It is submitted that the clinic has granted authorization under Bio-Medical Waste Management Rules, 2016 vide no. BMW/Fresh/HSP/2022/19229263 for forever for only 01 No. dental chair, subject to the conditions mentioned therein.
Earlier the clinic was granted consent tooperate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, which were expired on 31.03.2024
Now, the clinic has applied for consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 along with requisite documents. The clinic has deposited Rs. 17500/- vide UTR No. PUNBC22194009186 dated 13.07.2022 under Water Act, 1974 and Air Act, 1981. The fee deposited by the clinic is adequate upto 30.09.2024 under both Acts.
As per the new Bio Medical Waste Management Rules, 2016, the HCFs are not required to deposit authorization fees w.e.f. the date of issuance of the said rules i.e. 28.03.2016. The HCF has entered into an agreement with M/s CBWTF. No action is pending against the HCE under the Bio-Medical Waste Management Rules, 2016. The HCF has provided 01 dental chair. It is pertinent to mention here that a meeting of Core Committee was taken by the Hon’ble Chairman, PPCB on 19.03.2018 in the Committee Room, Head Office, Patiala and proceedings of the same have been received in this office through e-mail. In the said meeting, with regard to grant of authorization under BMW Rules, 2016 to the HCEs, it was decided as under: i) The Healthcare facilities upto 20 beds/ dental chairs, the documents to be obtained for getting authorization under the BMW Rules should be bare minimum i.e. location plan, agreement with CBWTF, self-declaration (To be specified by PPCB), copy of last month's manifests etc. ii) The fresh/renewal applications of HCFs' be processed online within one week without any prior inspection subject to submission of requisite documents by the HCFs'. The Regional Office will also ensure that no action regarding violation of the provisions of BMW Rules is pending against the HCF. Further, in 3rd Core Committee Meeting held on 25.09.2019, the competent authority has decided to consider all the dental HCFs having one dental chair as non bedded facilities subject to the condition that they have to submit an undertaking to the effect that “They are not having any facility to admit and keep the patient for a day under observation.
Keeping in view of above, if approved, it is recommended that consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the clinic for the period upto 30.09.2024 with suitable conditions and specific conditions as under: -
1. This consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 is valid till HCF remains single chaired facility.
2. The Clinic shall not any expansion in the existing premises without prior permission of the Board.
3. The Clinic shall comply with all the guidelines issued by issued by PPCB/CPCB from time to time.
