The project proponent has earlier obtained consent to establish/NOC for the establishment of residential colony in an area of 25.008 acres through online on OCMMS for plots (206), commercial plots (26), EWS Plots (55) & Hotel (1 no.), vide no. CTE/Fresh/BTI/2022/19608068 dated 3.11.2022 valid upto 2.11.2023 with conditions that:
1. The Consent to Establish (NOC) is being granted for the development of the residential colony in area of 25.008 acres at Dabwali Road, Bathinda.
2. The project proponent will install the STP simultaneously with the development of the colony and will ensure to develop the land under plantation as per the proposal submitted by it.
3. The project proponent will not make any expansion in the land area without intimation /prior permission of the Board and shall ensure to keep the built-up area < 1,50,000sqm.
4. The PP will not use any fresh water in the green area/ plantation developed inside the project premises and will make adequate arrangements to reuse the treated effluent for flushing purposes and / or for watering of green areas in the project premises.
5. The project proponent will ensure that the municipal solid waste generated from its colony is handled in an environmentally sound manner and the Bio degradable solid waste shall be managed through in-house treatment, in compliance to the Solid Waste Management Rules, 2016.
6. This consent to establish is issued from pollution angle and the project proponent shall obtain the statutory clearances / permissions from the other concerned departments, as required.
Thereafter the PP was issued SCN for violation of the provisions of Water Act, 1974 & Air Act, 1981 with opportunity of personal hearing before the Chief Environmental Engineer (B) of the Board on 12.06.2024 wherein it was decided as under:
1. The project proponent will install the STP of adequate capacity alongwith adequate disposal arrangement well before the commissioning of the project. The project proponent shall ensure the propionate installation of STP with the development of the project.
2. The project proponent shall ensure to manage the wet solid waste through in-house management in compliance to the Solid Waste Management Rules, 2016.
3. Environmental Engineer, Regional Office, Bathinda shall visit the colony and process the application to be applied by the project proponent for obtaining extension in validity of 'consent to establish' (NOC) under the Water Act, 1974 & Air Act, 1981, on merit
The PP has now applied for the extenion in the validity of the CTE as the project has not yet completed within the 1 year span of the CTE granted to it.
The PP has already obtained CLU for the said land of 25.008 acres from the department of Local Government, Punjab vide letter no. PB/CLU/BTI/BATHI/1167 dated 20.12.2021. As per the classification mentioned in the CLU letter, the site falls in residential area as per notified master plan, Bathinda.
The PP has submitted the copy of approved layout plan.
The PP has submitted acknowledgement of registration of firms on the name of M/s Banson Estates issued by Registrar of Firms & Societies, Punjab dated 16.09.2019.
The PP has submitted feasibility report for the control of Water Pollution by installing Septic Tank for residential houses upto 20 no.
The PP has proposed sewage treatment plant for the treatment of domestic effluent for residential colony of capacity 150 KLD consists of Equalization Tank Grease Oil Chamber M.B.B.R. (Reactor) Secondary Settler Multi Grade Filter Activated Carbon Filter C.C.T. (Chlorination Chamber) Disposal into Sewer / use for Horticulture.
The PP has proposed to utilize treated water for Green Parks (6054.52 sq yds) & road side plantation (0.3 acres) within the project. The reuse line in household will be provided to utilize the effluent for gardening purpose. The total land area green area will be 1.55 Acres within the project. The PP has already submitted lease deed for the additional land bearing khasra nos. 5707, 4026min (17 kanals) which will be used for plantation on karnal technology.
The project proponent has deposited NOC fee of Rs. 24000/- through online vide R.No. 783392071 dated 11.06.2024 against the proposed project cost of Rs. 1839.22 lacs, which is adequate for 2 years i.e. 2.11.2025.
The site of the PP was visited by AEE of this office on 21.06.2022 and it was observed as under: -
1. The project proponent has started the development work at the site and as per the rep available approx. 80- 90 % of the development work has been completed at site.
2. 2. No occupancy has been started at the project and approx. 9 no. houses are under construction.
3. The PP is yet to provide septic tank/ STP for treatment of the proposed effluent.
4. Thee PP is yet to develop the compost pits for the management of the solid waste.
Keeping in view of above it is recommended that validity of the Consent to establish/NOC may be extended to the project proponent for the establishment of residential colony in an area of 25.008 acres for plots (206), commercial plots (26), EWS Plots (55) & Hotel (1 no.), with validity upto 2.11.2025 with usual conditions.
