Sub: Proceeding of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 26.06.2024 w.r.t. show cause notice for refusal of consent to operate under the Water Act, 1974 to M/s Gaurav Industries, Sua Road, Eastman Chowk, Ind Area-C, Dhandari Kalan, Ludhiana.

The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry is a small scale red category unit and applied for fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974.
The application of the industry has been perused and following observations has been made:-
1. The industry is red category unit and has been established without NOC of the Board.
2. The industry has submitted the copy of MSME certificate with date of classifaction/ registration as 09.11.2023 and made an agreement with an agreement with M/s Charanjit Singh & Co. Technology, VPO Paddi, Sahnewal, Dehlon Road, Ludhiana for lifting of trade effluent @ 1500 Ltr/month on 05.08.2023. The industry has not submitted month wise details w.r.t. water consumption and effluent generation from process from date of agreement.
3. The industry has not mentioned the amount of acid consumed in the process alongwith bills from date of commissioning of process.
4. The industry has not submitted point wise compliance to the NOC conditions which would have been imposed if the industry earlier had obtaining 'Consent to Establish' (NOC).
5. The industry is newly established unit and has not submitted the certificate from Competent Authority regarding land use pattern of the area.
In view of above, the industry was show cause notice for refusal of consent to operate under the Water Act, 1974 with hearing before the Senior Environmental Engineer of the Board on 26.06.2024.
No one from industry attended the hearing.
After considering material facts on record, the Senior Environmental Engineer of the Board decided that another opportunity of personal hearing may be given to the industry.
1. The application for consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 be refused.
2. The Environmental Engineer, Regional Office shall send further recommendation in the matter.
