 526335703 dated 04.04.2024 under Water (Prevention & Control of Pollution) Act, 1974 and Rs. 72000/- vide R no. 10744817 dated 04.04.2024. After deduction of late fee, NOC regularization fee, which is adequate upto 28.02.2027. The project proponent has submitted GST certificate as proof of date of commissioning, as per which date of commencement is 18.04.2023. The project proponent has submitted letter for approval of building plan in the name of Almechnish Engineering Pvt. Ltd., plot no. 313, Phase-9, Mohali by PSIEC vide letter no. 488 dated 09.04.2013. The project proponent has submitted permission of sale of industrial plot no. 313, Phase-9, Industrial Focal point, Mohali issued from PSIEC vide letter no. 1653-58 dated 20.04.2021 between Sh. Shashank Gupta S/o Sh. Ajay Gupta & Smt. Mamta Gupta W/o Lt. Sh Ajay Gupta, Directors M/s Almechnish Engineering Pvt. Ltd. and Sh. Jasvir Kaur Walia W/o Sh. Darshan Singh Walia & Sh. Gagandeep Singh Walia S/o Sh. Darshan Singh Walia. The project proponent has submitted agreement with M/s Bantech Water Pvt Ltd. for lifting of trade effluent @ 4000 ltr/month generated from the industry. The project proponent has submitted manufacturing process as under: Raw material  Cutting  Bending Welding  Surface Treatment by Phosphate Process Powder coating Inspection Dispatch. The site was visited by the undersigned on 19.04.2023 and during visit it was observed as under: 1. The industry was in operation during the visit and engaged in manufacturing of auto parts. 2. The industry has installed phosphating section the same was yet not commissioned. The industry has installed ETP consist of Mixer Tank and Sand Filter for treatment of wastewater. The industry has executed an agreement with CETP, Chanalon to lift untreated effluent and has kept the ETP on standby in case of future use. 3. The industry is also engaged in metal surface treatment process. The industry has provided storage tank of capacity 2000 ltr to store wastewater generated from the process. About, 500 ltr of wastewater was found stored in the said tank. The same will be got lifted to the CETP as informed by representative of the industry. 4. The industry is also having Powder Coating process equipped with inbuilt Filter in closed booth. The filters are being cleaned inside the booth and reuse the material. 5. The industry has installed one no. Sand Blast Furnace the same was not in operation. 6. The industry has installed 1 no. DG set of capacity 160 KVA with canopies and stack of adequate height. From the above, the industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 as well as decision of personal hearing. In view of above, it is recommended that the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30.06.2026 with suitable and additional conditions as under: 1. The industry shall not discharge wastewater in illegal manner at any time. 2. The industry shall lift entire wastewater to the CETP. 3. The industry shall maintain the record of wastewater generated and lifted to the CETP and shall submit to the Board. Competency Senior Environmental Engineer
