File Note: Sir, the industry is a small scale red category unit and was granted 'Consent to Operate' under the Water Act, 1974 valid upto 01/02/2024 for the manufacturing of Zinc Plating on Job Basis for Nut & Bolt @ 3 MTD. The industry was surprisingly visited by RO on 29/12/2020 and it was observed that another industry namely M/s Kova Fastener Pvt. Ltd. was also operating in the same premises and was engaged in Hot Galvanizing process. M/s Kova Fastener Pvt. Ltd. was running with obtaining Consent/NOC from Board. Due to which, action under section 33-A of the Water Act, 1974 was taken against only M/s Kova Fastener Pvt. Ltd and PSPCL was directed to disconnect the power supply available to M/s Kova Fastener Pvt. Ltd E-177, Phase-IV, Focal Point, Ludhiana East, Ludhiana. Currently, only M/s Luxmi Electro Plating, E-177, Phase-IV, Focal Point, Ludhiana is operating its unit and complying with the environmental laws. Further, the Competent Authority of the Board has issued directions u/s 33-A of the Water Act, 1974 for restoration of electric connection temporarily upto 21.10.2022. It has deposited EC amounting Rs. 50,000/- vide R. No. 9/5453 dated 10.07.2023. Accordingly, after verifying physical compliance, Board vide letter no. 4151-52 dated 04.08.2023 has issued directions u/s 33-A of the Water Act, 1974 for restoration of electric connection available to the industry/premises temporarily upto 01.02.2024. The industry was given personal hearing before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 03.06.2024 w.r.t. Show cause notice for revocation of consent to operate granted under the Water Act, 1974, wherein, it was decided as under: 1. The auto generated consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 be revoked. 2. The industry shall apply for fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 through OCMMS, within 07 days. 3. The Environmental Engineer, Regional Office shall verify submission made by industry, and process consent application on merits. Now, the industry has applied for obtaining fresh 'consent to operate' under the Water Act, 1974 with requisite documents through OCMMS. The industry has submitted request letter for permanent restoration of electric connection. To verify the compliance, the industry was visited by RO on 09/04/2024 and it was reported as under: 1. The industry was in operation during visit & engaged in the Zinc-plating on job basis for nut & bolt. 2. The industry has made agreement with M/s JBR Technology Pvt. Ltd., Focal Point, Ludhiana for lifting of its effluent @ 6000 Ltr/month. 3. The industry has installed water meter in the process area and reading of the same noted during visit was 25.83 KL. 4. The industry has maintained the record of water meter reading regarding consumption & effluent lifted to M/s JBR Technology Pvt. Ltd., Ludhiana. The detail of record enclosed herewith. As per record water consumption and lifting is almost in proportion. Water Consumed in Process/Effluent Generated (as per record maintained by the industry) Effluent lifted by CETP Operator (During Verification Period) Storage Cap. Qty. lying stored at the time of visit Last Lifting (Qty. & Date) Avg. frequency of lifting MOU signed for qty. Initial WMR as on 01.01.2024: 05.87 KL Final WMR as on 09.04.202: 25.83 KL Water consumed: 19.96 KL 19.0 KL 8000 ltr. Appox. 500 ltr. 3000 ltr. on 30.03.2024 15 days 6000 ltr. 5. The industry is complying with the provisions of Water (Prevention & Control of Pollution) Act, 1974. The Board has already restored the electric connection of the industry two times as mentioned above. RO recommended that directions u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 may be issued to PSPCL authorities for permanent restoration of electric connection and consent to Operate' under Water (Prevention & Control of Pollution) Act, 1974 may be granted upto 30/06/2026 with suitable conditions as per policy of the Board. In view of report of RO, it is recommended as under:- 1. The Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 may be granted to the industry upto 30.06.2026. 2. Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 may be issued for restoration of electric connection of the industry permanently as per the policy of the Board, please. (Category - Red, small) (Competency lies with SEE for deciding consent case and for notice/ directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981, competency lies with CEE Ludhiana)
