It is intimated that the industry is small scale green category unit. The industry has applied for NOC for under Water Act, 1974 & Air Act, 1981 alongwith requisite documents for manufacturing of product Moduler Kitchen @ 240 Number/Year, Wardrobe @ 480 Number/Year. The industry has deposited Rs. 8400/- vide UTR no. 995949334 dated 21.06.2024 against the project cost of Rs. 220 Lacs which is adequate for one year.
On perusal of the project report submitted by the industry, the project proponent has submitted following proposals :-
1. The industry has porposed to install only non polluting machinery in its premises.
The industry has also proposed to install 1 no. D.G set of capacity 125 KVA.
2. The Domestic effluent shall be discharged onto land for plantation through septic tank.
Accordingly, the site of the project was visited by the AEE of this office on 26.06.2024 and it was observed that :-
1. The boundary wall has been completed.
2. Construction of shed has not been started yet.
3. No Machinery has arrived at site.
Applicability of 1st schedule of Factory Act, 1948 & EIA notification dated 14.09.2006 :-
• The industry does not attract the provisions of EIA notification dated 14.09.2006, as such, the industry is not required to obtain environmental clearance under the EIA notification dated 14.09.2006.
• The Govt. of Punjab, Department of Labour (Directorate of Factories Wing) vide Endst. No. 7346-59 dated 27.08.2013 has decided that the factories located/ to be set up in the designated/approved areas such as Industrial Area/ Industrial Estate/ Industrial Focal Point/ Approved Industrial Park/ Industrial Zone of the Master Plan/ Draft Master Plan are exempted for clearance of site from SCA-cum-SAC. The industry is located in designated industrial zone i.e Industrial area –C.
Keeping in view of above, it is recommended that :-
A The project proponent may be granted Consent to establish (NOC) under the provisions of the Water Act, 1974 & the Air Act, 1981 may be granted for one year with appropriate conditions, please.
B A copy of the said NOC alongwith undertaking and location plan of the industry clearly indicating the category of industry (red/orange/green) would be sent to the concerned District Town Planner of the Department of Town & Country Planning, Punjab / Local Body / Development Authority (also an intimation in this regard will be sent through e-mail) with the request to intimate the applicant (project proponent) under intimation to the Punjab Pollution Control Board within 15 days, if the said authority has any objection to the location of the project at proposed site.
C In case no reply is received from the aforesaid Authority within 15 days, then, it would be presumed that the proposed site is suitable for the project from the point of view of above referred Competent Authority.
D However, in case of any objection to the location of the project by the above referred Competent Authority or if any of the undertakings or documents are found wrong, the NOC granted to the project would be deemed to have been cancelled and the Board would not be responsible for the cost incurred by the project proponent on the basis of the said NOC. In addition, a condition would be imposed to the effect that in case any change/ amendment in the draft Master Plan are required, then the continuance of the project would be subject to such changes / amendments in the draft Master Plan by the Competent Authority.
