Sir, in this case, there were a lot of complaints of black smoke specifically from NIT Jalandhar. Later on, proceedings u/s 31-A of the Air Act 1981 were initiated and consent was revoked. A Bank Guarantee of Rs. 50,000 was en-cashed.
Later on in compliance of the decisions of hearing given u/s 31-A of the Air Act 1981 by the CEE, Jalandhar, the industry has submitted fresh Bank Guarantee of Rs. 50,000 and installed CCTV cameras.
However, last complaint was received on 03.04.2024 but the industry was not found in operation. Again on 18.06.2024, the industry was found not in operation.
Regional Office has reported that industry is complying with code of practice and installed Air pollution control devices but commented that the adequacy/efficiency of the APCD will be checked as and when the HMP will re-start its operations. Regional Office/EE ZO has recommended for long term consent upto year 2029.
It is observed that the HMP was established in April 1998 that is before the guidelines issued by the board for Hot Mix Plants. The industry has not submitted any document to prove that it is not in non-confirmatory zone or fulfills the siting guidelines of the Board for such units. Moreover, it is not established as to whether the industry has taken adequate measure to control the black smoke for which regular complaints were received in past from the prestigious institute (NIT, Jalandhar). Due to election code of conduct, new projects are not being carried out and due to Monsoon season, HMP is not likely to re-start in coming months. Therefore, actual performance of pollution control arrangement can not be adjudged at this stage. Due to above reasons, long-term consent can not be granted at this stage
Therefore, it is proposed that the consent to operate shall be granted upto 30.06.2025 with following stipulations:
1. The industry will inform the Board(through Regional Office-1, Jalandhar) atleast15 days before the restart of plant so as to check the adequacy of pollution control arrangements.
2. The industry shall submit the documents from the competent authority to prove that industry is in confirmatory zone as per the provision of Master Plan Jalandhar and is fulfilling the siting guidelines of the Board before its case shall be considered for renewal/further extension.
3.The industry shall deposit requisite sample testing fee for stack monitoring, within 15 days with the regional office-1, Jalandhar.
4. Regional Office-1, Jalandhar, on the re-start of industry shall make surprise check and collect stack emission samples to check the adequacy of pollution control arrangements and send further recommendation accordingly.
5.Conditions as recommended by RO and EE ZO
Sir, Im promoted as CEE and is under posting. Further more proceeding u/s 31-A of Air Act 1981 are still pending. Therefore, before grant of consent, concurrence of your self is required, please.
