File Note: • The project is a residential colony developed in an area of 25.008 acres for development of 206 no. Residential Plots, 26 no. commercial Plots, 55 no.EWS Plots & 01 no. hotel. The project proponent submitted in writing that the person who so ever will purchase the site of the hotel shall obtain the NOC for the same…………….. • Consent to establish' (NOC) granted to the project proponent under the provisions of the Water Act, 1974 & Air Act, 1981 dated 03.11.2022 (valid upto 03.11.2023) for development of the residential colony in area of 25.008 acres & for discharge of domestic effluent @ 145 KLD to be discharge onto land for plantation in an area of 1.55 acres within its premises to be developed under green area and onto 17 kanal land area outside its premises (taken on lease for 5 years)…………. • The site of the project was earlier visited by the officer of the Board on 26.04.2024 and it was observed that the project proponent has started the development work at the site and as per the rep. available approx. 80 % of the development work has been completed at site. No occupancy has been started at the project and approx. 9 no. houses are under construction. The project proponent is yet to provide STP for treatment of the proposed effluent……………. • The project proponent has failed to apply for obtaining extension in the validity of 'consent to establish' (NOC) and has also failed to apply for obtaining CTOs of the Board under the Water Act, 1974 & Air Act, 1981…………. • Show cause notice for violation of the provisions of Water Act, 1974 & Air Act, 1981 was issued to the project proponent alongwith an opportunity of personal hearing before the Chief Environmental Engineer (B) on 12.06.2024. During hearing, the Partners of residential colony stated that they have applied application for extension in the validity of NOC on 11.06.2024………….. • After hearing, the Partners of the colony and officer of the Board, the Chief Environmental Engineer (B) decided that:-……….. 1. The project proponent will install the STP of adequate capacity alongwith adequate disposal arrangement well before the commissioning of the project. The project proponent shall ensure the propionate installation of STP with the development of the project…………… 2. The project proponent shall ensure to manage the wet solid waste through in-house management in compliance to the Solid Waste Management Rules, 2016…………. 3. Environmental Engineer, Regional Office, Bathinda shall visit the colony and process the application to be applied by the project proponent for obtaining extension in validity of 'consent to establish' (NOC) under the Water Act, 1974 & Air Act, 1981, on merit…………. • Now the project proponent has applied for extension in the validity of the CTE…………… • The site of the project was visited by the officer of the Board on 21.06.2024 and it was observed that:- …………. 1. The project proponent has started the development work at the site and as per the rep available approx. 80- 90 % of the development work has been completed at site……………. 2. No occupancy has been started at the project and approx. 9 no. houses are under construction…………. 3. The project proponent is yet to provide septic tank/ STP for treatment of the proposed effluent………….. 4. The project proponent is yet to develop the compost pits for the management of the solid waste………….. • In view of above, if approved, 'consent to establish' (NOC) granted to the project for establishment of residential colony be further extended for one year, subject to the same conditions mentioned in the earlier CTE granted to it along with the following additional conditions that:-……………. 1. The project proponent will install the STP simultaneously with the development of the colony and will ensure to develop the land under plantation as per the proposal submitted………….. 2. The project proponent will construct compost pits of adequate capacity for management of the bio-degradable solid waste in compliance to the Solid Waste Management Rules, 2016………….. 3. The proponent shall ensure to obtain the required statutory clearance (s) from the Board before starting any construction activity in the plot area of size 1454.28 sq. yards reserved for construction of hotel as per the undertaking submitted by it…………….
