File Note: Earlier, Directions U/s 33 A of Water Act,1974 and u/s 31 A of Air Act, 1981 were issued to the PSPCL authorities to restore the supply of the electricity temporarily upto 15.8.2023. The industry was granted renewal of consents to operate under the Water Act, 1974 and Air Act, 1981 dated 16.02.2023 with validity upto 15.08.2023, for production of Furnace Oil @ 6 TPD, by using Butyl Rubber/Waste Rubber as raw material in one no. reactor of capacity 10 TPD with usual conditions alongwith following special conditions. 1. The industry shall comply with the code of practice prescribed in the notification dated 15.10.2014 issued by the Govt. of Punjab. 2. The industry will submit the report from the concerned department related to adoption of safety measures in compliance to the notification dated 15.10.2014, within 15 days. 3. The industry will get its air emission samples analyzed from the Board's lab/Approved lab of the Board as per the policy of the Board. Further, the industry has applied for renewal of consents to operate under the Water Act, 1974 and Air Act, 1981 for production of Furnace Oil @ 6 TPD, by using Butyl Rubber/Waste Rubber as raw material in one no. reactor of capacity 10 TPD through online on OCMMS, with requisite documents. The fixed assets of the industry has increased from 41 lakhs to 50.13 lakhs as per the detail submitted by the industry as per CA certificate dated 17.10.2023 the industry has installed reactor, and its accessories. However, during visit no new rector was found installed. The industry has already deposited the consent fee of Rs. 21,000/- through online (Rs. 18000/- vide R.no. 467942214 dated 26.11.2021 &Rs. 3000/- vide R.no. 673439413 dated 20.01.2021) under Water Act, 1974 and Rs. 21,000/- through online (Rs. 18000/- vide R.no. 349403588 dated 26.11.2021 &Rs. 3000/- vide R.no. 519071688 dated 20.01.2021) under Air Act, 1981, against the fixed assets of Rs. 50.13 lacs, which is adequate upto 31.03.2024 after deducting the CTE fees. To verify the contents of the applications, the industry was visited by AEE of this office on 30.11.2023 and it was observed as under- 1. The industry was not in operation during visit however during visit was filling the reactor with raw material for running the industry. 2. The electric connection of the industry was found intact. 3. The industry has stored large amount of raw material inside its premises and there were many bags of carbon powder stored under shed and steel wire was lying inside the premises. 4. The industry has made room type enclosure for the storage of carbon powder and provided pneumatic/screw system for filling this carbon into bags. 5. The industry has installed wet scrubber which was in line The industry has provided stack of adequate height with the APCD along with sampling facility. 6. The industry has installed digital temperature and analytical pressure sensors, however, sensor to measure the concentration of CO is handy. 7. The industry has made provision to dispose the waste water generated along with oil in the carbon powder room. 8. The industry has provided stack of adequate height with the APCD along with sampling facility. 9. The industry has provided flare with adequate stack height. 10. The industry has provided flare room at the farthest place. 11. The industry has planted trees along the boundary. 12. The compliance of SoP is attached. 13. The industry failed to produce any record regarding procurement of raw material and no record submitted w.r.t. generation, transportation and disposal of carbon black. Accordingly, the industry was issued SCN with opportunity of personal hearing on 22.2.2024 wherein it was decided that: 1. The industry shall ensure to comply with SOPs/code of practice prescribed for such type of units vide notification dated 15.10.2014, issued by the Govt. of Punjab, in true letter & sprit. 2. The industry shall apply for obtaining consents to operate under the provisions of the Water Act, 1974 & Air Act, 1981 as well as apply for obtaining authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016, within 07 days. 3. Environmental Engineer, Regional Office, Bathinda shall verify the record alongwith the submission made by the partners of the industry, check the compliance of SOPs at site and process the applications/authorization applied for obtaining consents to operate under the Water Act, 1974 & Air Act, 1981 as well as HOWM Rules, 2016, on merits. Now, the industry has applied for obtaining fresh consents to operate under the Water Act, 1974 and Air Act, 1981 for production of Furnace Oil @ 6 TPD by using Butyl Rubber/Waste Rubber as raw material. The fixed assets of the industry hasdecreased from 50.13 lakhs to 49.89 lakhs as per the detail submitted by the industry as per CA certificate dated 25.5.2024. The industry has now deposited the consent fee of Rs. 18,000/- through online vide R.no. P148240324928519&P148240324928623dated 27.5.2024 under Water Act, 1974 and under Air Act, 1981, against the fixed assets of Rs. 49.98 lacs, which is adequate upto 30.09.2027. In compliance to the hearing decisions the industry has failed to apply for obtaining authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 as well as consents to operate under the provisions of the Water Act, 1974 & Air Act, 1981. The industry was visited on 17.5.2024 and observed that: 1. The industry was not in operation however the condition showed that the industry is being operated. 2. The industry has installed wet scrubber. The APCD was not in line with the reactor as the APCD was found disconnected from the stack. 3. No carbon was found in the storage section to be filled in the bags however raw material i.e. used tyers were available at site. 4. The industry has made room type enclosure for the storage of carbon powder and provided pneumatic/screw system for filling this carbon into bags. 5. The industry has installed digital temperature and analytical pressure sensors, however, sensor to measure the concentration of CO is handy. 6. The industry has made provision to dispose the waste water generated along with oil in the carbon powder room. 7. The industry has provided flare with adequate stack height.The industry has provided flare room at the farthest place. 8. The industry has planted trees along the boundary. 9. The compliance of SoP is attached. 10. The industry failed to produce any record regarding procurement of raw material and no record submitted w.r.t. generation, transportation and disposal of carbon black. In view of above, it is recommended that CTO applied by the industry may be refused and action u/s 31- A of Air Act, 1981 and 33- A of Water Act, 1974 may be initiated against the industry.
