The Regional Office has submitted report in lieu to the application filed by the project proponent.
After perusal of the report sent by RO and the application filed by the project proponent, it was noted as under:
• The project proponent is a small scale green category commercial project and was earlier granted ‘Consent to Establish’ (NOC) under orange category vide no. CTE/Fresh/BAR/2023/23849743 dated 02/11/2023 valid upto 01/11/2024 for establishment of Shops @ 28 no. & Lake @ 01 no. and for disposal of domestic effluent @ 7.0 KLD onto land for green area in an area of 0.1 acres after passing through STP of capacity 20 KLD.
• In light of the latest categorization issued by CPCB, project is shifted from Orange to Green category as Sr. No. 3079 titled as Building and construction projects, having built-up area upto 20,000 m2 and wastewater generation <50 KLD. In this case, total built-up area of the project is less than 20,000 m2 and total wastewater generation is 31.93 KLD, which is less than 50 KLD. Hence, it falls under green category.
• Now, it has applied for NOC/consent to establish for establishment of Commercial project in total land area of 8.90 Acres with max. covered area of 6315.15 sqm consisting of Commercial Shops @ 28 Numbers, Holiday Resort Rooms @ 21 Numbers, Exhibition Centre @ 07 Numbers, Sports Club @ 01 Numbers, Amenity Centre @ 01 Numbers & Lake @ 01 Number as components and for disposal of domestic effluent @ 31.93 KLD (20.99 KLD will be reused in to dual Plumbing, remaining 10.3 KLD will be disposed on to land for plantation of an area 0.85 acres) after passing through STP under green category.
• The project proponent has also submitted the revised layout plan and CLU approved by the Senior Town Planner, Patiala vide no. 85 dated 12.01.2024.
• The project proponent has deposited NOC fee amounting Rs. 24,000/- vide no. 646062521 dated 23.05.2024 & Rs. 18,000 vide no. 584027318 dated 12.04.2024, against the proposed project cost of Rs. 4100.00 lakhs (value of plant & machinery is Rs. 500.00 lakhs), which is adequate for one year.
• The project proponent has submitted feasibility report as per which:
The estimate dpopulation of project will be 1722 (As per NBC, 2016).
The project requires 2000 KL fresh water one time for lake and 39.91 KLD water for domestic use.
It will generate domestic effluent @ 31.93 KLD from which 20.99 KLD will be reused in to dual Plumbing and remaining 10.3 KLD will be disposed on to land for plantation of an area 0.85 acres after treated in STP.
The plantation area is adequate in comparison to the proposed discharge to be discharged by the project proponent in the plantation area.
The project proponent has proposed to install STP of capacity 50 KLD based on MBBR technology.
The project proponent has proposed that total 172.2 kg/day solid waste will be generated in its full capacity. The project proponent proposed that it will adopt Innovative solid waste management practices for solid waste management at the project such as mechanical composter.
It is also proposed that all the staff members will be adequately trained on the same and collected waste will be sent to the local authority. Generated STP sludge will be used as manure at the site for landscaping and greenbelt development.
• The site of the project proponent was visited by the officer of Regional Office on 03/06/2024 and observed as under:
1. The site of the proposed commercial project is located on Near Handiaya Chowk, Opp. 5 Star Diamond Dhaba, Bathinda to Barnala Road, NH-7, c/o HG Eaton Plaza, Handiaya, District Barnala.
2. No rice sheller, saila plant, stone crusher, cement plant, grinding unit, hot mix plant, MAH unit falls within 500 mtr distance from the boundary wall of the project.
3. Now, the project proponent has proposed to develop a commercial project in an area of 3.35 acres consisting of Commercial Shops @ 28 Numbers, Holiday Resort Rooms @ 21 Numbers, Exhibition Centre @ 07 Numbers, Sports Club @ 01 Numbers, Amenity Centre @ 01 Numbers & Lake @ 01 Numbers.
4. At site, total 28 SCOs and one lake have been constructed, one hotel and 07 exhibition center, one sports club and one amenity center is under construction. The washrooms of this project are under construction. As such, presently there is no generation of domestic sewage from this project.
5. The lake is completed. The project proponent submitted that the water is reused in the lake after filtration of the same. The project proponent has provided the series of filters for reusing the lake water back into lake. During rain, the arrangements has been provided to discharge excess rain water into the rain harvesting pits through filters.
6. The project proponent has installed 01 no. DG set of capacity 250 KVA, equipped with canopy and adequate stack height. The project is not covered under Environmental Clearance.
• The RO has recommended that the revised consent to establish may be granted to the project proponent under green category with suitable conditions and special conditions that:
1. The project proponent shall comply with the conditions imposed in CLU issued by STP, Patiala vide letter no. 85 dated 12.01.2024.
2. The project proponent shall comply with the provisions of Master Plan of Barnala, as and when will be notified by the Govt.
3. The project proponent shall comply with the provisions of Municipal Solid Waste Management Rules, 2016 for management and handling of solid waste which is to be generated from the project and shall install the mechanical composter.
In consideration of the report/ recommendations sent by RO; if approved, the ‘Consent to Establish’ (NOC) from pollution angle under the provisions of the Water Act, 1974 & the Air Act, 1981 for establishment of Commercial project in total land area of 8.90 Acres with max. covered area of 6315.15 sqm consisting of Commercial Shops @ 28 Numbers, Holiday Resort Rooms @ 21 Numbers, Exhibition Centre @ 07 Numbers, Sports Club @ 01 Numbers, Amenity Centre @ 01 Numbers & Lake @ 01 Numbers as components, be granted to the unit for one year i.e. upto 06.06.2025 (one year from date of application filing), subject to suitable conditions and the following additional conditions that:
1. This CTE is valid for establishment of Commercial project in total land area of 8.90 Acres with max. covered area of 6315.15 sqm consisting of Commercial Shops @ 28 Numbers, Holiday Resort Rooms @ 21 Numbers, Exhibition Centre @ 07 Numbers, Sports Club @ 01 Numbers, Amenity Centre @ 01 Numbers & Lake @ 01 Numbers as components, on the same site for which site plan approved by Senior Town Planner, Patiala vide no. 85 dated 12.01.2024, only.
2. The project proponent shall develop its project strictly in accordance with the layout/ building plan approved by the site plan approved by Senior Town Planner, Patiala vide no. 85 dated 12.01.2024. In case, there is variation in built-up area/green area/ any other details in layout plan approved by the competent authority (if at any stage), then the project proponent shall get its revised layout plan approved from the competent authority as well as obtain fresh Consent to Establish from the Board, for the said change.
3. The project proponent shall ensure that the total built up area of construction carried out by it or being carried out by any different builder(s) may not be greater than 20,000 sqm, otherwise the project as such is covered under category 8(a) of the schedule appended to the EIA notification and project proponent of the building and construction project is required to obtain the environmental clearance, failing which, the promoter company/builder shall be liable for action for the violation of EIA notification dated 14/09/2006.
4. The project proponent shall comply with all terms & conditions imposed in the CLU granted by the STP, Patiala vide Memo No. 85 STP(P)/ SP-327 dated 12.01.2024.
5. The promoter company shall install STP of capacity 50 KLD based on MBBR technology for the treatment of domestic effluent generated by the project premises, as proposed by it.
6. The project proponent shall provide necessary arrangements for usage of the treated effluent after STP for flushing purpose in accordance with the Board’s office order no. 315 dated 05.07.2018 and only the remaining treated effluent shall be discharged onto the green area to be developed within premises and the plantation area as per Karnal Technology to be developed in 0.85 Acres area, as proposed by it.
7. The project proponent will develop the project on its own risk & cost in regard to disposal arrangement. The project proponent shall be entirely responsible for the arrangement of additional land required for the disposal of treated domestic effluent, if any.
8. The project proponent shall not carry out any activity/ construction at site which obstructs the natural drainage through the site, in wetland and water bodies and the natural drainage system should be maintained for ensuring unrestricted flow of water.
9. The project proponent shall restrict its water consumption, waste water generation and abide by the treatment proposal for wastewater and solid waste, as per the proposal given by it.
10. The promoter shall also not allow any occupancy in the project till the time adequate arrangements for effluent treatment & disposal, solid waste handling & disposal are made as well as 'consents to operate' under the Water Act, 1974 & the Air Act, 1981 are obtained.
11. During construction phase, it shall ensure that the waste water being generated from the labour quarters/ toilets shall be treated and disposed in environment friendly manner. In this regard, the project proponent shall provide septic tanks for the treatment of wastewater generated from the labour hutments and the treated effluent/ supernatant from the septic tanks shall be utilized in green area/ plantation only.
12. The promoter company shall submit the complete drawing and design of the STP and its component at the time of obtaining consent to operate.
13. The project proponent shall obtain permission from the PWRDA for the abstraction of ground water.
14. The project proponent shall utilize treated wastewater from nearby STPs for the construction purpose and shall submit an agreement in this regard within one month.
15. The project proponent shall provide separate water meter and energy meter for the STP and maintain record of the same on daily basis.
16. The promoter shall provide a buffer zone of green belt (dense populated trees with pleasant fragrance) around the sewage treatment plant, so as to reduce the effect of odour problem in its vicinity.
17. The promoter company shall explore the possibility of using treated domestic effluent for useful purpose such as construction work, sprinkling on dusty patches/roads, use in nearby construction activities etc.
18. The project proponent shall place adequate no. of bins outside its premises from where the Municipal Solid Waste shall be got lifted.
19. The project proponent shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016 and ensure that the solid waste is segregated into biodegradable and non-biodegradable components. The biodegradable component shall be treated by providing mechanical composter of adequate capacity to produce compost, which will be disposed of/reused in an environmentally sound manner and the non-biodegradable solid waste shall also be disposed of in an environmentally sound manner.
20. The project proponent will develop the project on its own risk & cost in regard to disposal arrangement of the solid wastes.
21. The project proponent shall also ensure that the hazardous waste and e-waste components of the solid waste shall also be segregated and the same shall be channelized to the authorized facility for such type of waste.
22. The project proponent shall comply with the provisions of the Construction and Demolition Management Rules, 2016.
23. The project proponent shall take adequate steps to the effect that the construction material of any kind that is stored at site shall be fully covered in all respects so that it does not disperse in the air in any form.
24. The project proponent shall ensure that all the construction material and debris shall be carried out in trucks or other vehicles which are fully covered and protected so as to ensure that the construction debris or the construction material does not get disburse into the air or atmosphere in any form.
25. The project proponent shall take all necessary steps to control the dust emissions to be generated from the construction activities of the project.
26. The project proponent shall ensure that the vehicles carrying construction material and construction debris of any kind shall be cleaned before it is permitted to ply on the road after unloading of such material.
27. The project proponent shall provide mask to every worker working on the construction site and involved in loading/ unloading and carrying of construction material and construction debris.
28. The project proponent shall provide all medical help, investigation and treatment of workers involved in construction of building and carrying out construction material and debris related to dust emissions.
29. The project proponent shall install mechanical composter for the treatment of solid waste being a bulk waste generator.
30. The project proponent shall make use of alternatives of single use plastics (SUP) within its premises and will not use any SUP items banned in accordance with MoEF&CC notification no. G.S.R. 571(E) dated 12.08.2021.
31. The Punjab Pollution Control Board shall have the liberty to revoke this consent & take penal action against the industry/project proponent and its responsible/ concerned person(s), in case any information/document provided by the industry/ project proponent is found to be incorrect/false/misleading at any point of time.
32. The Punjab Pollution Control Board shall not be responsible for any financial liability and/ or any other liability of the project proponent, due to grant of this Consent to Establish.
