The HMP was granted consents to establish under the Water Act, 1974 and Air Act, 1981 CTE/Fresh/BTI/2023/22898339 dt. 7.08.2023 valid upto 6.8.2024, respectively for establishment of unit having hot mix plant, Wet mix plant and RMC plant to produce Premix (Batch Type) @ 200 TPH Ready Mix Concrete @ 100 TPH Wet Mix Macadam @ 200 TPH, subject to conditions mentioned therein along with special conditions that-
1. The 'consent to establish' is granted to the industry for its establishment in the land area of 141 Kanals 09 Marlas bearing khasra nos. 2427/1/2(7-7), 2428/2/2(7-7), 2432/2(0-4), 2433/2(0-4), 2680(8-0), 2414/2(0-6), 2412/1(4-0), 2412/2(4-0), 2413/1(4-0), 2413/2(4-0), 2414/2/1(0-2), 2407/2(3-5), 2408/1(2-4), 2415/1(3-6), 2415/2(3-6), 2415/3(1-0), 2415/4(0-8), 2416/1(2-4), 2416/2(5-16), 2417/1(1-4), 2414/1(2-6), 2414/2(5-6), 2417/2(2-12), 2420/2/(6-0), 2421(8-0), 2422(8-0), 2423(8-0), 2677(8-0), 2678/2(7- 12), 2718/2(0-16), 2417(1-6), 2418 (7-10), 2419 (8-0), 2420/1 (1-8) and 5 kanal land area from khasra no. 2581, 2682/1, 2682/2, 2712 in the revenue estate of Village Sangat Kalan, Tehsil & Distt. Bathinda as per the proposal submitted by it and in case any of the documents submitted by the industry are found wrong, the consent to establish granted to the project would be deemed to have been cancelled and the Board would not be responsible for the cost incurred by the project proponent in the matter.
2. The industry will install the machinery related to the hot mix plant in khasra no. 2428/2/2 only as per the proposal submitted by it.
3. The industry will comply with the code of practice as prescribed by the Board vide notification no. Admn./SA2/F.No.178/99/03 dt. 26.04.99 for hot mix plant.
4. The industry shall apply for obtaining consents to operate under the Water Act, 1974 & Air Act, 1981 before commissioning any of its units i.e. RMC, WMM or HMP.
5. This consent to establish is issued from pollution angle; however it does not absolve from obtaining necessary permissions/clearances from other authorities/ statutes as applicable.
Thereafter the industry has obtained Fresh CTO under the Water Act, 1974 & Air Act, 1981 through OCMMS for operation of unit having hot mix plant, Wet mix plant and RMC plant to produce Premix (Batch Type) @ 200 TPH Ready Mix Concrete @ 100 TPH Wet Mix Macadam @ 200 TPH with validity upto 30.6.2025 with conditions that:
1. The industry will operate the machinery related to the batch type hot mix plant in khasra no. 2428/2/2 only as per the proposal submitted by it.
2. The industry will comply with the code of practice as prescribed by the Board vide notification no. Admn./SA2/F.No.178/99/03 dt. 26.04.99 for hot mix plant at all times.
3. The project proponent will ensure to comply with the guidelines prescribed/to be prescribed for hot mix plant (s) by the MoEF&CC/CPCB/PPCB from time to time and will also ensure to upgrade the existing APCD's, if required.
4. The industry will get its air emission sample analyzed from the Board’s Lab/approved lab of the Board as per the policy of the Board.
5. The industry shall inform the Regional Office, Bathinda of the Board at least 15 days prior regarding schedule of its operation to so as to enable the Board to monitor the industry as per its policy.
Now the industry has applied for Varied CTO under the Water Act, 1974 & Air Act, 1981 through OCMMS for operation of unit having hot mix plant, Wet mix plant and RMC plant to produce Premix (Batch Type) @ 320 TPH Ready Mix Concrete @ 100 TPH Wet Mix Macadam @ 200 TPH by adding the additional machinery to increase the production capacity and to add the additional land adjoining to the existing plant (in an area of 141Kanals 9Marlas land bearing khasra nos. 2427/1/2(7-7), 2428/2/2(7-7), 2432/2(0-4), 2433/2(0-4), 2680(8-0), 2414/2(0-6), 2412/1(4-0), 2412/2(4-0), 2413/1(4-0), 2413/2(4-0), 2414/2/1(0-2), 2407/2(3-5), 2408/1(2-4), 2415/1(3-6), 2415/2(3-6), 2415/3(1-0), 2415/4(0-8), 2416/1(2-4), 2416/2(5-16), 2417/1(1-4), 2414/1(2-6), 2414/2(5-6). 2417/2(2-12), 2420/2/(6-0), 2421(8-0), 2422(8-0), 2423(8-0), 2677(8-0), 2678/2(7- 12), 2718/2(0-16), 2417(1-6), 2418 (7-10), 2419 (2-0), 2420/1 (1-8), 2581, 2682/1, 2682/2, 2712, ਵਿੱਚੋਂ (5 ਕਨਾਲ - 0 ਮਰਲੇ) Tehsil &Distt. Bathinda) by adding 2- kanals 11 marlas bearing khasra nos. 2429/1(9-7), 2430/1/2(1-16), 2430/2(1-10), 2430/2/1(0-7), 2431/2/2/1(2-0), 2431/2(2-10), 2431/2/1(1-11), ਅਤੇ 2431/2/2/2(1-10) of village sangat kalan for the purpose of development of Bathinda – Dabwali road as per NHAI letter no. 231 dated 26.2.2021.
The unit has submitted revised letter 17.82023 from NHAI as per which appointment date of the project is from 11.8.2023 having completion period upto 730 days.
The unit has earlier deposited the consent fee of Rs. 21,600/- each vide no. 980494957 & 513496804 dated 5.09.2023. The unit has deposited NOC regularization fees for additional assets @ Rs. 5600 vide no. 734946534 dated 12.6.2024 is adequate upto 10.8.2025, against fixed assets of Rs. 492.57 lacs as per the CA certificate.
Further, the unit has submitted copy of Land Use classification certificate vide no. 677 dated 3.06.2024 issued by DTP Bathinda regarding suitability of the site stating that:
ਉਪਰੋਕਤ ਵਿਸ਼ੇ ਸਬੰਧੀ ਹਵਾਲੇ ਅਧੀਨ ਪੋਰਟਲ ਰਾਹੀਂ ਪ੍ਰਾਪਤ ਦਸਤਾਵੇਜਾਂ ਨੂੰ ਇਸ ਦਫ਼ਤਰ ਵਿਖੇ ਵਾਚਿਆ ਗਿਆ ਹੈ। ਸਾਈਟ ਬਠਿੰਡਾ-ਡੱਬਵਾਲੀ ਮੈਨ ਸੜਕ (ਐਨ.ਐਚ-54) ਤੋਂ ਪਿੰਡ ਸੰਗਤ ਕਲਾਂ-ਮਛਾਣਾ ਲਿੰਕ ਸੜਕ ਉਪਰ ਪਿੰਡ ਸੰਗਤ ਕਲਾਂ ਵੱਲ ਜਾਂਦਿਆ ਲਗਭਗ 685 ਮੀਟਰ ਦੀ ਦੂਰੀ ਤੇ ਸੜਕ ਦੇ ਸੱਜੇ ਹੱਥ ਸਥਿਤ ਹੈ। ਪੋਰਟਲ ਰਾਹੀਂ ਪ੍ਰਾਪਤ ਰੈਵੀਨਿਊ ਰਿਕਾਰਡ ਅਨੁਸਾਰ ਵਿਸੇ ਤਹਿਤ ਸਾਈਟ ਦਾ ਰਕਬਾ 20 ਕਨਾਲ 11 ਮਰਲੇ ਹੈ, ਜੋ ਕਿ ਰੈਵੀਨਿਊ ਅਸਟੇਟ ਪਿੰਡ ਸੰਗਤ ਕਲਾਂ, ਹ.ਬ. ਨੰ. 99, ਤਹਿ, ਵਾ, ਜਿਲਾ ਬਠਿੰਡਾ ਦੇ ਖਸਰਾ ਨੰ, 2429/1(9-7), 2430/1/2(1-16), 2430/2(1-10), 2430/2/1(0-7), 2431/2/2/1(2-0), 2431/2(2-10), 2431/2/1(1-11), ਅਤੇ 2431/2/2/2(1-10) ਵਿੱਚ ਪੈਂਦੀ ਹੈ। ਵਿਸ਼ੇ ਅਧੀਨ ਸਾਈਟ ਦੇ 2 ਕਿਲੋਮੀਟਰ ਦੇ ਘੇਰੇ ਅੰਦਰ ਕਿਸੇ ਵੀ ਨਗਰ ਕੌਂਸਲ ਜਾਂ ਨਗਰ ਪੰਚਾਇਤ ਦੀ ਹੱਦ ਨਹੀਂ ਪੈਂਦੀ। ਇਸ ਤੋਂ ਇਲਾਵਾ ਸਾਈਟ ਦੇ 5 ਕਿਲੋਮੀਟਰ ਦੇ ਘੇਰੇ ਅੰਦਰ ਕਿਸੇ ਵੀ ਨਗਰ ਨਿਗਮ ਦੀ ਹੱਦ ਨਹੀਂ ਪੈਂਦੀ ਹੈ। ਸਾਈਟ ਤੋਂ ਲਗਭਗ 245 ਮੀਟਰ ਦੀ ਦੂਰੀ ਤੇ ਇੱਕ ਰਾਧਾ ਸਵਾਮੀ ਸਤਿਸੰਗ ਬਿਆਸ ਡੇਰਾ ਪੈਂਦਾ ਹੈ। ਸਾਈਟ ਨੋਟੀਫਾਈਡ ਮਾਸਟਰ ਪਲੈਨ ਰਾਮਾਂ ਮੰਡੀ ਦੇ ਪੀ.ਸੀ.ਪੀ.ਆਈ.ਆਰ ਜੋਨ ਅੰਦਰ ਪੈਂਦੀ ਹੈ। ਜਿਸ ਵਿੱਚ ਵਿਸ਼ੇ ਤਹਿਤ ਐਕਟੀਵਿਟੀ ਸਥਾਪਤ ਕਰਨਾ ਆਗਿਆਯੋਗ ਹੈ, ਬੇਸ਼ਰਤੇ ਸਾਈਟ ਪੀ.ਪੀ.ਸੀ.ਬੀ ਵੱਲੋਂ ਸਮੇਂ ਸਮੇਂ ਤੇ ਜਾਰੀ ਗਾਈਡਲਾਈਨਾਂ/ਸ਼ਰਤਾਂ ਦੀ ਪੂਰਤੀ ਕਰਦੀ ਹੋਵੇ। ਸਾਈਟ ਅੱਗੋਂ ਗੁਜਰਦੀ ਸੜਕ ਦੀ ਚੌੜਾਈ 27 ਫੁੱਟ 6 ਇੰਚ ਹੈ। ਜਿਸਨੂੰ ਨੋਟੀਫਾਈਡ ਮਾਸਟਰ ਪਲੈਨ ਰਾਮਾਂ ਮੰਡੀ ਅਨੁਸਾਰ 60 ਫੁੱਟ ਚੌੜਾ ਕਰਨਾ ਤਜਵੀਜਤ ਹੈ। ਜਿਸ ਅਨੁਸਾਰ ਆਪ ਆਪਣੀ ਸਾਈਟ ਵਿਚੋਂ 16 ਫੁੱਟ 3 ਇੰਚ ਜਗ੍ਹਾ ਰੋਡ ਵਾਈਡਨਿੰਗ ਲਈ ਖਾਲੀ ਛੱਡਣ ਦੇ ਪਾਬੰਦ ਹੋਵੋਗੇ। ਰੋਡ ਵਾਈਡਨਿੰਗ ਦੇ ਸਮੇਂ ਕਿਸੇ ਕਿਸਮ ਦੀ ਕੋਈ ਕਾਨੂੰਨੀ ਅੜ੍ਹਚਨ ਪੈਦਾ ਨਹੀਂ ਕਰੋਗੇ ਅਤੇ ਰੋਡ ਵਾਈਡਨਿੰਗ ਲਈ ਛੱਡੀ ਗਈ ਜਗ੍ਹਾ ਨੂੰ ਸਰਕਾਰ/ਰੋਡ ਅਥਾਰਟੀ (ਜੋ ਰੋਡ ਦੀ ਉਸਾਰੀ ਕਰੇਗਾ) ਨੂੰ Free of Cost ਟਰਾਂਸਫ਼ਰ ਕਰੋਗੇ। ਸਾਈਟ ਕਲਰ ਕੋਡਡ ਜੋਨਿੰਗ ਮੈਪ ਏਅਰ ਫੋਰਸ ਸਟੇਸ਼ਨ ਬਠਿੰਡਾ ਦੇ Green Zone ਵਿੱਚ ਪੈਂਦੀ ਹੈ। ਜਿਸ ਵਿੱਚ ਜੇਕਰ ਬਿਲਡਿੰਗ ਦੀ ਉਚਾਈ 353 ਮੀਟਰ AMSL ਜਾਂ ਉਸ ਤੋਂ ਘੱਟ ਹੋਵੇ ਤਾਂ ਏਅਰ ਫੋਰਸ ਸਟੇਸ਼ਨ ਬਠਿੰਡਾ ਦੇ ਐਨ.ਓ.ਸੀ ਲੈਣ ਦੀ ਜਰੂਰਤ ਨਹੀਂ ਹੈ। ਜੇਕਰ ਉਸਾਰੀ ਜਾਣ ਵਾਲੀ ਬਿਲਡਿੰਗ ਦੀ ਉਚਾਈ 353 ਮੀਟਰ AMSL ਤੋਂ ਵੱਧ ਹੋਵੇਗੀ ਤਾਂ ਆਪ Competant Authority ਤੋਂ NOC ਲੈਣ ਦੇ ਪਾਬੰਦ ਹੋਵੋਗੇ। ਆਪ ਨੋਟੀਫਾਈਡ ਮਾਸਟਰ ਪਲੈਨ ਰਾਮਾਂ ਮੰਡੀ ਦੀਆਤਜਵੀਜ਼ਾਂ ਨੂੰ ਮੰਨਣ ਦੇ ਪਾਬੰਦ ਹੋਵੋਗੇ ਅਤੇ ਇਸ ਵਿਭਾਗ ਵੱਲੋਂ ਜਾਰੀ ਨੋਟੀਫਿਕੇਸ਼ਨ ਨੰ. 18/30/09-ਐਚ.ਜੀ.2/853 ਮਿਤੀ 12-06-2023 ਅਨੁਸਾਰ ਆਪ ਕੋਈ ਵੀ ਉਸਾਰੀ ਸ਼ੁਰੂ ਕਰਨ ਤੋਂ ਪਹਿਲਾਂ ਸਾਈਟ ਦੇ ਬਿਲਡਿੰਗ ਪਲੈਨ ਸਮਰੱਥ ਅਥਾਰਟੀ ਡਾਇਰੈਕਟਰ ਫੈਕਟਰੀ ਪੰਜਾਬ ਜੀ ਪਾਸੋਂ ਪ੍ਰਵਾਨ ਕਰਵਾਉਣ ਦੇ ਪਾਬੰਦ ਹੋਵੋਗੇ ਅਤੇ ਹੋਰ ਸੰਬੰਧਤ ਵਿਭਾਗ ਪਾਸੋ ਲੋੜੀਂਦੀ ਪ੍ਰਵਾਨਗੀ/NOC ਲੈਣ ਦੇ ਵੀ ਪਾਬੰਦ ਹੋਵੋਗੇ। ਮਾਲਕੀ ਸਬੰਧੀ ਨਿਰੋਲ ਜਿੰਮੇਵਾਰੀ ਆਪ ਦੀ ਹੋਵੇਗੀ। ਇਹ ਪੱਤਰ ਕੇਵਲ ਲੈਂਡਯੂਜ਼ ਕਲਾਸੀਟਿਕੇਸ਼ਨ ਸਬੰਧੀ ਹੈ। ਇਸ ਨੂੰ ਇਸ ਦਫਤਰ ਵੱਲੋਂ ਸੀ.ਐਲ.ਯੂ/ਬਿਲਡਿੰਗ ਪਲੈਨ ਦੀ ਪ੍ਰਵਾਨਗੀ ਨਾ ਸਮਝਿਆ ਜਾਵੇ।
The industry has also attached the NaibTehsildar, Sangat report vide dated 15.04.2024 (attached along with), wherein, it has intimated regarding the various distances of the unit in Village Sangat Kalan, Tehsil Sangat, District Bathinda. As per the report, “ਤਸਦੀਕ ਕੀਤਾ ਜਾਂਦਾ ਹੈ ਕੇ ਵਿਸ਼ੇ ਅਧੀਨ ਸਾਈਟ ਪਿੰਡ ਸੰਗਤ ਕਲਾਂ ਹਦਬਸਤ ਨੰ. 99 ਤਹਿਸੀਲ ਸੰਗਤ ਜਿੱਲ੍ਹਾ ਬਠਿੰਡਾ ਦੇ ਖਸਰਾ ਨੰਬਰ 2429, 2430, 2431 ਕੁਲ ਰਕਬਾ 20 ਕਨਾਲ 11 ਮਰਲੇ ਰਕਬੇ ਵਿਚ ਹੋਤ ਮਿਕ੍ਸ ਪਲਾਂਟ ਸਥਾਪਿਤ ਕੀਤਾ ਜਾਣਾ ਹੈ
1. Municipal Corporation Limits – 5 ਕਿਲੋਮੀਟਰ ਤੋਂ ਦੂਰ ਹੈ
2. Class A town and Cities Limits– 2 ਕਿਲੋਮੀਟਰ ਤੋਂ ਦੂਰ ਹੈ
3. Other towns and cities Limits- 1 ਕਿਲੋਮੀਟਰ ਤੋਂ ਦੂਰ ਹੈ
4. Village Laldora/ Phirni– 500ਮੀਟਰ ਤੋਂ ਦੂਰ ਹੈ
5. Wild Life Sanctuary/ Zoo- 500ਮੀਟਰ ਤੋਂ ਦੂਰ ਹੈ
6. National Highway - 500ਮੀਟਰ ਤੋਂ ਦੂਰ ਹੈ
7. State Highway/ Scheduled Road - 300ਮੀਟਰ ਤੋਂ ਦੂਰ ਹੈ
8. Residential Area (15 Pucca Houses)- 300ਮੀਟਰ ਤੋਂ ਦੂਰ ਹੈ
9. Educational Institute/ Historical Religious Places/ Protected Monuments- 300ਮੀਟਰ ਤੋਂ ਦੂਰ ਹੈ
From above, it is clear that the unit is complying with various distances as prescribed in the siting criteria stipulated for such units by the Board/Govt.
The hot mix plant was visited by officer of this office on 27.6.2024 and it was observed as under –
1. The unit was in operation during visit and almost all the sections of the plant were operational. 2. The unit has installed WMM plant, RMC plant (3 nos.) and batch type hot mix plant(2 nos.). The unit has installed machinery of existing hot mix plant in khasra no. 2428/2/2 The unit has installed new HMP in the khasra newly added land area i.e khasra nos. 2429, 2430, 2032.
3. The unit has installed bag house filter with the existing batch type Hot mix plant with adequate sampling arrangement and adequate stack height. Bag House filter installed with the HMP is in-built with the machinery as such it is adequate in principle.
4The industry has installed dust collector followed by wet scrubber with the rotary type HMP with adequate sampling arrangement and adequate stack height. which is adequate in principle.
5. The unit has installed DG set @ 62.5 KVA, 125 KVA, 225 KVA and 420 KVA with canopy and adequate stack height.
6. The PP has provided fresh plantation along the boundary of the site.
7. 5 no. bitumen heaters provided with adequate stack height.
8. Vehicular movement area for movement of heavy vehicles was found stabilized with the stone aggregates.
9. Septic tank provided for treatment of domestic effluent generated from the office section as well as pantry section with discharge onto land for plantation.
The newly added area in the project falls in PICPR zone and is 500 m far from village limits, 300 m from state highway, NH, scheduled road. There are no. educational institute/ religious monuments / houses( 15 nos) with in 300 m of the site
The unit is complying with provisions of Water Act, 1974 and Air Act, 1981.
Recommendations: -
Keeping in view of above, it is recommended that-
1. Consents to operate under the Water Act, 1974 and Air Act, 1981 may be granted to the industry upto 10.8. 2025 for the operation of unit having hot mix plant, Wet mix plant and RMC plant to produce Premix (Batch Type) @ 320 TPH Ready Mix Concrete @ 100 TPH Wet Mix Macadam @ 200 TPH, with suitable conditions along with condition that:
a. The industry will operate the machinery related to the batch type hot mix plant in khasra no. 2428/2/2, 2429, 2430, 2431 only.
b. The industry will comply with the code of practice as prescribed by the Board vide notification no. Admn./SA2/F.No.178/99/03 dt. 26.04.99 for hot mix plant at all times.
c. The PP will provide operational schedule of the HMP to the Board within 15 days so as to carry out air emission sampling.
