It is submitted that the Project Proponent had earlier applied for obtaining Consent to Establish (NOC) of the Board on 23.02.2024 from pollution angle for setting up of residential colony for Residential Plot @ 88 no., commercial shops @ 10 no. in land area of 44 kanals 17 marlas (27,134 square yards) under orange category for discharge of treated domestic effluent @ 60 KLD. From the perusal of the documents submitted by the project proponent, it has been observed that:
1. Copy of CLU obtained from the Competent Authority for development of the colony not submitted.
2. Copy of license obtained from the Competent Authority not submitted.
3. The project proponent has proposed discharge of treated effluent onto land for plantation, however proper layout plan alongwith khasra nos. of the said plantation area not submitted.
4. ETP proposed of capacity 60 KLD, considering 5 persons/plot, however as per the Department of Housing and Urban Development notification issued vide no. G.S.R. 144/P.A.11/1995/Ss.180 and 43/2021 dated 31.08.2021 circulated by the Board vide Head Office letter no. 15864-82 dated 22.07.2022, it has been specified that the population of plotted development shall be counted @ 15 persons per plot, hence the calculation of water pollution load as well as the disposal arrangements proposed by the project proponent are not adequate.
In view of above, the project proponent has been issued show cause notice before refusal of 'Consent to Establish' (NOC) under the provisions of the Water Act, 1974 & Air I Act, 1981 with an opportunity of personal hearing before the Senior Environmental Engineer on 27.03.2024.
During hearing, Sh. Vinod Goyal, Consultant attended the hearing and requested for some time to provide adequate calculation of water pollution load as well disposal arrangement and also to submit the copy of license issued by the Competent Authority for development of the residential colony.
After hearing the representative of the colony as well as officer of the Board, it had been decided by the Senior Environmental Engineer (B) that:
1. The project proponent will submit all the requisite documents alongwith proper calculation of water pollution load as well as disposal arrangements to the Regional Office, Faridkot of the Board, within 03 days.
2. Environmental Engineer, Regional Office, Faridkot shall verify the documents submitted by the project proponent and process the application applied for obtaining 'consent to establish' (NOC) under the provisions of the Water Act, 1974 & Air Act, 1981, on merits.
But, the Project Proponent has failed to comply with the hearing decisions. Therefore, application of the Project Proponent was refused vide no. CTE/Fresh/MOG/2024/24425450 dated 09.04.2024.
Now, the Project Proponent has again applied for obtaining Consent to Establish (NOC) of the Board from pollution angle for setting up of residential colony for development of Residential Plot @ 88 no., commercial shops @ 10 no. in land area of 44 kanals 17 marlas (27,134 square yards) with 15 persons / plot under orange category for discharge of treated domestic effluent @ 160 KLD, detail of the case is as under:-
• The Project Proponent has submitted copy of license to develop colony vide no. 05/2024 issued by GLADA, Ludhiana.
• The project proponent has submitted copy of approved building plan vide no. 823STP(L)/LA-23 dated 30.06.2023 issued by STP, Ludhiana for setting up residential colony in land area of 44 kanals 17 marlas (27,134 square yards) on the name of M/s Divya Enclave through promoter company M/s Divya Real Estate.
• The Project proponent has submitted copy of project report, showing total project cost will be 3.50 crore. Accordingly, the project proponent has deposited NOC fee of Rs. 10800/- vide UTR / Ref. No. N322232743907548 dated 18.11.2023, which is adequate for one year.
• The project proponent has submitted copy of amended feasibility report of STP with propose 15 persons per plot to be installed for the treatment of domestic effluent generated within the premises of the colony from M/s Alliance Consultants, 7812/5, Passi Road, Patiala consisting of bar screen > collection tank > primary clarifier > aeration tank > Treated waste water collection tank > activated carbon & pressure sand depth filters > Micro Filteration > UV Treatment > sludge drying beds, which seems adequate. As per feasibility report, domestic effluent will be generated @ 160 KLD. It will partially disposal of treated domestic effluent @ 20 KLD onto land under park / green area within the colony measuring 4000 M2 (approx 1 acre).
• Now, the Project Proponent has added to develop plantation in an area of 7 kanals 16 marlas bearing khasra no. 86//1/2/1(0-9), 86//2/1(3-14), 86//3/1(3-13) registration no. No. 2023-24/135/1/1710 (for 2 kanals land area) & 2023-24/135/1/1711 (for 5 kanals 16 marlas land area) dated 7/2/2024 on the name of M/s Divya Real estate Pvt. Ltd. as per Karnal Technology for utilization of treated domestic effluent @ 90 KLD, which seems adequate. The location of said land is adjoining to the premises of proposed colony and Project Proponent has proposed to laid underground pipeline for carrying treated domestic effluent onto said land. Further, treated domestic effluent @ 55 KLD will be reuse for dual plumbing.
• The project proponent has submitted copy of revenue record such registry of land, approved map.
• The project proponent has submitted copy of partnership deed executed on 30.05.2022 among its 04 no. partners (Sh. Kewal Krishan, Sh. Bal Krishan, Sh. Balwinder Kumar Garg and Sh. Lalit Kumar Garg).
• The project proponent has proposed to handling of wet waste through Converted into manure using Mechanical composter. Same manure to be used for horticulture purposes. Dry waste to be disposed to authorized recycler as per SWM rules, 2016.
As per approved building plan submitted by the project proponent, the total saleable area of the project is 14297.53 Sq yard (11954.55 sq meter), which is below 1,50,000 sq meter. hence project does not include in the EIA notification.
The site of the project proponent was already visited by the AEE of this office on 04.03.2024 and it was observed that the construction work of boundary wall was in progress. There is no MAH unit within the 250 mtrs from the boundary of the project. There is no brick kiln, cement plant, saila plant, rice sheller, stone crusher, grinding unit or hot mix plant within 100 mtrs of the site. As such, the site is suitable for the establishment of commercial project.
Keeping in view of above, it is recommended that Consent to Establish (NOC) may be granted to the Project Proponent for setting up of residential colony for Residential Plot @ 88 no., commercial shops @ 10 no. in land area of 44 kanals 17 marlas (27,134 square yards) under orange category for discharge of treated domestic effluent @ 60 KLD with suitable conditions along with specific conditions as under:
1. The project proponent shall be bound to obtain environmental clearance under EIA notification dated 14.09.2006 in case the built up area of the project increase above 1,50,000 sq. meters.
2. The Project Proponent shall obtain other statutory approvals required from other departments, if any.
3. The project proponent shall install STP for treatment of its domestic effluent before its commissioning.
4. The Project Proponent will obtain permission from local authorities for disposal of sewage to be discharged into MC sewer, if applicable.
5. The project proponent shall develop adequate plantation area for scientific discharge of treated waste water.
6. The project proponent will handle its solid waste as per the provisions of the Solid Waste Management Rules, 2016 and make adequate arrangements for treatment of wet waste and source of generation.
7. The project proponent shall ensure that there is no stocking, distribution, sale or use of Single Use Plastic items in its premises as notified by MoEF&CC, Govt. of India vide its notification dated 12.08.2021.
