File Note: It is submitted that the industry has been granted ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Fresh/SAS/2019/9261354 dated 08/04/2019 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Fresh/SAS/2019/9261272 dated 08/04/2019, having validity upto 30/09/2023 for Dry powder injections @ 2.40 crore/year subject to certain conditions. Now, the project proponent has applied for obtaining varied ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for production Dry Powder Injections @ 2,00,50,000 Number/Year, alongwith a requisite documents. The industry has deposited Rs 28000/- vide UTR. no. N265232653068074 dated 22.09.2023 under the Water (Prevention & Control of Pollution) Act, 1974 (linked with application no. 23582352) and Air (Prevention & Control of Pollution) Act, 1981 of Rs. 28000/- vide UTR no. N264232651634482 dated 21.09.2023 (linked with application no. 23583410), which is adequate upto 30.09.2027 (Considering of NOC regularization fee and late fee) for both the Acts against the increase in the fixed assets of Rs. 72.62 lakhs to 82.56 lakhs. Visit: Accordingly, the site of the industry was visited by AEE of this office on 01.07.2024 and it was observed as under: 1. The industry is engaged in the business of manufacturing of dry powder injections through formulation only. The industry was not in operation during the visit and the representative of the industry informed that the unit is not in operation since last 2-3 months due to no market demand. 2. He further informed that they have applied for varied ‘consent to operate’ as they are now proposing to increase production capacity of Dry Powder Injections from 2.4 cr. Number/Year to 2.5 cr. Number/year. There is no increase in any machinery at the site for this proposed increase in production. 3. The industry has installed 1 vial washing machine, depyrogenating tunnel, powder filling machine, powder filling machiner, vial sealing machine & vial labelling machine each and 9 air handling units. 4. The process engaged in the formulation & manufacturing of product is as under: Filling, Stoppering Depyroginating Tunnel Washing Decartoned Vials & sealing Labelling Inspection machine & finish goods under Test quarantine packaging dispatchstore 5. The source of fresh water supply is through PSIEC supply and the same has been provided with mechanical flow meter to adjudge the quantity of water consumed by the industry. 6. The source of effluent generation is wastewater generated from the vial washing section and during CIP of the formulation mixer tanks. 7. The industry has provided in-house fabricated evaporator system for evaporating the effluent generated from its process. Further, the industry has installed EMF on the pipeline through which the said effluent is being carried into the evaporator tank. 8. The domestic effluent is being discharged into PSIEC sewer line which further connects to terminal STP of capacity 2 MLD installed at Industrial Focal Point, Derabassi. 9. The industry has installed a diesel fired thermax boiler of capacity 600 Kcal/ hr having adequate stack height. 10. Further, the industry has installed a D.G. Set of capacity 125 KVA equipped with canopy and stack of adequate height. From above, it is clear that the industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Recommendations: In the above, if may approved, the industry may be granted varied ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 upto 30.09.2027, subject to suitable conditions and additional conditions that: 1. This consent is being issued to the industry in supersession to the earlier ‘consent to operate’ granted under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Fresh/SAS/2019/9261354 dated 08/04/2019 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Fresh/SAS/2019/9261272 dated 08/04/2019, having validity upto 30/09/2023 2. The industry shall not carry out any activity in its premises which can change the category of unit from Orange to Red. 3. The industry shall apply for obtaining authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016, within 07 days. 4. The industry shall properly operate and maintain its evaporator at all times and shall keep proper record of operation of the same. 5. The industry shall discharge only domestic effluent into PSIEC sewer. 6. The industry shall maintain proper record of the freshwater being consumed in its process at all times. 7. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ out side its premises/ onto land for stagnation at any time, under any circumstances. 8. The industry shall ensure that due to operation of the project at the site, no nuisance for general public is created at any time and no public complaints are received. 9. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time. 10. The unit shall ensure that no nuisance is created in the vicinity of its premises from the operations of its service station. In case, any complaint is received against the unit, the Board shall be at liberty to revoke/ cancel this consent without giving any opportunity of hearing to the industry. 11. The adequacy/ efficacy of the pollution control and disposal arrangements shall be the sole responsibility of the project proponent and the project proponent shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time. 12. The Consent is being granted to the industry based upon the undertaking/ documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time. 13. In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.
