File Note: The Regional Office has submitted report in lieu to the application filed by the project proponent. After perusal of the report sent by RO and the application filed by the project proponent, it was noted as under: • The project proponent has applied for establishment of affordable residential plotted colony in an area of 5.18 Acres consisting of components as Residential Plots @ 83 Numbers, EWS plots @ 13 Numbers, Commercial Plots @ 34 Numbers, alongwith requisite documents & fees. • The project proponent has deposited Rs. 36000/- vide R No. AXSK241300006179 dated 09.05.2024 on account of ‘Consent to Establish’ fees against the proposed project cost of Rs. 25.39 Crore; which is adequate for one year. • The project proponent has obtained the CLU vide Memo No. PB/CLU/JUC/JALAN/2057 dated 28.09.2022 for an area of 20954.86 sqm. • The project proponent has submitted site plan approved by Senior Town Planner, MC, Jalandhar dated 17.04.2023. As per building plan, total saleable area is 11583.45 square meter (10637 square meter residential and 946.44 square meter commercial) and total built up area will be 24230.58 square meter which is less than 1,50,000 square meter and hence the project is not covered under EIA, 2006. • The project proponent has submitted feasibility report for control of pollution. As per the brief project report the occupancy/population has been estimated to be 480 persons considering 05 persons per plot and 96 total residential plot. As per the feasibility the waste water generation will be 54.2 KLD. • The RO mentioned in its note that the waste water generation calculation is as below: 1. Total residential dwellings – 96. Population to be served = 96 x 05 = 480 2. Water consumption = 480 x 0.135 KLD = 64.8 KLD. Waste water generation = 64.8 x 0.8 = 51.84 KLD. 3. Commercial shops – 34. Total persons for commercial shops = 34 x 2 = 68. 4. Water consumption = 68 x 0.040 KLD = 2.72 KLD. Waste water generation = 2.72 x 0.8 = 2.176 KLD. 5. Thus, maximum waste water generation will be 54 KLD. • As per the feasibility report, STP of capacity 75 KLD has been proposed to be installed at site. The STP will be based on MBBR technology which is principally adequate. The project proponent has proposed to treated water will be disposed in adjoining MC sewer. • The project proponent has submitted a letter issued by MC, Jalandhar mentioning that “Since the Competent Authority of Municipal Corporation, Jalandhar department of Local Govt. has granted L.O.I. No. MTP/473 issued by MTP, Municipal Corporation, Jalandhar to Dwarka Vihar. Now, firm has requested for the connection of sewer with main sewer line which will be treated by STP. Provisional NOC for the discharge of 0.07 MLD shall be granted to the firm after the approval of competent authority with condition that: A. The firm will be allowed to dispose of the sewage into Municipal sewer of this colony after deposition of required charges to Municipal Corporation Jalandhar and as per capacity of STP during that time. Note, firm will be allowed for sewer connection only after deposition of EDC charges. • The project shall generate solid waste which will be segregated into recyclable, Biodegradable and inert waste. Bio Composter will be installed for treatment of wet solid waste. Recyclable waste shall be sold to recyclers. Non-Bio-degradable waste will be disposed off as per the Solid Waste Management Rules, 2016. • The proposed site was visited by the officers of Regional Officer on 18.06.2024 and observed as under:  The site of the project falls within the Municipal limit of MC Jalandhar.  The project proponent has demarcated the boundary wall of the proposed project at site. No MAH industry/cement plant/ grinding unit/ rice sheller/ saila plant/ stone crushing/ screening cum washing unit/ hot mix plant/ brick kiln within a radius of 500 m from the boundary of the proposed site of the project.  No air polluting industry located within 100 m of the site. Therefore, the site of the project is conforming to the sitting guidelines laid down by the Govt. of Punjab, Department of Science Technology and Environment vide order dated 25/07/2008 as amended on 30/10/2009. • The RO has recommended that consent to establish (NOC) under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the project for one year with suitable conditions and special conditions as mentioned in its note. It is brought out that the project proponent has not proposed for reutilization of treated effluent after STP for flushing purposes which is a mandatory requirement as per Boards order no. 315 dated 05.07.2018 and the relevant part of the said order is reproduced as under: “2. If the residential colony/commercial complex/construction project is proposed to be established outside the municipal limits of a City/Town of the State or jurisdiction of any other development authority, then the individual colonizer shall provide adequate and appropriate STP to treat its waste water and shall make arrangements to reuse the treated waste water for flushing purposes and to discharge the remaining treated effluent onto land for plantation/irrigation purposes.” Therefore, a condition can be imposed to the project proponent to provide necessary arrangements for max. utilization of treated effluent for flushing purposes in the project and only the remaining treated effluent shall be discharged into MC Sewer. In consideration of the report/ recommendations sent by RO; if approved, the ‘Consent to Establish’ (NOC) from pollution angle under the provisions of the Water Act, 1974 & the Air Act, 1981 for establishment of affordable residential plotted colony in an area of 5.18 Acres consisting of components as Residential Plots @ 83 Numbers, EWS plots @ 13 Numbers, Commercial Plots @ 34 Numbers, be granted to the project proponent for one year i.e. upto 10.06.2025 (one year from date of application filing), subject to suitable conditions and the following additional conditions that: 1. This CTE is valid for establishment of affordable residential plotted colony in an area of 5.18 Acres consisting of components as Residential Plots @ 83 Numbers, EWS plots @ 13 Numbers, Commercial Plots @ 34 Numbers, on the same site for which site plan approved by Senior Town Planner, MC, Jalandhar dated 17.04.2023, only. 2. The project proponent shall develop its project strictly in accordance with the layout/ building plan approved by the site plan approved by Senior Town Planner, MC, Jalandhar dated 17.04.2023. In case, there is variation in built-up area/green area/ any other details in layout plan approved by the competent authority (if at any stage), then the project proponent shall get its revised layout plan approved from the competent authority as well as obtain fresh Consent to Establish from the Board, for the said change. 3. The project proponent shall ensure that the total built up area of construction carried out by it or being carried out by any different builder(s) may not be greater than 20,000 sqm, otherwise the project as such is covered under category 8(a) of the schedule appended to the EIA notification and project proponent of the building and construction project is required to obtain the environmental clearance, failing which, the promoter company/builder shall be liable for action for the violation of EIA notification dated 14/09/2006. 4. The project proponent shall ensure that the total built up area of all individual projects/plots combined together is not more than 1,50,000 sqm, otherwise the project as such is covered under category 8(b) of the schedule appended to the EIA notification dated 14/09/2006 and the project proponent is required to obtain environmental clearance, failing which, the promoter company shall be liable for action for violation of the EIA notification dated 14/09/2006. 5. The promoter company shall install STP of capacity 75 KLD based on MBBR technology for the treatment of domestic effluent generated by the project premises, as proposed by it. 6. The project proponent shall provide necessary arrangements for usage of the treated effluent after STP for flushing purpose in accordance with the Board’s office order no. 315 dated 05.07.2018 and the remaining treated effluent shall be discharged onto the green area to be developed within premises and only the surplus treated effluent shall be discharged into MC Sewer in accordance with the permission accorded by the MC authorities. 7. The project proponent will develop the project on its own risk & cost in regard to disposal arrangement. The project proponent shall be entirely responsible for the arrangement of additional land required for the disposal of treated domestic effluent, if at any stage. 8. The project proponent shall not carry out any activity/ construction at site which obstructs the natural drainage through the site, in wetland and water bodies and the natural drainage system should be maintained for ensuring unrestricted flow of water. 9. The project proponent shall restrict its water consumption, waste water generation and abide by the treatment proposal for wastewater and solid waste, as per the proposal given by it. 10. The promoter shall also not allow any occupancy in the project till the time adequate arrangements for effluent treatment & disposal, solid waste handling & disposal are made as well as 'consents to operate' under the Water Act, 1974 & the Air Act, 1981 are obtained. 11. During construction phase, it shall ensure that the waste water being generated from the labour quarters/ toilets shall be treated and disposed in environment friendly manner. In this regard, the project proponent shall provide septic tanks for the treatment of wastewater generated from the labour hutments and the treated effluent/ supernatant from the septic tanks shall be utilized in green area/ plantation only. 12. The promoter company shall submit the complete drawing and design of the STP and its component at the time of obtaining consent to operate. 13. The project proponent shall obtain permission from the PWRDA for the abstraction of ground water. 14. The project proponent shall utilize treated wastewater from nearby STPs for the construction purpose and shall submit an agreement in this regard within one month. 15. The project proponent shall provide separate water meter and energy meter for the STP and maintain record of the same on daily basis. 16. The promoter shall provide a buffer zone of green belt (dense populated trees with pleasant fragrance) around the sewage treatment plant, so as to reduce the effect of odour problem in its vicinity. 17. The promoter company shall explore the possibility of using treated domestic effluent for useful purpose such as construction work, sprinkling on dusty patches/roads, use in nearby construction activities etc. 18. The project proponent shall place adequate no. of bins outside its premises from where the Municipal Solid Waste shall be got lifted. 19. The project proponent shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016 and ensure that the solid waste is segregated into biodegradable and non-biodegradable components. The biodegradable component shall be treated by providing mechanical composter of adequate capacity to produce compost, which will be disposed of/reused in an environmentally sound manner and the non-biodegradable solid waste shall also be disposed of in an environmentally sound manner. 20. The project proponent shall obtain permission from MC Jalandhar regarding disposal of the inert solid waste onto any authorized dumping/ SLF site of MC. In case, the permission for the same is denied or not allowed by the MC Jalandhar at any stage; then this ‘Consent to Establish’ (NOC) from pollution angle shall be deemed cancelled and the Board shall not be responsible for any financial liability arising due to cancellation of this CTE (NOC). In such case, the project proponent shall apply for fresh ‘Consent to Establish’ (NOC) from pollution angle alongwith concrete proof for alternate modes of disposal of the inert solid waste. The project proponent will develop the project on its own risk & cost in regard to disposal arrangement of the solid wastes. 21. The project proponent shall also ensure that the hazardous waste and e-waste components of the solid waste shall also be segregated and the same shall be channelized to the authorized facility for such type of waste. 22. The project proponent shall comply with the provisions of the Construction and Demolition Management Rules, 2016. 23. The project proponent shall take adequate steps to the effect that the construction material of any kind that is stored at site shall be fully covered in all respects so that it does not disperse in the air in any form. 24. The project proponent shall ensure that all the construction material and debris shall be carried out in trucks or other vehicles which are fully covered and protected so as to ensure that the construction debris or the construction material does not get disburse into the air or atmosphere in any form. 25. The project proponent shall take all necessary steps to control the dust emissions to be generated from the construction activities of the project. 26. The project proponent shall ensure that the vehicles carrying construction material and construction debris of any kind shall be cleaned before it is permitted to ply on the road after unloading of such material. 27. The project proponent shall provide mask to every worker working on the construction site and involved in loading/ unloading and carrying of construction material and construction debris. 28. The project proponent shall provide all medical help, investigation and treatment of workers involved in construction of building and carrying out construction material and debris related to dust emissions. 29. The project proponent shall install mechanical composter for the treatment of solid waste being a bulk waste generator. 30. The project proponent shall make use of alternatives of single use plastics (SUP) within its premises and will not use any SUP items banned in accordance with MoEF&CC notification no. G.S.R. 571(E) dated 12.08.2021. 31. The Punjab Pollution Control Board shall have the liberty to revoke this consent & take penal action against the industry/project proponent and its responsible/ concerned person(s), in case any information/document provided by the industry/ project proponent is found to be incorrect/false/misleading at any point of time. 32. The Punjab Pollution Control Board shall not be responsible for any financial liability and/ or any other liability of the project proponent, due to grant of this Consent to Establish.
