File Note: Subject: Application for obtaining varied consent to operate under the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981-M/s Shiva Alloys, Amloh Road, Village Kumbh, Mandi Gobindgarh, Distt Fatehgarh Sahib. It is intimated that the industry is medium scale orange category unit was granted consent to operate under the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOW/Varied/FGS/2022/17446338 dated 30/03/2022 and CTOA/Varied/FGS/2022/17446293 dated 30/03/2022 both are valid upto 30/09/2026 for the manufacturing of Steel Ingots @ 84 MTD. It is further intimated that the industry was issued Show Cause Notice for cancelation of consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 and notice to issue direction u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 as amended in 1987 due to non-compliance of State Fuel Policy dated 04/10/2023 before the Worthy Chairman of the Board on 12/04/2024 at Patiala and the proceeding of the same is as under: 1. The consent to operate granted to the industry under the Air (Prevention & Control of Pollution) Act, 1981 be cancelled. 2. The industry shall modify its annealing furnace to use PNG as fuel and shall apply for obtaining varied consent to operate under the Air (Prevention & Control of Pollution) Act, 1981. 3. The industry shall comply with SOPs framed by PSCST, Chandigarh to operate APCD, at all the time. 4. The industry shall use good quality scrap with proper size, as raw material at all time. 5. Environmental Engineer, Regional Office, Fatehgarh Sahib shall insure the compliance of the above said direction. Now, the industry has applied for varied consent to operate under the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 with requisite documents. The industry has installed 02 no. of annealing furnace and using PNG as fuel on both of furnaces. As per the record, the consents fee is adequate upto 30/09/2026. Now, the industry has deposited of Rs. 51000/- vide no. 173513851 dated 22/06/2024 as water consent fee and Rs. 51000/- vide no. 130652539 dated 22/06/2024 as air consent fee against the fixed assets of Rs. 1741.0 Lakhs as on 31/05/2024 as per certificate dated 17/06/2024 which is adequate upto 31/03/2028 as per office order dated 29/10/2018. The industry has deposited NOC Regularization fee of Rs. 21600/- vide no. N012242832700569 dated 12/01/2024 and Rs. 2400/- vide no. N064242915259047 dated 03/04/2024 (Total 24000/-) which is adequate. To verify the compliance of personal hearing and contents, the industry was visited by the AEE of this office on 13/06/2024 During the visit, it was observed as under: 1. The industry was in operation during the visit. 2. The industry has installed induction furnace of capacity 07 TPH and installed Bag filter house as APCD. The industry has installed 02 no. of annealing furnace using PNG as fuel. 3. The industry has installed energy meter on its APCD and its reading was 20072. 4. The industry was under installation of holding furnace of capacity 20 TPH. 5. The industry has installed online continuous emission monitoring system (OCEMS) with its stack and connect the same with server of the Board in compliance of special conditions. 6. The industry has connected the CCTV cameras with the server of the Punjab Pollution Control Board in compliance of special condition. 7. The industry has complied with the guidelines/SOPs provided by PSCST, Chandigarh in the effective operation of APCD and also maintained the record. 8. The industry has installed cooling tower for cooling of condensed water and cooling water has been recirculated. 9. The industry has installed water meter on its submersible pump and its reading was 41948.0 Kl. 10. No trade effluent will be generated in the industrial process. Domestic effluent will be discharged onto land for plantation through septic tank. 11. The industry has installed 02 no. of DG. Set of capacity 125 KVA and 320 KVA with canopy and adequate stack height. 12. The industry is using use good quality scrap with proper size, as raw material during the visit. The industry is falls under the Industrial Zone as per Master Plan of Mandi Gobindgarh. Moreover, the Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under: "The Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries." PWRDA vide notification dated 27.01.2023 has exempted units from obtaining any permission of the authority, which are extracting not more than 300 cubic meters of ground water per month. In the subject cited case, the industry has mentioned ground water extraction @ 50 KLD. Considering 30 working days per month, ground water extraction will be 1500 KL/month, which is more than 300 KL/month. The industry has not applied for obtained permission from PWRDA. In view of above, if approved it is recommended that the varied consent to operate under the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for the manufacturing of Steel Ingots @ 84 MTD may be granted upto 30/09/2027 with suitable conditions and special conditions as under: 1. The industry shall obtain necessary clearance for Abstraction of Ground Water from the Punjab Water Regulation and Development Authority (PWRDA). 2. The industry will operate & maintain its air pollution control device (APCD), regularly and efficiently, so as to achieve the stack emission standards, consistently as prescribed by the Board/ MoEF&CC as amended from time to time. 3. The industry shall ensure that no black smoke should be emitted from the stack of the industry at any time. 4. The industry will not generate and discharge any trade effluent without obtaining prior written permission of the Board. 5. The industry shall comply with the guidelines/SOPs provided by PSCST, Chandigarh in the effective operation of APCD. 6. The industry shall not dispose off its Hazardous waste to any unauthorized vendor. 7. The industry shall not use any scrap containing Hazardous waste like shockers containing waste oil.
