File Note: The Regional Office has submitted report in lieu to the application filed by the project proponent. After perusal of the report sent by RO and the application filed by the project proponent, it was noted as under: • It is submitted that the industry was granted ‘Consent to Establish’ (NOC) under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/PTA/2022/19533252 dated 29/09/2022, valid upto 23/08/2023 for manufacturing of Cotton Yarn @ 17.10 Metric Tonnes/Day and Cotton Waste @ 1.52 Metric Tonnes/Day by using J34/Comber Noil/Flat@ 19 Metric Tonnes/Day as raw material under orange category subject to conditions as mentioned therein. • Now, the industry has applied for fresh consents to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Cotton Yarn @ 17.10 Metric Tonnes/Day and Cotton Waste @ 1.52 Metric Tonnes/Day by using J34/Comber Noil/Flat@ 19 Metric Tonnes/Day as raw material under orange category along with requisite documents. • The industry has deposited Rs. 221000/- (consent fee: Rs. 199500/-, Rs. 500/- Application form fees and NOC extension fee of Rs. 21000/-) vide online receipt no. 677472231 dated 31/05/2024 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 210500/- (consent fee : Rs. 210000/- as air consent fee and Rs. 500/- Application form fees) vide online receipt no. 278048706 dated 31/05/2024. The RO has calculated that the consent fee deposited by the industry is adequate upto 31.03.2029 against the fixed assets of Rs. 3438.66 lakh as on 24.05.2024 as per CA certificate dated 25.05.2024 submitted by it. • The industry has submitted certificate of Principal Approval from Invest Punjab dated 13.09.2022, valid upto 12.03.2026 and as per the certificate the service includes issuance of approval of factory building plan. • The industry was visited by the officer of Regional Office on 08.06.2024 and observed that: 1. The industry was in operation. 2. The industry has 7 no. open end machines, 7 no. cards, 4 no. draw frames, 1 Blow Room, 1 humidification plant and 4 rotary filter to control the fluff emissions. 3. There is no source of trade effluent generation. 4. The water is used for humidification in the process. 5. The domestic waste water generated from the premises is being treated in a septic tank and the overflow of this septic tank is pumped in the plantation area approximately. 6. Four no. rotary air filters are installed by the industry to control fluff emissions generated by the industry, which is adequate. 7. Cotton waste generated by the industry is being sold to the processors of cotton waste plant and the traders also. 8. The industry is complying with the conditions of consent to establish granted to it under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. • The RO has recommended that the varied consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry upto 30.09.2028 for manufacturing of Cotton Yarn @ 17.10 Metric Tonnes/Day and Cotton Waste @ 1.52 Metric Tonnes/Day by using J34/Comber Noil/Flat@ 19 Metric Tonnes/Day as raw material under orange category subject to suitable conditions and special conditions that: 1. The industry shall shift its unit if the site of the industry comes under non conforming zone of master plan to be prepared by the authority concerned. 2. The adequacy & efficacy of the sewage treatment facilities as well as arrangements for disposal of treated wastewater onto land for plantation / irrigation will be the entire responsibility of the industry. 3. The industry shall re-circulate the entire water of humidification plant. 4. The industry shall not discharge any effluent (treated or untreated) into any drain or in inland surface water at anytime or any other unauthorized place by any unauthorized means and will discharge its treated effluent onto land for plantation only. 5. The entire cooling water used by the industry shall be re-circulated into the processes of the industry. No cooling water will be discharged by the industry. 6. The industry shall for the purpose of measuring and recording the quantity of water consumed and effluent is charged, affix electromagnetic flow meters of such standards and at such places as approved by the Environmental Engineer, Punjab Pollution Control Board, Regional Office, Patiala. 7. The industry shall not generate and discharge any trade effluent without the prior written permission of the Board. 8. The industry shall conduct the Environment audit and submit audit report to the Board every year as required under Environment (Protection) Act, 1986. 9. The industry shall obtain permission from PWRDA for the abstraction of ground water as per latest guidelines of the Govt. Additionally, it is brought out that the industry has attached building plan approved by Er. Jasvir Singh, Competent Person approved under Punjab Factory Act, 1948, vide Addendum dated 21.06.2024 alongwith the application filed under the Water Act, 1974 on IP-BF portal. In consideration of the recommendations sent by RO; if approved, the industry may be granted Consent to Operate under the Water Act, 1984 & the Air Act, 1981 for manufacturing of Cotton Yarn @ 17.10 Metric Tonnes/Day and Cotton Waste @ 1.52 Metric Tonnes/Day by using J34/Comber Noil/Flat@ 19 Metric Tonnes/Day as raw material, upto 31.03.2029, subject to suitable conditions and the following additional conditions: Conditions proposed for Consent to Operate under Air Act, 1981: 1. The industry will not carry out any of the following activities without permission of the Board- a. Increase in production capacity beyond capacity consented by the Board i.e. for manufacturing of Cotton Yarn @ 17.10 Metric Tonnes/Day and Cotton Waste @ 1.52 Metric Tonnes/Day by using J34/Comber Noil/Flat@ 19 Metric Tonnes/Day as raw material. b. Addition in land and building. c. Addition of any other machinery apart from which consent is being granted. d. Increase in connected load/ contract demand from PSPCL. 2. The industry shall install manual AAQM stations one in upwind direction & one in downwind direction of its boundary before 30.09.2024 and carry out regular monitoring of Ambient Air Quality through the said stations & the data regarding the same shall be made available to the visiting officer of the Board, without fail. 3. The industry will comply with zoning regulations of HUD/ Department of Town & Country Planning/ Local Government and shall bound to comply with the bye-laws of the Master Plan already prepared/ to be prepared by the Department of Town and Country Planning, Punjab. 4. The industry shall make use of alternatives of single use plastics (SUP) within its premises and will not use any SUP items banned in accordance with MoEF&CC notification no. G.S.R. 571(E) dated 12.08.2021. 5. The industry shall not carry out any activity/ process at its site, which can change its category from ORANGE to RED, under any circumstances. 6. The industry shall not install any DG set and/or any boiler/ furnace or any other source of air pollution within its premises without the prior written permission of the Board. 7. The industry will maintain noise levels outside the room well within the permissible limits as laid down by the Board/CPCB/MoEF&CC. 8. The industry shall ensure that ambient air quality within the processing shed is confirming to the standards laid down by MoEF&CC/CPCB/PPCB, at all the times. 9. The industry shall carry out management and handling of solid waste, which is to be generated from the premises of the industrial unit, as per the provisions of the Solid Waste Management Rules, 2016. 10. The industry shall ensure that the activities of unit does not create any nuisance in the surrounding areas and no public complaints are received. In case, any complaint is received against the unit, the Board shall be at liberty to revoke/ cancel this consent without giving any opportunity of hearing to the industry. 11. The ‘consent to operate’ is being issued to the industry based upon the documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing. 12. In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent. Conditions proposed for Consent to Operate under Water Act, 1974: 1. The industry will not carry out any of the following activities without permission of the Board- a. Increase in production capacity beyond capacity consented by the Board i.e. for manufacturing of Cotton Yarn @ 17.10 Metric Tonnes/Day and Cotton Waste @ 1.52 Metric Tonnes/Day by using J34/Comber Noil/Flat@ 19 Metric Tonnes/Day as raw material. b. Addition in land and building. c. Addition of any other machinery apart from which consent is being granted. d. Increase in connected load/ contract demand from PSPCL. 2. The industry shall obtain permission from PWRDA for abstraction of ground water within three months and shall comply with the guidelines issued by PWRDA from time to time. 3. The industry will comply with zoning regulations of HUD/ Department of Town & Country Planning/ Local Government and shall bound to comply with the bye-laws of the Master Plan already prepared/ to be prepared by the Department of Town and Country Planning, Punjab. 4. The industry shall make use of alternatives of single use plastics (SUP) within its premises and will not use any SUP items banned in accordance with MoEF&CC notification no. G.S.R. 571(E) dated 12.08.2021. 5. The industry shall not carry out any activity/ process at its site, which can change its category from ORANGE to RED, under any circumstances. 6. The industry shall not generate and discharge any kind of trade effluent from its unit and shall not start any wet process in its premises without prior written permission of the Board. 7. The industry shall only discharge only domestic effluent onto land for plantation within its premises, after passing through septic tank. 8. The industry shall keep the plantation/ green area (developed within premises) in good conditions, at all times and shall not allow the treated effluent to stagnate there. 9. The industry shall not discharge any effluent outside its premises, at any point of time, under any circumstances. 10. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances. 11. The industry shall re-circulate the entire water of humidification plant and the purge water from the humidification plant (if any) shall be utilized for non-core activities after treatment through STP, only. 12. The industry shall ensure that the activities of unit does not create any nuisance in the surrounding areas and no public complaints are received. In case, any complaint is received against the unit, the Board shall be at liberty to revoke/ cancel this consent without giving any opportunity of hearing to the industry. 13. The ‘consent to operate’ is being issued to the industry based upon the documents/ information submitted by it alongwith the online application form.
