Mining contractor namely M/s Tirupati Earth and Project Works Private Limited was granted fresh ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 vide no: CTOW/Renewal/LDH3/2024/25564424 & CTOA/Renewal/LDH3/2024/25562310 dated 23.05.2024, valid upto 30.06.2024 for mining of sand @ 903231 tons per year at mining site of area 20.65 hectare located in the revenue estate of village Akkuwal, Tehsil Jagraon, District Ludhiana.
Now, the mining contractor namely “M/s Tirupati Earth and Project Works Private Limited” has applied for renewal of ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 for mining of sand @ 903231 tons per year at mining site of area 20.65 hectare located in the revenue estate of village Akkuwal, Tehsil Jagraon, District Ludhiana.
The State Environment Impact Assessment Authority (SEIAA) vide letter no. Certain amendments to this “Environmental Clearance” were issued vide letter no: SEIAA/MS/2023/340 dated 10.02.2023. Thereafter, the State Environment Impact Assessment Authority (SEIAA) vide letter no. SEIAA/MS/2023/1331 dated 13.09.2023 has transferred above said Environmental Clearance to mining contractor i.e. M/s Tirupati Earth and Project Works Private Limited subject same conditions mentioned in letter no. SEIAA/MS/2017/547 dated 03.05.2017.
Now, the SEIAA vide letter no: SEIAA/MS/2024/236 dated 03.05.2024 has extended the validity of “Environmental Clearance” granted to in the name General Manager – cum – Mining Officer, District Industries Centre, Ludhiana vide letter no. SEIAA/2017/619 dated 04.05.2017 for mining of minerals (Sand) from River Sutlej in the revenue estate of village Akkuwal, Tehsil Jagraon, District Ludhiana, Punjab for period upto 02.10.2026 and the subsequently transfer of EC issued vide letter no: SEIAA/MS/2023/1331 dated 13.09.2023 is extended till 02.10.2026, subject to the conditions as mentioned in the original EC issued vide letter no. SEIAA/2017/619 dated 04.05.2017, amendment in EC issued vide letter no. SEIAA/MS/2023/340 dated 10.02.2023 and transfer in EC issued vide letter no: letter no. SEIAA/MS/2023/1331 dated 13.09.2023.
The mining contractor had already deposited Rs. 21,600/- vide online receipt No. N259232646020248 dated 16.09.2023 under the Water Act, 1974 & Rs. 22,100/- vide online receipt no. N259232646020253 dated 16.09.2023 under the Air Act, 1981 as consents fee, which was adequate upto 15.09.2024 under the said acts. The project proponent has submitted latest CA certificate dated 01.05.2024 stating that the cost of the project is 6,77,42,325/- The project proponent has submitted point-wise compliance of the “Environmental Clearance” granted to it.
The mining site was visited by undersigned on 28.06.2024 and it was observed that mining was going on at site.
Keeping in view of above, it is recommended that renewal of ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 may be granted to the project proponent for the period upto 30.06.2024 for mining of sand @ 903231 tons per year in site area of 20.65 Hectare located at village Akkuwal, Tehsil Jagraon, District Ludhiana subject to suitable conditions alongwith following special conditions:
1. The project proponent shall carry out mining as per letter issued by the State Environment Impact Assessment Authority (SEIAA) vide letter no. SEIAA/MS/2017/547 dated 03.05.2017.
2. This ‘Consent to Operate’ is granted subject to the orders of Hon’ble Punjab and Haryana High Court in CWP 28603 of 2023, CM no. 2554 & CM no. 2550 pending before the Hon’ble Punjab and Haryana High Court.
3. The project proponent shall obtain necessary clearance / permission from the other Departments, if required, on its own level.
4. The industry shall earmarked the boundary properly before starting mining activity at the site. 5. The Project proponent will carry out mining process is open cast, semi mechanized, without drilling and blast.
5. The contractor shall maintain the computerized record of daily mining/ lifting of sand at site.
6. The project proponent shall submit analysis report of ambient air quality monitoring parameters mentioned in EC conditions as well as noise quality from Board's approved lab/ Board's lab within 01 month.
7. The project proponent shall not carry out mining beyond the allotted area, if the industry found illegal mining beyond the area then consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 will be revoked without any notice.
