Sir, the amended agenda is as under:
Recommendations:
It is intimated that the industry is large scale orange category unit was granted consent to operate under the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOW/Varied/FGS/2023/21284461 dated 01/05/2023 valid upto 26/10/2023 and CTOA/Varied/FGS/2023/21284448 dated 04/05/2023 valid upto 31/12/2023 for the manufacturing of Round, Bars, Flats etc. @ 18 TPH Ingot, Billets @ 84 MT/Day.
Now, the industry has applied for varied consent to operate under the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 with requisite documents. The industry has now using PNG as fuel in our reverberatory furnace.
As per the record file, the fee deposited by the industry is adequate upto 31/12/2029 and Rs. 6000/- in excess is lying pending with the Board under the Water (Prevention & Control of Pollution) Act, 1974 and upto 31/12/2028 Rs. 24600/- in excess is lying pending with the Board under the Air (Prevention & Control of Pollution) Act, 1981 against the un-depreciated of fixed assets of Rs. 4452.54 Lacs.
Now, the industry has submitted the CA certificate dated 25/05/2024, wherein, the total value of fixed assets of the industry is Rs. 5064.17 Lakhs. The industry has deposited the NOC regularization fee of Rs. 18,000/- via receipt no. 441900813 dated 28/05/2024 due to an increase in fixed assets. After adjusting the NOC Regularization fee and deducting 25% penalty under the both acts, the consent fee is adequate up to 29/02/2028 under the both the acts as per the Board’s Office Order dated 29/10/2018.
To verify the contents of the application the industry was visited by AEE of this office on 21/06/2024. During visit, it was observed as under:
1. The industry was in operation during the visit.
2. The industry is engaging in the manufacturing of Round, Bars, Flats etc. @ 18 TPH or Ingots, Billets @ 84 MTD by using Ingots, Billets etc. @ 20 TPH or Melting Scrap @ 92 MTD.
3. The industry has installed induction furnace of capacity 7 TPH using bag filter house as APCD which was also in operation.
4. The industry has installed energy meter on its APCD and its reading was 33982.7.
5. The industry has installed reverberatory furnace and now using PNG as fuel.
6. The industry has submitted the completion certificate induction furnace of capacity 07 TPH vide no. PSCST/TFD/225 dated 29/06/2022.
7. The industry has installed 2 no. D.G sets of capacity 125 KVA & 40 KVA, which is equipped with canopies and adequate stack heights.
8. The industry has provided cooling towers for cooling of water and the entire cooling water is being recycled.
9. The industry is maintaining record of SOPs framed for operation and maintenance of APCD.
10. The industry has stabilized movement area on front side of the unit and was advised to provide complete pavement of roads wherever vehicle movement has to take place for suppression of dust.
11. No water is used in the process, so no trade effluent is generated. Domestic effluent is discharged onto land for plantation after passing through septic tank.
Moreover, the Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under:
"The Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries."
PWRDA vide notification dated 27.01.2023 has exempted units from obtaining any permission of the authority, which are extracting not more than 300 cubic meters of ground water per month.
In the subject cited case, the industry has mentioned ground water extraction @ 36 KLD. Considering 30 working days per month, ground water extraction will be 1080 KL/month, which is more than 300 KL/month. The industry not applied for obtained permission from PWRDA.
In view of above mentioned facts, if approved, it is recommended that varied 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 for production of Round, Bars, Flats etc. @ 18 TPH or Ingots, Billets @ 84 MTD may be granted to the industry upto 30/09/2027 with suitable conditions and following special conditions:
1. The industry shall submit the permission regarding ground water abstraction from Punjab Water Regulation and Development Authority (PWRDA) within one month.
2. The industry shall be liable to comply with the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
3. The industry shall comply with the guidelines/SOPs provided by PSCST, Chandigarh in the effective operation of APCD.
4. The industry shall not generate and discharge any kind of trade effluent.
5. The industry shall keep a qualified person to handle the operation and maintenance of the APCD.
