Sir, the application of the industry has been perused and following observations has been made:-
1. The industry is red category unit and has been established without NOC of the Board.
2. The industry is a new unit and failed to submit MSME certificate as proof of exact date of commissioning of the unit.
3. The industry has made an MOU with M/s JBR Technology Pvt. Ltd., (Unit-I), Ludhiana @ 5000 Ltr/M for the disposal of trade effluent generated from process dated 18.12.2021 and the industry was in operation without valid consent/ NOC of the Board from last three years. Also, the industry has failed to submit month wise details w.r.t. water consumption and effluent generation from process from date of agreement with JBR.
4. The industry is a new unit and the industry has not submitted the certificate from Competent Authority regarding land use pattern of the area.
5. The industry has not submitted point wise compliance to the NOC conditions which would have been imposed if the industry earlier had obtaining 'Consent to Establish' (NOC) verified by visiting officer.
In view of the above, it is recommended that show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 may be issued to the industry with hearing at ZO level due to reason mentioned at point no. 1, 2, 3 & 4 and RO may be requested to submit reply in view point no. 5, please, please.
