File Note: It is submitted that the subject cited industry is a small industry and was granted consent to operate under the Water Act, 1974 vide no. R14PTACTOW882248 dated 11.6.2014 and under the Air Prevention & Control of Pollution) Act, 1981 vide no. ZO-I/PTA/APC/2013/V-148 dated 28/01/2013 both valid upto 30.6.2019 for manufacturing of plastic rings and sides of curtain support @ 350 Kg/day and nickel / chrome plated pipes @ 90 nos./day by using MS Pipe @27000 Nmber/Year Coating Material Nickle and Chrome @ 0.2 KL/Year Plastic Granuals @108200 Kg/Year H2SO4 @0.2 KL/Year as raw material subject to certain condition mentioned therein. As per the record file, the industry was earlier visited on 07.07.2017 and the industry was found violating the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 by started manufacturing new products and by violating the conditions of the earlier consents. The industry was issued show cause notice vide Board's letter no. 2995 dated 14.7.2017 to submit its written reply. However, no reply was submitted by the industry. Accordingly, the site of the industry was visited by the officer of Regional Office, Patiala on 19.12.2023 and following observations has been made: 1. The industry is engaged in manufacturing of bathroom and curtain accessories based on plastic and have stopped its electroplating process for curtain rods. 2. The industry has installed 12 no. of injection moulding machines for manufacturing of bathroom and curtain accessories using virgin plastic granules. 3. The industry has also installed 1 no. vacuum metalizing plant for metalizing of plastic material i.e. providing a layer of aluminium metal over plastic, which is not provided any APCD. 4. The industry is using lacquer as raw material before metalizing. Empty drums are sold to kabadi walas. 5. The industry has also provided small tanks for rinsing of metalized product and the rinsed water is being discharged into PSIEC sewer. Domestic effluent is discharged into sewer. 6. The house keeping of the industry was found very poor. As such, show cause notice for violation of the provisions of the under section 25/26 Water (Prevention & Control of Pollution) Act, 1974 & section 21 of the Air (Prevention & Control of Pollution) Act, 1981 was issued vide Board's letter no. 12444 dated 27/02/2024 with an opportunity to appear in person before the Senior Environmental Engineer (ZP-I) on 12.03.2024. After hearing, it was decided as under: 1. 1. The industry shall comply with the observations of the visiting officer of the Board, within 07 days and submit the compliance to the Environmental Engineer, Regional Office, Patiala, within 15 days, thereafter. 2. The industry shall obtain renewal of the consents to operate granted by the Board under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981, within 15 days. 3. Environmental Engineer, Regional Office, Patiala shall revisit the industry after 15 days to verify the contentions of the industry and submit its report alongwith conclusive recommendations. 4. Further action shall be taken after the report from the Regional Office, Patiala. The proceedings of the personal hearing were conveyed to the industry vide Board's letter no. 12804 dated 19.03.2024 for compliance. Now, the industry has again applied for obtaining varied consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Plastics Rings/Sides of Curtain Supports etc. @ 350 kgs/day by using Plastics Granules @ 350 kgs/day & Lacqoer @ 6.0 Ltr/day with requisite documents under GREEN CATEGORY at sr. no. 3068- Injection molding of plastic{ only from fresh(virgin) plastic granules and only small scale industry. The industry has deposited Rs. 21000/- vide online R. No. 492234365 dated 15.04.2024 as water consent fee and Rs. 21000/- vide online R. No. 755014575 dated 15.04.2024 as air consent fee against the fixed assets of Rs. 23.38 lakh as per CA certificate dated 26.03.2024, which is adequate upto 30.06.2029 (after deducting penalty @ 500%). The industry was visited by the officer of this office on 30.04.2024. During visit, it was observed that: 1. The industry is engaged in manufacturing of bathroom and curtain accessories based on plastic and have stopped its electroplating process for curtain rods. 2. The industry has installed 10 no. of injection moulding machines for manufacturing of bathroom and curtain accessories using virgin plastic granules. 3. The industry has also installed 1 no. vacuum metalizing plant for metalizing of plastic material i.e. providing a layer of aluminium metal over plastic, which is not provided any APCD. 4. The industry has also installed 2 no. ovens for baking of lacquer oven plastic material. 5. The industry is using lacquer as raw material before metalizing. Empty drums of lacquer are sold to kabadi walas. 6. The industry has also provided small tanks for rinsing of metalized product and the rinsed water is being discharged into PSIEC sewer. Domestic effluent is discharged into sewer. As mentioned above, the industry is again found violating the provisions of the Water Act, 1974 and the Air Act, 1981 and does not seems to fall under green category due to installation of vacuum metalizing plant and 2 no. ovens for baking of lacquer oven plastic material. In view of above, may if approved, recommendations be sent to SEE, ZO-1, Patiala that 1. Application of the industry has applied varied consent to operate under the Water Act, 1974 and the Air Act, 1981 be refused. 2. Further action for violating the decisions of the personal hearing be initiated against the industry. (Competency SEE)
