Deepak Gupta, Consultant The officers of the Board brought out that the project proponent has applied for obtaining fresh consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for establishment of residential project consisting of 284 residential plots alongwith requisite documents. The site of the proposed project was visited by officer of the Board on 5/3/2024 and it was observed as under: 1) The project proponent has proposed to construct 284 residential plots. 2) The project proponent has demarcated its site with flag pools. 3) The project proponent is laying the roads. Laying down of sewerage network was under progress. No construction activity by any plot owner has started. 4) As per notified master plan of Kharar, the site is located in the residential zone. 5) As per the boundary limits of the site shown by the representative of the promoter company during the visit, there is no operational approved existing MAH industry within a radius of 250 m from the boundary of the proposed site of the project. There is no operational approved existing air polluting industry falls within a radius of 100 m from the boundary of the project. The total water requirement for the proposed project @ 192 KLD. Wastewater generation @ 154 KLD, out of which @ 64 KLD will be reused in flushing purpose, @ 10 KLD will be discharged onto land for plantation and remaining @ 80 KLD will be evaporated in mechanical evaporator (in summer season). Further, Regional Office reported that during winter & rainy season, the project proponent needs to upgrade the capacity of evaporator according to excess treated wastewater, which is not acceptable. The project was approved by the MC under affordable scheme and the number of persons per plot are taken as 5. Therefore, the water demand and wastewater generation is recalculated as under: No. of Plots Persons taken per plot Total population on Season Fresh water demand Waste- water generation Utilization of treated wastewater Flushing Plantation/ green area Evaporator 284 5 1420 Summer 192 KLD 154 KLD 64 KLD 37 KLD 53 KLD Winter 192 KLD 154 KLD 64 KLD 30 KLD 60 KLD Rainy 192 KLD 154 KLD 64 KLD 28 KLD 62 KLD A clarification was raised to the project proponent on 20/5/2024 to submit reply of the the following observations: 1) Revised conceptual / approved layout plan earmarking the location of electric evaporator. 2) Whether the proposal of PP to mechanically evaporate 60 KLD is economically viable. Provide supporting documents in this regard. 3) Whether cost of all these proposals added in cost of total project cost. If not, please incorporate the same in the total project cost. But, the project proponent has failed to submit the reply of above clarification within the stipulated period given to it. The project proponent is not complying with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 and also failed to give the reply of clarification raised by Regional Office, SAS Nagar. Thus, the application of the project proponent cannot be considered at this stage. It was proposed to refuse the consent to establish (NOC) applied under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, after affording an opportunity of show cause-cum-personal hearing. Thereafter, the project proponent was served SCN notice for refusal of consent to establish (NOC) from pollution angle under the provisions of the the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 vide Board's letter no. 1219-20 dated 31/5/2024 dated alongwith an opportunity of personal hearing before the Chief Environmental Engineer (P) of the Board on 12/6/2024. But, neither any representative of the project proponent attended the hearing nor submitted any reply/ communication in the matter. The matter was considered by the Competent Authority and decided to give another opportunity of personal hearing to the project proponent before taking further action in the matter. Therefore, the project proponent was given another opportunity of personal hearing vide Board's letter no. 1404-05 dated 14/6/2024 before the Chief Environmental Engineer (P) of the Board on 26/6/2024. The representative of the project proponent attended the hearing and submitted written reply which was taken on record. He informed that treated wastewater will be used for flushing purposes, plantation purposes and remaining into sewer. The treated wastewater will be discharged into sewer only after obtaining permission from MC and keeping in view the capacity of the terminal STP. But, if the capacity of the terminal STP will not be adequate or permission may not be granted for discharge treated wastewater into sewer, only then electric evaporator of adequate capacity will be installed to handle the treated wastewater. He further undertaken that the project proponent will reserve the sufficient land for installation of evaporator at the project site and same will be earmarked in the approved layout plan of the project. He requested to consider our reply and grant NOC with the above mentioned proposal. After hearing the officers of the Board and the representative of the project proponent, the Chief Environmental Engineer (P) of the Board decided that the project proponent shall be granted NOC applied under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 subject to suitable conditions and additional conditions that: (a) The project proponent shall reuse treated wastewater @ 64 KLD for flushing purposes, @ 10 KLD onto land for plantation and remaining 80 KLD into sewer after obtaining permission from the MC. In case, the capacity terminal STP may not be adequate or permission by the MC to discharge treated wastewater into sewer may not be granted only then project proponent shall install electric evaporator of adequate capacity to handle the treated wastewater @ 80 KLD. (b) The project proponent shall get earmark the land for installation of electric evaporator in the approved layout plan and submit the same to the Board within 2 months. (c) The project proponent shall not use land reserved for installation of electric evaporator for any other purpose under any circumstances without obtaining prior permission from the Board. If approved, proceedings of the personal hearing as above may be conveyed to the project proponent and Environmental Engineer, PPCB, RO, SAS Nagar for compliance and sending the report, respectively.
